Passed by the state \u2064Legislature in\u200c April \u20632022, medical providers who violate the law \u2063could face up to 10 years in prison. A month \u200clater in May 2022, U.S. District \u200dJudge Liles\u2062 C. Once\u200b the injunction is\u2062 officially\u2064 lifted, \u200dSB 184 can\u200c be enforced in Alabama.<\/p>\n<p>\u201cStates have a compelling interest in protecting children from drugs, particularly those for which there is uncertainty regarding \u200dbenefits, recent surges \u200cin use, and irreversible effects,\u201d the court \u200dopinion \u2064said (<a href=\"https:\/\/media.ca11.uscourts.gov\/opinions\/pub\/files\/202211707.pdf\" target=\"_blank\" rel=\"noopener\">pdf<\/a>).<\/p>\n<p>\u201cThe\u200d record evidence \u2064is undisputed that the medications at issue present some \u2063risks. As the district \u2064court recognized, these medications can cause \u2018loss of fertility \u2062and sexual function.&#8217; The district court \u2064also acknowledged testimony that \u2018several European countries have restricted treating\u2062 minors with \u2062transitioning medications due to\u200d growing\u200d concern about \u200cthe medications\u2019 risks.\u2019\u201d<\/p>\n<p>The \u2063appeals court criticized the district court\u2019s rationality while issuing the preliminary injunction.<\/p>\n<p>The district court had \u2062held that there was a specific \u2063right under the U.S.\u200d Constitution which allows parents \u201cto treat [one\u2019s] children with\u200b transitioning medications subject to medically accepted standards.\u201d<\/p>\n<p>However, the district court\u2019s judgment on this point is based on \u201can unprecedented interpretation\u201d of the fundamental\u200c rights of parents regarding the upbringing, care, and control of their children, the opinion stated.<\/p>\n<p>\u201cThat was error,\u201d it said.<\/p>\n<h2>No Violation of Equal Protection Clause<\/h2>\n<p>The judges in the \u206211th U.S.\u200b Circuit\u200d Court of Appeals \u200balso dismissed the argument that SB 184 violated the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-legal-team-files-appeal-after-obama-judge-dismisses-lawsuit-seeking-to-block-pennsylvania-from-certifying-its-results\/\" title=\"Trump Legal Team Files Appeal After Obama Judge Dismisses Lawsuit Seeking to Block Pennsylvania From Certifying Its Results\">equal protection clause<\/a> and criticized the district court for judging\u200c the law as classifying individuals \u201con the basis \u200cof sex.\u201d<\/p>\n<p>It pointed out that the state of \u2063Alabama has argued \u200bthat the law only\u2062 \u201cclassifies \u200don the bases of age and \u2064procedure, not sex or gender\u200d nonconformity.\u201d The court agreed that SB 184 is best understood as a law \u201cthat <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-court-sides-with-alabama-on-transgender-treatment-ban-for-minors\/\" title=\"Federal court supports Alabama's ban on transgender treatment for minors.\">targets\u2063 specific medical interventions<\/a> for minors\u201d rather than something violating the equal protection clause.<\/p>\n<div style=\"margin-left:0;margin-right:0;max-width:1200px\">\n<figure style=\"width:640px;margin-left:auto;margin-right:auto\" class=\"alignnone\"><figcaption>A young girl at \u2063the annual New\u2062 York City Pride March \u2063in New York City on \u2062June 25, 2023. (Samira Bouaou\/The Epoch Times)<\/figcaption><\/figure>\n<\/p><\/div>\n<p>SB 184 \u201cestablishes \u200da rule that applies equally to both sexes,\u201d the appeals court stated, \u200cwhile reasoning\u2063 that the law only refers to\u200d sex because it\u200b regulates medical procedures that are \u201cthemselves \u2062sex-based.\u201d<\/p>\n<p>\u201cThe regulation of a course of treatment that, by the nature \u2063of things, only \u200ctransgender individuals would want to undergo would not trigger \u200cheightened scrutiny unless \u200cthe regulation is a pretext for invidious\u2063 discrimination against such individuals, and,\u2063 here, the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/appeals-court-clears-true-the-vote-leaders-of-contempt\/\" title=\"Appeals Court Clears True the Vote Leaders of Contempt\">district court made<\/a> no findings of such a pretext,\u201d \u200cthe \u2062opinion stated.<\/p>\n<p>In addition to banning transgender treatment for minors, SB 184 \u2062prohibits school staff from withholding \u200binformation from parents or legal guardians\u200c if a \u2064minor\u2019s\u200d perception of his or her gender\u200b is \u201cinconsistent\u2062 with the\u200c minor\u2019s sex.\u201d<\/p>\n<p>The bill states that individuals who undergo transgender procedures have been found to suffer from elevated mortality rates and higher\u200b rates of substance \u200dabuse, \u200cdepression,\u200d and psychiatric \u200dhospitalizations compared to the general\u200b population.<\/p>\n<p>It argues \u2064that minors are\u200c \u201cunable to comprehend and fully appreciate the risk and life implications\u201d resulting from such procedures.<\/p>\n<p>While introducing \u200bthe bill, Republican\u200b state \u2064Rep.
