Lenka John, James Tyson, \u2064and Noel Harner claim that the city\u2063 ordered \u200bthem \u2064to \u200cleave the parks where they \u200cwere living and subsequently destroyed their personal property, including essential items like medications and mobility devices.<\/p>\n<p>According to the lawsuit, the \u200dcity&#8217;s actions violated their\u200c constitutional rights under\u2064 the Americans with \u200cDisabilities Act. The plaintiffs argue \u2064that \u2063the city&#8217;s destruction of their property without \u200cwarning or accommodation infringed upon\u200c their Fourth, Fifth, and \u206414th Amendments to the U.S.\u2064 Constitution.<\/p>\n<blockquote>\n<p>\u201cI felt violated,\u201d said Lenka John, one of the plaintiffs, as city employees tossed her \u2063medical records,\u2062 heart monitor, walker, and disability assistance paperwork into a trash truck.<\/p>\n<\/blockquote>\n<p>The lawsuit\u200d alleges that the city failed to respond to requests for\u2064 assistance from disabled homeless individuals before the\u200d parks closed for maintenance. The county&#8217;s 2023 Point-in-Time Count and Survey revealed that there are over\u2063 1,000 homeless people in the city, \u200cwith approximately 4,200 people living without shelter in San Bernardino County.<\/p>\n<p>California, in general, has been struggling with a homelessness crisis. Despite significant financial \u200cinvestments, the state has not made\u200d progress\u200d in addressing the issue.
