Fulton County Sheriff Pat Labat has also\u200c said he \u2062would take the former president&#8217;s mugshot as part of \u200dthe process, a move not seen in the three prior criminal indictments against the\u200b former president.<\/p>\n<p>In an \u2062interview with NTD News\u2019 \u201cCapitol Report,&#8221; William\u200b A. Jacobson, a\u200d Clinical Professor of Law and Director of the Securities Law Clinic\u2063 at Cornell Law School, said the former&#8217;s president&#8217;s status as a Secret\u200d Service\u2062 protectee complicates \u2062matters for the Fulton County\u200b officials seeking to play up his \u200carrest.<\/p>\n<blockquote>\n<p>&#8220;Because his Secret Service is around\u2064 him all the time,\u200b you \u200dhave to do it a \u2063different\u2062 way,&#8221; \u2063Mr. \u200bJacobson explained. &#8220;So presumably he will \u200csurrender, he will \u200cgo in either in front of people or not in front of\u200b people into the courthouse to surrender\u2062 himself, \u200band he\u2063 will be\u2064 processed relatively\u200c efficiently.&#8221;<\/p>\n<p>Mr. Jacobson \u200dsaid \u200cthe Secret Service&#8217;s charge \u200cto protect the \u2064former president will likely prevent him from having to go through the process of waiting in a holding \u200ccell for several hours with other detainees, while he awaits an appearance before a judge<\/p>\n<p>&#8220;I can&#8217;t imagine this\u200b is going to go \u2063the way\u200d it would \u200bbe for a normal criminal case,&#8221; the \u2062law school professor continued. &#8220;And that&#8217;s\u2063 why, while the Georgia authorities have \u200bmade very clear\u2064 they&#8217;re going to release his mug shot and they&#8217;re\u2062 going to try to\u200b humiliate him, I can&#8217;t\u200c imagine\u200b it&#8217;s going to be done \u200dthe way it would be done for another defendant in a case.<\/p>\n<\/blockquote>\n<h2>Fulton Case Overlaps\u2064 with Federal Charges<\/h2>\n<p>Mr. Jacobson\u2064 noted some overlap between the Fulton County indictment\u200b and one of the\u2063 other indictments \u2063the former president faces\u2014a federal\u2064 case brought\u2063 by special\u200d counsel Jack Smith\u2064 earlier this \u2064month. On Aug. \u20631, Mr. \u2064Smith unveiled \u200dfour charges against the former president, alleging his efforts to challenge the 2020 election results amounted to an \u2063effort to defraud\u200c the United States, to obstruct the\u2064 election certification process, and\u2064 to violate \u2063the right to vote and have one&#8217;s vote counted.<\/p>\n<p>Ms.\u2062 Willis&#8217;s indictment overlaps with \u2064Mr. Smith&#8217;s as \u2063it\u2064 alleges criminality in how\u200b President \u2062Trump\u200d and members\u2062 of his campaign\u200d team\u2063 challenged Georgia&#8217;s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/fraud-alert-analysis-of-3000-counties-reveals-joe-biden-received-5-6-more-votes-in-counties-using-dominion-voting-machines\/\" title=\"FRAUD ALERT: Analysis of 3,000 Counties Reveals Joe Biden Received 5.6% More Votes in Counties Using Dominion Voting Machines\">2020 general election results<\/a>. Given the overlap, Mr. \u2064Jacobson said \u2064he\u2063 felt the state-level indictment\u200c in Georgia is unnecessary.<\/p>\n<p>&#8220;I&#8217;m not sure it&#8217;s \u200cunethical or illegal, \u2063but it is \u2064certainly questionable,&#8221; he said. &#8220;I&#8217;ve questioned from \u2062the beginning why the Georgia case was even\u2063 needed, when you have a federal case\u200c charging Donald Trump with essentially\u2062 the same crime, which is allegedly unlawfully interfering in the 2020 election count in the\u200b attempts to overturn it. And why \u200chave a separate\u200c state case? That&#8217;s what&#8217;s never made sense at all.&#8221;<\/p>\n<p>Mr. Jacobson said it&#8217;s\u200b not unheard of for there to \u2063be both federal\u200d and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/legal-scholar-sees-flaws-in-georgia-indictment-efforts-to-humiliate-trump\/\" title=\"Legal expert questions Georgia indictment, criticizes attempts to embarrass Trump.\">state-level criminal cases \u2062stemming<\/a> from the same underlying set of facts, but said \u2064in \u200dmost instances such overlaps begin with a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/death-penalty-biden-justice-department-silent-on-buffalo-shooters-fate\/\" title=\"Death Penalty? Biden Justice Department Silent on Buffalo Shooter\u2019s Fate\">state-level case<\/a> followed by a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/fbi-announces-investigation-into-andrew-brown-jr-shooting\/\" title=\"FBI Announces Investigation Into Andrew Brown Jr. Shooting\">federal civil rights investigation<\/a>.<\/p>\n<p>&#8220;You can have two different so-called sovereigns, pursuing charges for the same crime, it&#8217;s just uncommon to have them going on at\u200c the same \u2062time with trial\u200b dates at\u2064 the \u200dsame time,&#8221; he explained. &#8220;And of\u200d course,\u200c there&#8217;s nothing that&#8217;s usual or common \u200cabout\u200b prosecuting\u2062 a former president \u200din an election year when he&#8217;s running for election again.&#8221;<\/p>\n<h2>Trump&#8217;s \u200dActions Not Clearly Illegal<\/h2>\n<p>Addressing\u200d the actual substance of the case itself, the Cornell legal scholar\u200c raised concerns about how Ms. Willis\u200b tied the 45th president&#8217;s actions in with the actions of\u2063 other defendants. Her overarching case charges all 19 defendants\u200d with taking part in\u200c a shared criminal enterprise, under\u2062 Georgia&#8217;s\u2063 Racketeering Influenced Corrupt Organizations (RICO) Act.<\/p>\n<p>President Trump&#8217;s part\u2063 in the alleged RICO scheme entailed several alleged overt acts, including a \u2062Jan. 2, 2021, call with\u2063 Georgia Secretary of State Brad\u200c Raffensperger and\u200b other Georgia election officials, wherein he laid out several\u2064 claims about irregularities in\u200b the Georgia election results\u200d that Ms. Willis co<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>The indictment of ex-President Trump in Fulton County, Georgia suggests he&#8217;ll be treated as a regular criminal.
