Counsel Jack\u2062 Smith has revealed in\u200b a recent court filing that the Washington grand jury in the \u200dclassified documents case against former President Donald Trump has ended, after the judge challenged the special counsel\u200c over his use of an out-of-state grand jury.<\/p>\n<p>While Mr. Smith empaneled a grand jury in Miami to indict \u200cPresident Trump in Florida, the special counsel was also using an out-of-state grand jury in Washington, \u2064possibly in\u200c hopes of adding charges\u200c in the case, which accuses the former president of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/jack-smith-ends-dc-grand-jury-in-trump-documents-case-after-challenge-from-judge\/\" title=\"Judge challenges Jack Smith's decision to end DC Grand Jury in Trump documents case.\">inappropriately keeping \u200dnational defense secrets<\/a> at his Mar-a-Lago home.<\/p>\n<p>Earlier in August, Florida-based federal Judge Aileen Cannon reprimanded Mr. Smith for his use of\u2063 the Washington grand jury and\u2064 demanded that he justify its use.<\/p>\n<div class=\"shortcode\">\n<div class=\"border-comp-divider mb-4 mr-4 w-full an Aug. 7 order, Judge Cannon <a href=\"https:\/\/www.courtlistener.com\/docket\/67490070\/100\/united-states-v-trump\/\" target=\"_blank\" rel=\"noopener\">directed<\/a> the DOJ to \u201caddress the legal\u2062 propriety\u200c of \u200dusing an out-of<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-shoots-down-smiths-requests-in-special-counsel-case\/\" title=\"Judge denies Smith's requests in special counsel case.\">-district grand jury proceeding<\/a> to continue to investigate and\/or to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-seeks-explanation-for-out-of-district-grand-jury-proceeding-in-trump-docs-case\/\" title=\"Judge wants explanation for 'out-of-district grand jury' in Trump documents case.\">seek post-indictment hearings<\/a> on matters pertinent \u200dto the instant indicted matter in this district.\u201d<\/p>\n<p>She imposed a deadline\u2064 of Aug. 22 \u2063for the government to respond.<\/p>\n<div class=\"shortcode\">\n<div class=\"lazyload-wrapper\">\n<div class=\"lazyload-placeholder\"><\/div>\n<\/p><\/div>\n<\/p><\/div>\n<h2>Mr. Smith&#8217;s Team Responds<\/h2>\n<p>The matter of\u200c the out-of-state grand jury\u2064 was addressed by Mr. Smith&#8217;s team \u2063in a new filing\u00a0(<a href=\"https:\/\/s3.documentcloud.org\/documents\/23924535\/special-counsel-filing-in-trump-case.pdf\" target=\"_blank\" rel=\"noopener\">pdf<\/a>) on Aug. 22, \u2064which indicates that its use has ended.<\/p>\n<p>The DC grand jury\u2062 &#8220;completed its \u2063term on August 17,\u200b 2023,&#8221; wrote\u00a0David Harbach, one of Mr. Smith&#8217;s \u200cdeputies,\u2063 in the filing.<\/p>\n<p>At the same \u2064time, Mr. Harbach defended the use of the DC grand jury alongside the one in Florida,\u200c arguing that a two-pronged approach was appropriate because there was alleged criminal conduct\u2062 in both places that should be investigated.<\/p>\n<p>&#8220;Following the indictment in this case, the \u200dGovernment \u200ccontinued to investigate false statements by two\u2063 witnesses in the District of Columbia, and\u200d the hearing \u2064before the Chief Judge in the District of Columbia appropriately stemmed from that investigation,&#8221; Mr. Harbach \u2062wrote.<\/p>\n<p>Mr. Harbach wrote in the filing that an employee of President Trump changed his testimony after \u200cgetting a new lawyer and has admitted that he lied to the DC grand jury.<\/p>\n<p>The employee had told a grand jury in March that he did not recall or did \u2063not have any conversations about \u200dsecurity footage at\u200b President Trump&#8217;s resort in Florida, \u2062Mar-a-Lago, according to prosecutors.<\/p>\n<p>&#8220;Immediately after receiving new counsel, Trump\u2063 Employee 4 retracted his prior false testimony and provided information that implicated Nauta, De Oliveira, and Trump in\u200c efforts to\u2063 delete \u2062security camera footage, as set forth in the superseding indictment,&#8221; per the filing.<\/p>\n<p>Carlos De Oliveira, the 56-year-old property manager at Mr. Trump&#8217;s Florida estate, was added \u200cas \u200da third defendant\u200c in the case, alongside the\u2064 former president and his personal \u200dvalet, Walt\u2062 Nauta.<\/p>\n<p>Mr. Smith&#8217;s \u200cteam accused President Trump in a\u200c &#8220;superseding indictment&#8221; (<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.flsd.648653\/gov.uscourts.flsd.648653.85.0_3.pdf\" target=\"_blank\" rel=\"noopener\">pdf<\/a>) filed in the case on July \u206327\u2062 of conspiring with his staff to delete some security footage so that the grand jury in\u200c the case would\u2062 not\u200d see all the \u200cevidence. The former president has denied the charges.<\/p>\n<p>President Trump now faces a total of\u2062 40 federal charges\u200d related to the\u200c documents that he possessed at\u200d his home at the Mar-a-Lago\u2064 Club in Palm Beach.<\/p>\n<h2>&#8216;Appropriate&#8217; \u200bUse of DC Grand Jury?<\/h2>\n<p>Mr. Harbach \u2062said in the filing that Trump Employee 4 <a href=\"https:\/\/www.theepochtimes.com\/us\/trump-employee-admitted-to-lying-to-grand-jury-special-counsels-team-says-5479060\" target=\"_blank\" rel=\"noopener\">was told<\/a> by\u2064 prosecutors \u200bthat he had become a target of\u200b an investigation into whether he lied to\u2063 the DC grand jury before\u2062 changing his testimony.<\/p>\n<p>The filing also defends the use of the DC grand\u200c jury, saying that it was\u2062 not used &#8220;for the primary purpose of strengthening\u2064 its case&#8221; against \u2064the former president and his co-defendants, as \u2064some have alleged.<\/p>\n<p>&#8220;Not only\u200b was it appropriate \u200dto use the grand jury to investigate false statements by Trump Employee 4 and De Oliveira, it was appropriate to use the grand jury in\u200b the District of Columbia, where the statements were made and where venue for <\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Special Counsel Jack Smith&#8217;s use of an out-of-state grand jury in the classified documents case against former President Donald Trump was challenged by the judge.
