No reason \u2062was given for the\u200b withdrawal.<\/p>\n<p>&#8220;Mr. Biden has been advised of, and consents to, our withdrawal. The dismissal would allow the tax charges to be brought against Mr. Biden in another jurisdiction, such as California or Washington, D.C. The Delaware venue\u2064 was something the prosecution and Mr. Biden&#8217;s lawyers had agreed to when they had still sought a plea\u200d deal, according to court filings \u2064(<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ded.82801\/gov.uscourts.ded.82801.31.0.pdf\" target=\"_blank\" rel=\"noopener\">pdf<\/a>).<\/p>\n<p>Abbe David Lowell of Winston &#038; Strawn\u200d LLP and Richard I.G. Jones,\u2062 Jr.\u200d of Berger Harris LLP will continue to represent Mr. Biden &#8220;in this matter through its conclusion,&#8221; according to the filing.<\/p>\n<p>The attorneys were not immediately available for comment.<\/p>\n<h2>Possible Witness<\/h2>\n<p>Before the case was dismissed in Delaware, Mr. Biden&#8217;s attorney Christopher Clark \u200dhad also stepped down \u2062from the case.<\/p>\n<p>On \u2063 <a href=\"https:\/\/www.theepochtimes.com\/us\/hunter-biden-attorney-withdraws-from-case-citing-potential-role-as-witness-5466699\" target=\"_blank\" rel=\"noopener\">Aug. 15<\/a>, Mr. Clark and attorney Mr. Jones wrote in a filing that\u2062 Mr. Clark may appear\u200b as a \u200dmaterial witness.<\/p>\n<p>&#8220;Under the &#8216;witness-advocate&#8217; rule,\u200d it is inadvisable for \u2064Mr. Clark to continue as counsel in this case,&#8221; they\u200c wrote in\u2062 the filing.<\/p>\n<p>They anticipate that\u200c the \u200bplea bargain for Mr. Biden, which fell\u2062 apart\u2062 during his first hearing\u200b in Judge Noreika&#8217;s court, may be an \u200dissue raised during his trial.<\/p>\n<p>\u201cBased on recent developments, it appears that the negotiation and drafting of the plea agreement and diversion agreement will be\u200c contested, and Mr. Clark is a percipient witness to those issues,\u201d the \u2064filing reads.<\/p>\n<p>Mr. Biden was charged with two misdemeanor crimes of failure to pay more than $100,000 in taxes from more than $1.5 million in income in 2017 and 2018, and one charge of possessing \u2064a firearm\u200c in 2018 as\u200b a drug user.<\/p>\n<div>\n<figure style=\"width:300px\" class=\"alignright\"><figcaption>U.S. Attorney for \u200bthe District of Delaware David Weiss in a file image. (Department\u200c of Justice \u2062via The Epoch Times)<\/figcaption><\/figure>\n<\/p><\/div>\n<h2>DOJ Investigation Under Scrutiny<\/h2>\n<p>In June, Mr.\u2064 Weiss, who had not yet been appointed special counsel, announced a <a href=\"https:\/\/www.theepochtimes.com\/us\/hunter-biden-pleads-guilty-to-federal-charges-5344246\" target=\"_blank\" rel=\"noopener\">plea deal<\/a> in which Mr. Biden\u200b would plead guilty to\u2064 the tax charges, which carry up to one year in prison, and pretrial diversion for the gun charge, which carries up to 10 years in prison and \u200ba fine\u2062 up to $250,000, and the\u200c DOJ would not prosecute Mr. Biden for other things they had already investigated. The limit of this\u2062 immunity was one\u2063 reason the deal fell apart.<\/p>\n<p>The deal was panned as a\u2064 &#8220;sweetheart deal&#8221; by \u2062Republicans, who are \u2062investigating Mr. Biden&#8217;s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/all-fbi-agents-must-blow-their-whistles-or-theyll-be-complicit-in-bureaus-politicization\/\" title=\"All FBI Agents Must Blow Their Whistles Or They\u2019ll Be Complicit In Bureau\u2019s Politicization\">foreign financial dealings<\/a> in House committees. When later Mr. Weiss was appointed\u200d special counsel on Aug. 11 by Attorney \u2062General Merrick\u200d Garland, the same Republicans were vocal in their criticism.<\/p>\n<p>The DOJ \u2064made public their investigation of \u2064Mr. Biden in 2020, and Mr. Weiss led the \u2063DOJ&#8217;s investigation beginning in February 2021.<\/p>\n<p>Retired Harvard law professor Alan Dershowitz told <a href=\"https:\/\/www.foxbusiness.com\/politics\/harvard-law-professor-warns-hunter-bidens-special-counsel-clear-violation\" target=\"_blank\" rel=\"noopener\">Fox Business<\/a> that the appointment was &#8220;illegal.&#8221;<\/p>\n<p>&#8220;The\u200c regulation provides clearly\u200d that special counsel have to come from outside the government for good reason.
