An extra restroom break for a\u200d pregnant cashier\u2062 on her feet all day.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Congress recently passed a new law, the \u2064Pregnant \u2064Workers Fairness Act, to ensure\u2063 that every pregnant woman receives fair, reasonable job accommodations to keep her and her unborn child healthy and safe while she remains in the workforce. It was \u200ca transformational, bipartisan, \u200cpro-woman law to ensure employers reasonably accommodate pregnancies, childbirth, and \u200drelated conditions.<\/span><\/p>\n<p><span style=\"font-weight: 400\">What the law did <\/span><i><span style=\"font-weight: 400\">not<\/span><\/i><span style=\"font-weight: 400\">  include was a right to an abortion.<\/span><\/p>\n<blockquote>\n<h3>The Biden Administration&#8217;s Illegal Move<\/h3>\n<p><span style=\"font-weight: 400\">Yet the Biden administration\u2062 has illegally hijacked this law as its latest vehicle to \u2064try\u200d and impose \u2062an abortion mandate on the American people. Recently,\u200c the U.S. Equal \u200bEmployment Opportunity Commission proposed <\/span><a href=\"https:\/\/www.federalregister.gov\/public-inspection\/2023-17041\/regulations-to-implement-the-pregnant-workers-fairness-act\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">new\u200b regulations<\/span><\/a><span style=\"font-weight: 400\">  for \u200cimplementing the Pregnant\u200b Workers Fairness Act to require virtually every employer\u2064 in the country, even\u200d pro-life and \u2062religious Americans\u2062 who recognize that life begins at conception, to facilitate abortion.<\/span><\/p>\n<\/blockquote>\n<p><span style=\"font-weight: 400\">The Pregnant Workers Fairness Act requires every employer\u2062 in\u200d America to \u201creasonably accommodate\u201d a worker\u2019s \u201cpregnancy, childbirth,\u2063 or related medical conditions.\u201d The administration is now proposing that \u201crelated medical\u2063 conditions\u201d include \u201ctermination of pregnancy, including\u200b via \u2026 abortion.\u201d\u200b This new mandate would require employers \u200cwith more than 15 employees to create\u2063 \u201creasonable accommodations\u201d for their workers\u2019 elective abortions, even\u2064 if doing so violates their \u200dpro-life\u200c or religious\u2064 beliefs.<\/span><\/p>\n<p><span style=\"font-weight: 400\">But Congress sought to\u2064 protect pregnant workers,\u2062 not\u2063 force employers to \u200cfacilitate\u2064 abortions.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Ever since the U.S. Supreme Court affirmed the value\u200d of unborn lives in <\/span><i><span style=\"font-weight: 400\">Dobbs v.\u2064 Jackson Women\u2019s Health Organization<\/span><\/i><span style=\"font-weight: 400\">, Alliance\u200d Defending Freedom has tracked the administration\u2019s effort to find every \u2063possible avenue to\u200b advance a pro-abortion \u2064agenda, even if doing so \u2062is illegal and grossly exceeds the authority of the executive branch. From trying to \u200brequire <\/span><a href=\"https:\/\/adflegal.org\/article\/mayo-pharmacy-challenging-mandate-dispense-abortion-drugs?utm_source=dailywire&#038;utm_medium=oped\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">pharmacies<\/span><\/a><span style=\"font-weight: 400\">  that accept Medicaid patients to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-deep-blue-path-to-infanticide\/\" title=\"The Deep Blue Path To Infanticide\">dispense abortion-inducing drugs<\/a>, to forcing <\/span><a href=\"https:\/\/adflegal.org\/press-release\/court-halts-biden-admins-attempt-turn-ers-abortion-facilities?utm_source=dailywire&#038;utm_medium=oped\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">emergency\u2064 room \u2062doctors<\/span><\/a><span style=\"font-weight: 400\">  to perform and complete abortions, to\u2063 creating \u200ca 50-state online \u2062 <\/span><a href=\"https:\/\/adflegal.org\/case\/alliance-hippocratic-medicine-v-us-food-and-drug-administration?utm_source=dailywire&#038;utm_medium=oped\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">mail-order chemical abortion drug economy<\/span><\/a><span style=\"font-weight: 400\">.<\/span><\/p>\n<p><span style=\"font-weight: 400\">This emboldened pro-abortion activists to call on the\u200d administration, through the EEOC, to\u200d read into\u200c the Pregnant Workers Fairness Act an abortion mandate on employers across\u2064 the country, requiring them to \u201caccommodate\u201d an employee\u2019s elective abortion, regardless of state laws\u200d protecting unborn life or employers\u2019 pro-life positions or religious beliefs.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The\u2062 EEOC\u2019s new mandate requires employers, for example, to give \u200dwomen extra time off from \u200cwork to\u200d make it possible for them to obtain abortions, even if <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-administration-hijacks-pregnant-workers-law-to-further-abortion\/\" title=\"Biden Administration exploits pregnancy law to advance abortion agenda.\">state law prohibits intentionally assisting women<\/a> in obtaining abortions \u2014 and even if the state <\/span><i><span style=\"font-weight: 400\">is<\/span><\/i><span style=\"font-weight: 400\">  the woman\u2019s employer.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Pro-life\u200b and religious employers have the right to live and speak the truth about the sanctity of life \u2014 the importance\u200b of caring for unborn children and \u2064their mothers.\u200b But the Biden administration has refused to craft any exemptions in the text of its new abortion regulations.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Whether to\u200c impose an abortion mandate on virtually every employer in America is a major question that only Congress can tackle through the democratic process. The Supreme Court thus would \u2062require the \u2064administration to show clear language in the text of the act \u200cgiving them authority to impose this mandate. None exists. Congress did\u2063 not put abortion\u2064 anywhere in the text of the law, so there\u2063 is no legal \u200cauthority for any new federal \u2064regulations regarding abortion. Indeed, Senator Bob\u200d Casey (D-PA), the chief sponsor of\u2064 the bill, <\/span><a href=\"https:\/\/www.congress.gov\/congressional-record\/volume-168\/issue-200\/senate-section\/article\/S10081-2\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">promised<\/span><\/a><span style=\"font-weight: 400\">  that the law did not authorize any \u201cregulation that requires abortion leave.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">The proposed rule was \u200cpublished on August \u206411, kicking off a 60-day\u2062 period for Americans to <\/span><a href=\"https:\/\/www.federalregister.gov\/public-inspection\/2023-17041\/regulations-to-implement-the-pregnant-workers-fairness-act\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">let their voices be heard<\/span><\/a><span style=\"font-weight: 400\">. What they should tell the administration \u200bis that it \u2062doesn\u2019t have the legal authority to smuggle an abortion mandate into a pro-woman, pro-life law.
