Chip Roy of Texas is fighting to protect veterans&#8217; Second\u200b Amendment rights from interference by the Biden administration bureaucrats at the Department of Veterans \u2062Affairs (VA).<\/p>\n<p>Introduced by Reps. Roy, Eli Crane of Arizona, Lance Gooden of Texas, Andrew Clyde of \u200cGeorgia, Andy Harris of Maryland, \u200band Mary Miller of Illinois, this legislation specifically prevents the VA from sharing veterans&#8217; names with the\u2062 Department of Justice to \u200cbe added to the federal government&#8217;s no-gun \u200blist.<\/p>\n<p>Currently, \u200dthe VA requires \u200bveterans\u2062 who want to appoint a fiduciary\u2064 to manage their benefits \u200cto risk \u2063losing their \u200dSecond\u2062 Amendment rights. The fiduciary program, as stated by the VA, aims to\u2063 protect veterans and beneficiaries who\u200d are unable to manage \u2062their VA benefits. However, the VA does not \u200dassess whether a veteran is a danger to \u200dthemselves or others during the fiduciary evaluation process. Despite this, any veteran deemed &#8220;unable to manage&#8221; their benefits by the VA is automatically prohibited from purchasing or owning firearms or ammunition.<\/p>\n<p>Their names are\u200c then shared with the\u2064 FBI&#8217;s National Instant Criminal Background Check System (NICS), which\u200b <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/fact-checkers-rush-to-defend-downplay-joe-bidens-gun-show-loophole-claims\/\" title=\"Fact-Checkers Rush To Defend, Downplay Joe Biden\u2019s \u2018Gun Show Loophole\u2019 Claims\">federal firearm dealers<\/a> use to \u200bdetermine\u200b eligibility for\u2062 gun purchases. Veterans with \u200bfiduciaries are placed in an &#8220;adjudicated\u200c mental defective&#8221; category, effectively \u200dstripping \u200bthem of their Second \u2063Amendment rights indefinitely.<\/p>\n<p>FBI data from 2023 reveals that nearly 98 percent of the names in the NICS &#8220;mental defective&#8221; category were \u2064provided\u200c by the VA.<\/p>\n<p>The VA warns that knowingly violating this law may result in fines and\/or\u200d imprisonment.<\/p>\n<p>A memo released\u2062 by House \u200dVeteran \u2063Affairs Committee Chairman Mike Bost \u2063highlights that the decision to name a fiduciary and disarm veterans is often made by VA general \u200bschedule employees, rather than a court \u200bor <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/new-bill-would-stop-va-bureaucrats-from-gaming-the-system-to-grab-veterans-guns\/\" title=\"New bill aims to prevent VA bureaucrats from manipulating system to seize veterans' firearms.\">similar judicial authority<\/a>. While\u200d there is an appeals process for veterans seeking \u200brelief from firearms prohibitions, the VA ultimately determines whether or not that relief is\u2062 granted.<\/p>\n<p>The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bidenflation-is-costing-the-average-american-family-11500-this-year\/\" title=\"Bidenflation Is Costing the Average American Family ,500 This Year\">committee estimates<\/a>\u2062 that\u2063 hundreds of thousands of veterans and their family members \u200chave been\u2063 denied their constitutional \u2064right \u2062to bear arms based on the judgment of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/dhss-alejandro-mayorkas-builds-escalator-for-asylum-migrants\/\" title=\"DHS's Alejandro Mayorkas Builds Escalator for Asylum Migrants\">low-level bureaucrats<\/a>.<\/p>\n<p>&#8220;America&#8217;s heroes should \u200dnever have to fear \u2063losing their God-given right to self-defense simply\u2062 for seeking the care they have \u200bearned \u200bin the\u2063 process of protecting \u2062our republic,&#8221; said \u2064Roy. \u200b&#8221;Yet, instead of focusing on securing the border or defeating foreign enemies like China,\u200d Democrats are set to take \u2064aim\u200d at our veterans&#8217; Second Amendment rights.
