Foerster LLP.<\/p>\n<p>AAFER filed its lawsuit (<a href=\"https:\/\/mma.prnewswire.com\/media\/2191596\/AAFER_Law_Firm_Perkins_Complaint_STAMPED.pdf?p=pdf\" target=\"_blank\" rel=\"noopener\">pdf<\/a>) against Perkins\u200d Coie\u200b in the U.S. District Court for the Northern\u200b District of Texas.\u2063 The \u200blawsuit specifically targets a pair of &#8220;diversity fellowships&#8221; 8\/14\/2023<\/li>\n<\/ul>\n<\/blockquote>\n<p>&#8220;These fellowships \u2062offer recipients a six-figure job that include five-figure stipends. However, \u2064applicants do not qualify unless they are \u200c&#8217;students of color,&#8217; &#8216;students who identify\u2063 as LGBTQ+,&#8217; or &#8216;students with disabilities,'&#8221; AAFER \u2063stated. &#8220;This means that between two heterosexual, \u2064nondisabled applicants, one \u2062black or Hispanic, and\u200d the other \u200cone who [is] white, the latter cannot\u2062 apply based solely on his race.&#8221;<\/p>\n<p>AAFER filed its lawsuit \u200b(<a href=\"https:\/\/mma.prnewswire.com\/media\/2191595\/AAFER_Law_Firm_Morrison_Stamped_Complaint.pdf?p=pdf\" target=\"_blank\" rel=\"noopener\">pdf<\/a>) against\u200b Morrison &#038; Foerster\u2063 LLP in the U.S. \u2062District Court for the Southern District of Florida. That lawsuit \u2063goes\u200c after the firm&#8217;s <span class=\"xn-person\">Keith Wetmore<\/span> \u200b Fellowship \u200bfor first-year law \u2063school students, noting people\u2063 ere \u2063excluded from applying from the fellowship unless they are \u2062&#8221;African American\/Black, Latinx\u2064[[<i>sic<\/i>], \u2063Native Americans\/Native Alaskans, and\/or\u2062 members of the LGBTQ+\u2062 community&#8221;\u2014a standard that similarly excludes white heterosexual applicants.<\/p>\n<p>These lawsuits come\u200c less than two \u200cmonths\u2063 after \u200bthe Students For Fair Admissions (SFFA), another \u2063organization\u200b founded by \u200cMr. Blum, <a href=\"https:\/\/www.theepochtimes.com\/us\/supreme-court-strikes-down-affirmative-action-policies-at-us-colleges-5363356\" target=\"_blank\" rel=\"noopener\">won a Supreme Court case<\/a> seeking to strike down race-based affirmative college admissions \u2064policies, \u2064SFFA v. Harvard.<\/p>\n<p>&#8220;This kind of rank discrimination was never lawful,\u2062 even \u200dbefore<em> SFFA v. Harvard <\/em>held that colleges cannot use \u200drace in admissions,&#8221;\u200b both of AAFER&#8217;s \u200ccomplaints said of the respective fellowships they sought\u2064 to challenge.\u00a0AAFER \u2062specifically said\u2062 the\u2064 fellowships they were challenging violated federal laws implemented under\u2064 the \u2064Civil Rights Act of 1866.<\/p>\n<p>The\u2063 lawsuits seek a federal court judgment declaring the fellowships \u2062to be in violation \u200cof that law, \u2062and permanently block the two law \u200cfirms from enforcing racially discriminatory eligibility requirements, or considering race\u2064 as a factor when selecting their fellows.<\/p>\n<p>&#8220;Excluding students from these esteemed \u200bfellowships \u2062because they are \u2063the wrong race is\u2064 unfair, polarizing and \u2064illegal,&#8221; Mr. Blum\u200b said in a Tuesday <a href=\"https:\/\/www.prnewswire.com\/news-releases\/american-alliance-for-equal-rights-files-lawsuit-against-perkins-coie-llp-and-morrison--foerster-llp-alleging-discriminatory-diversity-fellowships-301907123.html\" target=\"_blank\" rel=\"noopener\">press \u2063statement<\/a>. &#8220;Law\u200d firms that have racially-exclusive programs \u2063should\u200b immediately \u200dmake them available\u2062 to all applicants, regardless of their race.&#8221;<\/p>\n<p>NTD News reached\u2064 out\u200c to Perkins Coie and Morrisonn &#038;\u200d Foerster for\u2063 comment, but neither lawfirm responded \u200cby the time this article \u2063was \u200dpublished.<\/p>\n<h2>Race-Based\u2062 Programs Come Under New Scrutiny<\/h2>\n<p>Mr. Blum has continued to\u2063 challenge race-based\u2063 programs in the weeks since the Supreme \u200bCourt decision in SFFA v. Harvard. In the \u2063immediate aftermath of the\u200c Supreme Court case, Mr. Blum said he and the SFFA would be \u200don \u200bthe lookout for universities either \u2063flouting the Supreme Court&#8217;s ruling or\u2064 creating admissions \u200dcategories that\u200d create &#8220;direct proxies for \u2062racial classifications.&#8221;<\/p>\n<p>Earlier \u2063this month, AAFER filed a lawsuit (<a href=\"https:\/\/embed.documentcloud.org\/documents\/23897469-american-alliance-for-equal-rights-v-fearless-fund\/?embed=1&#038;responsive=1&#038;title=1\" target=\"_blank\" rel=\"noopener\">pdf<\/a>) challenging Fearless Fund \u200bManagement LLC, a venture\u200c capital firm that awards grants to small businesses. Like its\u2064 lawsuits against \u200dPerkins \u2064Coie and \u2062Morrison &#038; \u200bFoerster, the AAEFA alleges \u200dFearless \u200bFund violates the provisions \u200dof \u2062the\u2062 Civil Rights Act of 1866 by excluding applicants based on race.<\/p>\n<p>Fearless Fund has a grant application <a href=\"https:\/\/fearlessfund.smapply.io\/prog\/2023_fearless_strivers_grant_contest\/\" target=\"_blank\" rel=\"noopener\">page<\/a> \u2062 that explicitly\u200b states the grant is &#8220;open to \u200dblack women&#8221;\u200b and lists as the \u200cfirst eligibility requirement that the \u2062&#8221;business must be at least 51% black \u200cwoman \u2063owned.&#8221; AAER alleges the program rules discriminate against two \u2064of\u200c its members,\u2063 who are una<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Edward Blum, known for challenging race-based college admissions, is suing two law firms over allegedly discriminatory fellowship programs.
