The Coalition for TJ, a group consisting \u2064of students, parents, staff,\u2062 and alumni of Thomas Jefferson High School for Science and\u2064 Technology, is\u200d urging \u200cthe high court to review their anti-discrimination \u200dcase\u2064 against Fairfax County Public Schools.<\/p>\n<h3>Rectifying Lower Court Losses<\/h3>\n<p>After recent victories in race-based admissions cases at Harvard \u200cUniversity and the University of North Carolina, the Coalition for \u200bTJ is confident that they can overturn previous losses in lower courts. They are particularly\u200c focused on a May appeals decision \u2062from the 4th U.S. Circuit Court of Appeals. Attorney Joshua Thompson of the Pacific Legal Foundation, representing the coalition, emphasizes that the Constitution prohibits discrimination based on race \u200band argues that Thomas Jefferson High School&#8217;s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/3-supreme-court-justices-dissent-in-major-affirmative-action-ruling\/\" title=\"3 Supreme Court Justices Disagree in Key Affirmative Action Decision\">admissions policy violated<\/a> this principle.<\/p>\n<blockquote>\n<p>&#8220;TJ&#8217;s admission overhaul tried to hide its discriminatory\u200d purpose behind a patina of race-neutrality. But the school&#8217;s proxy discrimination clearly violated Chief Justice Roberts&#8217; warning against indirect discrimination.&#8221;<\/p>\n<\/blockquote>\n<p>The case revolves\u200c around TJ&#8217;s admissions policy, which\u200b the Pacific Legal Foundation claims\u2063 disproportionately harms Asian applicants. The school replaced a merit-based system with a lottery system in an effort to increase the representation\u2062 of black and Hispanic students. A Supreme Court ruling against the school\u2064 district could have implications \u2062beyond \u2063K-12 schools, potentially \u200caffecting college\u200c admissions as well.<\/p>\n<blockquote>\n<p>&#8220;Guarantees \u200bof\u200c [Students for Fair Admissions v. Harvard] might mean little if schools could accomplish the same discriminatory result through \u2062race-neutral proxies,&#8221; the petition continues.<\/p>\n<\/blockquote>\n<p>Meanwhile, education advocacy groups are applauding the decision to appeal to the Supreme Court. They argue that the admissions\u200d changes made by Fairfax County Public Schools in 2020 had an &#8220;anti-Asian feel&#8221; and were discriminatory. Instead of lowering the\u2063 bar, \u200bthese groups believe that the district should focus on\u200b preparing students for the rigorous \u2063math and science programs at Thomas Jefferson High School.<\/p>\n<h2>Virginia Tech&#8217;s Campus Speech Policies\u2064 Under Scrutiny<\/h2>\n<p>In\u2064 a separate case seeking review at the Supreme\u200c Court, \u2062Virginia Tech is being \u2062challenged for its campus speech policies. The advocacy group \u200cSpeech First filed the lawsuit in April \u200b2021, arguing that the school&#8217;s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-asked-to-intervene-in-fairfax-and-virginia-tech-education-lawsuits\/\" title=\"Supreme Court urged to step in on Fairfax and Virginia Tech education lawsuits.\">bias reporting\u200c system policy infringes<\/a> on students&#8217; First Amendment rights and has a chilling effect on free speech.<\/p>\n<p>The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/free-speech-group-squashes-universitys-bias-reporting-system-in-court\/\" title=\"Free Speech Group Squashes University\u2019s Bias Reporting System In Court\">bias reporting system<\/a> allows students to report incidents of perceived &#8220;bias,&#8221; which Speech First claims is defined\u200b too broadly, posing a threat to free speech. These \u200dreports are then assessed by &#8220;bias response teams,&#8221; \u200dwho have the authority \u2063to take \u200cdisciplinary action against the accused students.<\/p>\n<blockquote>\n<p>&#8220;Overly broad \u2064or vague definitions of bias put all kinds of speech at risk of being reported &#8211; even unpopular speech which \u200dis protected by the First Amendment,&#8221; the group&#8217;s definition states. &#8220;Political speech and satire are particularly vulnerable because the system favors students who \u2064easily take offense.&#8221;<\/p>\n<\/blockquote>\n<p>Speech First&#8217;s executive director,\u2063 Cherise Trump, highlights the prevalence of bias response teams in universities across the country, arguing that they stifle the speech of \u2063millions of college students.
