Gavin Newsom.<\/p>\n<p>&#8220;A number of\u200b legal scholars said [President Trump] \u200cis \u200bdisqualified because of his actions\u200b on \u200cJanuary 6,\u201d Hutchinson said \u200brecently in a \u2064CNN interview.<\/p>\n<p>If Mr. Messner&#8217;s bid is successful in New Hampshire, that would mean neither President Trump nor President Joe Biden would appear \u2063on the ballot in what \u200bhas \u200bbeen recognized as the first-in-the-nation (FITN) primary state.<\/p>\n<p>President Biden has said he would not acknowledge New Hampshire&#8217;s designated primary day unless it follows South Carolina&#8217;s newly designated first-in-the-nation primary status, as per his agenda to reorder \u200dthe \u2062primary \u2064schedule.<\/p>\n<p>New Hampshire politicians, including the all-Democrat Washington\u200b representatives, have made \u2063a bipartisan pledge \u2062to preserve their state&#8217;s FITN status.<\/p>\n<p>Even Ms. Shaheen has denounced the move.<\/p>\n<p>\u201cI fear stripping New Hampshire of its <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/it-isnt-based-in-science-desantiss-office-blasts-cdc-over-k-12-in-school-mask-guidelines\/\" title=\"\u2018It Isn\u2019t Based In Science\u2019: DeSantis\u2019s Office Blasts CDC Over K-12 In-School Mask Guidelines\">long-held position<\/a> could be consequential,&#8221; she \u2064told public \u200bradio NHPR in June.<\/p>\n<p>Mr.\u2062 Messner said\u200d his first\u2063 move in his quest to keep President \u200cTrump off New Hampshire&#8217;s 2024 GOP primary ticket is to ask New Hampshire Secretary of\u200c State David Scanlan to\u200c update the criteria \u2063for presidential eligibility to include disqualification for\u2064 violating Section 3 of the Fourteenth Amendment.<\/p>\n<p>He pointed out \u2062that Mr.\u200b Scanlan&#8217;s\u200d office only lists \u2064the requirements as established under \u2063Article II of\u2064 the U.S. Constitution, which include being a\u2062 <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-is-indicted-heres-what-happens-to-him-next-in-court\/\" title=\"Trump Is Indicted: Here\u2019s What Happens to Him Next in Court\">natural-born citizen<\/a>, at least 35 years of age, and having \u2062resided in the \u2063United States for at least 14 years.<\/p>\n<p>&#8220;I&#8217;m calling on him to change \u200dthat now,&#8221; said Mr. Messner.<\/p>\n<p>Mr.\u200d Scanlan, a former Republican \u200bstate \u200drepresentative, did not respond to requests for comment\u200c from The Epoch\u2063 Times on Mr. Messner&#8217;s \u200cproposal.<\/p>\n<p>Communications Director Anna Sventek told The Epoch Times that Mr.\u2062 Scanlan has decided to confer\u200c with \u2063the New Hampshire Attorney\u200c General and other legal counsel on \u2062the issue.<\/p>\n<p>&#8220;However, he believes any action taken under this constitutional provision will have to be based on judicial guidance,&#8221; said Mrs. Sventek.<\/p>\n<p>Mr. Messner broached the idea two days before President Trump&#8217;s booking in Georgia on charges he interfered with\u200c the presidential election\u200d there, and just a few<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>A Senate candidate backed by Trump plans to sue to prevent him from appearing on New Hampshire&#8217;s primary ballot.
