An\u2063 Aug. 28 hearing was ordered\u2062 the day after.<\/p>\n<p>The Georgia \u200dcase had been brought by Fulton County District Attorney against the 19 defendants for\u2064 violating the state&#8217;s Racketeer \u2062Influenced and Corrupt \u2064Organizations \u200d(RICO) Act when they acted to challenge the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-vows-to-fight-all-politically-charged-indictments-as-potential-third-case-looms\/\" title=\"Trump pledges to combat all politically motivated charges amid looming third case.\">2020 election \u200bresults<\/a>\u2063 in what Ms. Willis called a &#8220;criminal\u200d racketeering enterprise.&#8221; \u200dThe indictment alleges the defendants knowingly committed false and\u200b fraudulent deeds \u200cwhile \u200dbelieving President\u2063 Trump had actually lost reelection.<\/p>\n<blockquote>\n<h3>Related Stories<\/h3>\n<ul>\n<li>\n        <a href=\"http:\/\/www.theepochtimes.com\/us\/judge-denies-meadows-clark-motion-to-avoid-arrest-in-georgia-election-case-5479502\">Judge Denies Meadows,\u2062 Clark Motion\u2063 to Avoid Arrest in \u2063Georgia Election Case<\/a><br \/>\n        <br \/>\n        <span class=\"text-comp-caption\">8\/23\/2023<\/span>\n      <\/li>\n<li>\n        <a href=\"http:\/\/www.theepochtimes.com\/us\/da-willis-says-mark-meadowss-defense-to-remove-case-before-arrest-is-baseless-5479370\">DA Willis Says Meadows&#8217;s Attempt to Thwart Arrest Is &#8216;Baseless&#8217;<\/a><br \/>\n        <br \/>\n        <span class=\"text-comp-caption\">8\/23\/2023<\/span>\n      <\/li>\n<\/ul>\n<\/blockquote>\n<p>She gave the \u200ddefendants \u2063until noon on Aug. 25 to surrender\u200d voluntarily or face arrest.<\/p>\n<p>Mr. Meadows was charged with two counts; in addition to \u2063racketeering, he was accused of &#8220;unlawfully soliciting, requesting, and\u2062 importuning&#8221; Georgia Secretary \u200cof State Brad\u200c Raffensperger to violate his oath of office during a phone call where President\u200d Trump asked about the\u200c state&#8217;s votes and asked Mr. Raffensperger to investigate election \u2064fraud.<\/p>\n<p>Mr. Meadows argues that \u200dall of his actions were taken\u2062 as a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/treasury-department-hit-with-large-scale-breach-national-security-council-now-involved\/\" title=\"Treasury Department Hit with Large-Scale Breach, National Security Council Now Involved\">federal official<\/a> and that the actions\u2062 listed in the indictment\u2062 were things one &#8220;would expect a Chief\u200d of Staff to\u200d the President of \u200dthe United \u200bStates to do.&#8221; The removal to federal court would have also dismissed the case against him, under the supremacy clause in the U.S. Constitution.<\/p>\n<div class=\"shortcode\">\n<div class=\"lazyload-wrapper\">\n<div class=\"lazyload-placeholder\"><\/div>\n<\/p><\/div>\n<\/p><\/div>\n<p>On\u200d Aug. 18, \u200bMr. Meadows&#8217;s lawyers filed a motion to\u2063 dismiss all \u2064charges against him based on supremacy clause immunity.\u200c Federal law precedes state\u200c laws and\u200c courts, and \u200dprecedents have ruled that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/mark-meadows-surrenders-released-on-100000-bond-in-trump-election-case\/\" title=\"Mark Meadows surrenders, granted 0,000 bond in Trump election lawsuit.\"><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/antifa-blm-vandalize-ice-building-burn-original-starbucks\/\" title=\"Antifa, BLM vandalize ICE building, burn original Starbucks\">federal officers<\/a> conducting \u2062official\u200c duties<\/a> do not\u2063 have to consider state law and\u2063 that cases against federal officers should be tried in federal court.<\/p>\n<p>Meanwhile, \u200bMr. Meadows&#8217;s lawyers sent several rounds of communications to Ms. Willis&#8217;s office, which they later submitted \u2063to court. The attorneys had requested to \u2063meet earlier than Monday,\u200d Aug. 28 to discuss the\u2063 case removal, and Ms. Willis&#8217;s office said that would not \u2064be possible.\u2063 Then,\u2063 they requested the arrest deadline be delayed for their client until after the\u200d Aug. 28 hearing on his case removal, with the expectation that \u2063no arrest would\u2064 be necessary once the\u2062 case had been removed.<\/p>\n<p>Ms. Willis refused,\u200b responding that Mr. Meadows would be \u200dtreated like any other criminal defendant.<\/p>\n<p>&#8220;We both know that \u2064is simply not true,&#8221; attorney John Moran \u2062wrote in response.<\/p>\n<p>They then filed\u2063 an emergency motion in court, requesting an immediate resolution. \u200bMs. Willis \u200bwas given an Aug.\u2062 23 deadline to respond, in which she called Mr. Meadows&#8217;s motion &#8220;baseless&#8221; and &#8220;meritless.&#8221;<\/p>\n<p>U.S. District Court Judge Steve Jones of the \u200cNorthern District of \u200cGeorgia, an appointee of former President Barack Obama,\u200d denied the emergency motion\u2064 the same \u2062day, citing the pending hearing.<\/p>\n<h2>Witnesses Subpoenaed to Testify<\/h2>\n<p>Only one \u200cnotice of removal is required to \u2063move \u2064the \u2062entire case\u2062 to federal court, Mr. Meadows&#8217;s lawyers noted. The issue of removal was raised by observers since the unusual indictment \u2063was\u2062 handed up\u200d on Aug. 14. Because it\u200c is a \u200bstate criminal \u2063case, not a \u200bfederal\u2064 one,\u200c a conviction could not be pardoned\u200d by a president.<\/p>\n<p>Besides \u200dMr.\u2062 Meadows, former Justice \u2062Department official \u2063Jeffrey Clark and alternate elector David \u2063Shafer have also filed notices\u2062 of removal.<\/p>\n<p>Ms. Willis is\u2062 expected\u200b to contest\u2063 the \u2063request for removal, which she \u2063 <a href=\"https:\/\/www.courtlistener.com\/docket\/67694389\/27\/the-state-of-georgia-v-meadows\/\" target=\"_blank\" rel=\"noopener\">argued<\/a> \u2064 against \u200din a response \u2062filed Aug. 23.<\/p>\n<p>&#8220;Because the defendant faces charges that do not \u200darise from conduct \u200cunder the color of his office, and \u200dbecause he can offer no \u200dplausible federal\u200d defense, the State of Georgia \u2064respectfully requests that this Court \u200cremand the case to the Superior Court of Fulton County,&#8221; it reads.<\/p>\n<p>It accuses Mr. Meadows of \u200bact<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Mark Meadows, ex-chief of staff to the president, surrendered on Aug. 24 at Fulton County jail, released on $100,000 bond.
