However, new laws in North Carolina have placed limitations on the governor&#8217;s authority\u2064 to\u200c impose public health restrictions.<\/p>\n<p>According to data from the Centers for\u2062 Disease Control and Prevention, COVID-19 hospitalizations have \u2064increased for five consecutive weeks, reaching 12,613 new admissions for the week of Aug. 12. This marks a significant rise of over 21% compared to the \u2062previous\u200b week.<\/p>\n<h3>Mask Mandates Return in \u200dCertain \u200dInstitutions<\/h3>\n<p>This week, Morris Brown\u2063 College \u2064in Georgia and Lionsgate, a major Hollywood \u2062Studio,\u2063 have reintroduced mask mandates.\u2063 Additionally,\u2062 universities such as Rutgers and Georgetown are now \u200brequiring masks \u2062to be worn\u2063 indoors, as reported by No College Mandates, a group that tracks\u2063 COVID-19 policies in higher education.<\/p>\n<p>While the current increase \u2062in hospitalizations is\u200b still significantly\u2062 lower than last year and 2021, the head \u2063of the CDC, Dr. Mandy Cohen, remains a strong advocate for masking and limiting gatherings.<\/p>\n<h3>Limitations on Governor&#8217;s Authority<\/h3>\n<p>In 2020, North Carolina&#8217;s Emergency Management Act\u2062 was utilized to\u200c impose various restrictions, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/former-fda-head-mask-mandates-should-end-in-wholesale-fashion-officials-need-to-rollback-restrictions-to-keep-integrity\/\" title=\"Former FDA Head: Mask Mandates Should End In \u2018Wholesale Fashion,\u2019 Officials Need To Rollback Restrictions To Keep \u2018Integrity\u2019\">including mask mandates<\/a> and \u2063limitations on leaving home, attending\u2062 school, and operating businesses. \u200cEven houses of faith faced restrictions, \u2064and the \u2062state of emergency lasted a staggering 888 days.<\/p>\n<p>In response \u200cto these measures, lawmakers, primarily led \u200bby the Republican majority, passed several bills to curtail the governor&#8217;s authority during a declared emergency. Although \u2064Governor Cooper vetoed all of them, a \u2062budget bill signed in November 2021 included a series of \u2064changes.<\/p>\n<p>The new\u200c provisions, effective since Jan. 1, require greater agreement from <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/missouri-state-pension-system-loses-money-due-to-ftx-bankruptcy\/\" title=\"Missouri State Pension System Loses Money Due to FTX Bankruptcy\">statewide elected officials<\/a> on the Council \u200cof State. They\u2062 also\u200b mandate consultation with the General Assembly to extend a state of emergency. The Council of State comprises the governor, lieutenant \u200dgovernor, \u200battorney general, secretary of state, commissioners of labor, \u2062agriculture, and insurance, as \u2064well as the state&#8217;s auditor, superintendent of\u200b public instruction, and treasurer.<\/p>\n<p>Under the new law, the \u2062governor must obtain consensus from \u2063a majority of the Council\u2063 of State within 48 hours before exercising any power \u200bor\u200c authority requiring their concurrence. If council members fail to respond within \u2062the given timeframe, their lack of response is\u2062 considered a concurrence.<\/p>\n<p>Furthermore,\u2063 the law requires\u2063 the governor to document the contact\u2064 and response of each council member and publicly publish those responses on the same\u2064 website where executive orders are posted. These changes effectively limit a governor&#8217;s ability to unilaterally impose emergency powers or restrictions without consensus from the bipartisan council.<\/p>\n<p>Additional provisions of the law define a statewide emergency as one that applies to two-thirds or more of the counties and impose restrictions on the duration of an emergency. A declared state of emergency automatically expires after 30 days without approval from\u2063 a majority of council members. If necessary, the \u200bcouncil can extend the state \u200cof emergency to 60 days, but any \u200bfurther extension \u2064requires approval from\u200c the \u200bGeneral Assembly through the passage of a\u200d law.<\/p>\n<p>The new\u200b provisions also \u200cprevent any governor from bypassing the General Assembly or\u2063 Council of State by issuing a substantially \u2062similar\u200c declaration \u200cof emergency arising from \u200cthe same events that led to \u2064the initial declaration.<\/p>\n<p>North Carolina&#8217;s restrictions on emergency powers \u2063have earned a score of 66 on the Maine Policy \u200bInstitute&#8217;s \u2064Emergency Powers Checks \u200b&#038; Balances Scorecard 2023. This scorecard rates states on a \u200cscale of 1-100, with \u200c<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/mask-mandates-here-are-the-new-rules-in-north-carolina\/\" title=\"New rules in North Carolina: Mask mandates explained.\">higher scores indicating greater safeguards<\/a> of liberty \u2063through legislative \u200ccounterbalance to\u200b the governor.<\/p>\n<p>North Carolina&#8217;s score is tied with Arkansas for the eighth highest figure, \u2062trailing behind South Carolina at 83, Kansas\u200c at 81, New Hampshire \u2062and Minnesota at 76, Montana and Utah at 73, and\u2062 Alaska, Michigan, and Georgia at 71.
