The \u200bcourt announced its unanimous decision \u2062to dismiss the lawsuit brought by\u200d the National Shooting Sports Foundation (NSSF), a trade organization for firearms industry\u200c members.<\/p>\n<p>The NSSF had argued that the New Jersey law, which\u200c allows the state to sue &#8220;bad \u2063actors&#8221; in\u2064 the firearms industry, conflicted with a federal law\u2064 called\u2063 the Protection of\u200c Lawful Commerce\u2063 in Arms Act (PLCAA). However, \u200bthe appeals court ruled\u2064 that the NSSF had &#8220;jumped the gun&#8221; by seeking a pre-enforcement\u2062 block \u2063of the New Jersey law and\u2063 had not provided sufficient\u200b evidence \u2062of its chilling effect on firearms industry marketing practices.<\/p>\n<p>The court also noted that the New Jersey law only threatens civil penalties, rather than criminal ones, making it &#8220;less \u2062chilling&#8221; in\u200d nature. However, it \u2063did\u2062 leave open the\u2063 question of whether the threat\u200b of administrative penalties\u2064 alone would be enough for standing.<\/p>\n<h3>Reactions to the Ruling<\/h3>\n<p>New Jersey Attorney General Matthew Platkin celebrated the \u2062appeals\u200d court&#8217;s\u2064 decision, stating that the \u2064law is\u2063 an\u200d <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-appeals-court-dismisses-lawsuit-challenging-nj-public-nuisance-gun-law\/\" title=\"Federal court dismisses challenge to NJ gun law.\">important\u2064 public safety tool<\/a>.
