The complaint alleges that the Department of State is \u2064violating \u200cthe Help America Vote Act (HAVA) by not\u200b requiring overseas voters to provide identification when\u200c registering to vote.<\/p>\n<p>HAVA, which was passed in 2002, established minimum election standards for state and local governments in the administration of Federal elections.<\/p>\n<p>The Uniformed and Overseas Citizens Absentee Voting Act \u2064(UOCAVA), passed by \u200dCongress\u2063 in 1986, allows absentee \u2064voting \u2062by members of the U.S. military and merchant marine, their family members, and U.S. citizens residing outside the United States. \u200dThis \u2063includes individuals who have never \u2062lived in the United States and have no intention of \u200bdoing so.\u2064 People born overseas to U.S. citizens are also considered U.S. \u200ccitizens and may be eligible to vote in U.S. \u200celections \u2063in certain \u200dstates.<\/p>\n<p>The HAVA\u200d requires individuals\u200c to apply to register to vote, but they are not considered voters\u200b until the application process is complete.<\/p>\n<p>UOCAVA voters \u200ccan register\u200b using the Federal Post Card Application, \u2062which serves as both a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/leading-candidate-for-new-york-city-mayor-may-not-live-in-city-report-suggests\/\" title=\"Leading Candidate For New York City Mayor May Not Live In City, Report Suggests\">voter registration form<\/a> and an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/more-suspicious-elections-absentee-data-from-detroit-36-of-absentee-ballots-returned-were-from-people-who-were-not-listed-as-being-sent-an-absentee-ballot\/\" title=\"More Suspicious Elections Absentee Data from Detroit: 36% of Absentee Ballots Returned Were From People Who Were Not Listed as Being Sent an Absentee Ballot\">absentee ballot application<\/a>.<\/p>\n<h3>Minimum Voter Registration Requirements<\/h3>\n<p>According to HAVA, voter registration\u2063 applicants must provide their driver&#8217;s \u200clicense number or the last four digits of their Social Security number. The Secretary of State is responsible for\u2063 verifying \u2064the applicant&#8217;s identity by matching these numbers with official records.<\/p>\n<p>If\u200b an applicant does not\u2062 have a driver&#8217;s license or Social Security number, the\u2062 state may \u200bassign a unique number. However,\u2064 individuals without these identification numbers cannot vote in a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-ag-barr-authorizes-federal-prosecutors-to-pursue-substantial-allegations-of-voting-irregularities-before-2020-election-is-certified\/\" title=\"BREAKING: AG Barr Authorizes Federal Prosecutors to Pursue \"Substantial Allegations\" of Voting Irregularities Before 2020 Election is Certified\">federal election<\/a> unless they\u200b provide another document to establish their identity \u2063and eligibility.<\/p>\n<p>Simply put, individuals cannot be considered \u2064voters until they are registered and their identification is\u2063 verified.<\/p>\n<p>However, Pennsylvania has been \u200dsending ballots to \u2062UOCAVA applicants before verifying\u200b their identification. In 2018, the Department of State issued guidance stating that voter registrations should not be rejected solely based\u200b on a\u2064 nonmatch\u200d between the applicant&#8217;s identifying numbers \u2064and the comparison database numbers.<\/p>\n<p>The complaint filed\u2063 by PA\u2063 Fair Elections argues that this policy violates HAVA&#8217;s identification verification and matching requirement.
