She also \u2062filed a similar response \u2064opposing a request for \u2062a pause made by defendant Jeffrey Clark, a former Justice Department official.\u2063 Willis is urging the judge to deny both requests.<\/p>\n<p>U.S. District\u200b Judge Steve Jones \u2062subsequently denied both emergency motions\u200d to pause the proceedings. While the order on Clark&#8217;s request was brief, the order on Meadows&#8217; request spanned six\u200b pages and cited an upcoming hearing as the rationale. The court refrained from commenting on the removal\u200c itself, focusing solely on the defendants&#8217; ability to avoid arrest while their notice of removals are pending.<\/p>\n<p>Willis set a deadline of noon\u200c on Aug. 25 for the 19 defendants to surrender \u200dvoluntarily or face arrest.<\/p>\n<h2>Emergency \u2063Motion<\/h2>\n<p>A day after the indictment\u200d on Aug. \u200c14, Meadows filed a notice of removal, seeking to move the case to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/savage-to-newsmax-im-filing-injunction-to-stop-biden-firing\/\" title=\"Savage to Newsmax: I'm Filing Injunction to Stop Biden Firing\">federal court based<\/a> on his status as a federal officer. \u2064Other defendants followed suit with similar notices in the following week.<\/p>\n<p>An evidentiary hearing between the prosecution, Willis, and Meadows&#8217; attorneys \u2064was scheduled for\u200c Aug. 28. However, Meadows&#8217; attorneys argue that, under his constitutional federal officer immunity, he is immune to arrest and other court actions in state jurisdiction.<\/p>\n<p>They \u2064pushed\u2064 for an earlier hearing or a ruling \u200cwithout a hearing, after multiple\u200c requests to meet with Willis&#8217;s office before the noon deadline \u200don Aug. 25 went unanswered.<\/p>\n<p>Willis declined, stating that &#8220;your client is no different than any other \u200ccriminal defendant \u200cin this jurisdiction. Two \u200dweeks was a tremendous courtesy. At 12:30, I shall file warrants\u200b in the system.&#8221;<\/p>\n<p>The court then gave Willis \u2063a deadline of 3 p.m. on Aug. 23 to respond to Meadows&#8217; emergency motion.<\/p>\n<p>The response from the State asks the court to \u2062dismiss or deny \u200bthe emergency motion.<\/p>\n<h2>DA Response<\/h2>\n<p>Willis argued that \u2063Meadows&#8217; \u2062contention that the case should be immediately removed on the papers is meritless. She pointed to Code 1445, which prevents conviction in a case being removed but does not prevent other proceedings. Meadows&#8217; lawyers had argued that the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/da-willis-says-meadowss-attempt-to-thwart-arrest-is-baseless\/\" title=\"DA Willis dismisses Meadows's attempt to obstruct arrest as 'groundless'.\">supremacy clause prevents \u200dfederal officers<\/a> from being arrested and brought to trial in state court, citing a \u200dcase from\u200b 1879.<\/p>\n<p>Willis further argued that an evidentiary hearing is required, even if the notice of removal is pending \u200cin federal court.<\/p>\n<p>She wrote, &#8220;The\u2063 defendant&#8217;s request to immediately remove the case is a not \u2064so subtle request to invite the Court to improperly prevent the State\u200d from proceeding against the defendant pending the Court&#8217;s ruling on the notice of \u2062removal.&#8221; Willis asked the court to dismiss\u2062 or deny the emergency\u2063 motion.<\/p>\n<p>She also\u200c emphasized that the possibility of \u200cMeadows needing to defend himself in both state and federal court does not constitute irreparable injury. Willis cited previous cases where federal courts have denied requests to interfere in <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/da-bragg-sues-jim-jordan-over-supposed-campaign-to-intimidate\/\" title=\"DA Bragg Sues Jim Jordan Over Supposed \"Campaign to Intimidate\"\">state criminal prosecutions<\/a>, particularly when the state cases are brought in good faith.<\/p>\n<p>&#8220;Here, the defendant does not allege that his prosecution is\u200b taken in bad faith, that there is no hope of\u2063 obtaining a valid conviction, or that it\u2064 is being taken to harass the defendant.
