The appeal would go to the\u2063 Atlanta-based 11th U.S.\u2064 Circuit Court\u2064 of \u2062Appeals.<\/p>\n<p>The law, \u2063which took effect on July 1, also prevents minors from receiving sex change surgeries, though that\u2062 provision was not at issue in the case \u200dbefore Geraghty.<\/p>\n<p>A group of families and an organization called TransParent sued in federal court, arguing that the prohibition on hormone replacement therapy violated a minor&#8217;s rights under the Constitution&#8217;s 14th Amendment to equal protection\u200c under the law.<\/p>\n<p>Geraghty, \u200cappointed to \u2064the bench by President Joe Biden, agreed, saying the ban amounts to a \u2062sex-based classification as it &#8220;places a special burden on transgender minors \u2062because their gender identity does not match their birth sex.&#8221;<\/p>\n<p>The <span data-qa-component=\"highlight-text\">judge<\/span> said that amounts \u200cto a form \u200bof unconstitutional sex discrimination because a minor&#8217;s sex at\u200b birth determines whether \u200bthat child\u2062 can receive a given form of medical treatment.<\/p>\n<p>The state argued that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/christie-says-transgender-operations-on-minors-should-be-allowed-if-parents-consent\/\" title=\"Christie supports parental consent for transgender operations on minors.\">banning hormone therapy<\/a> was justified\u200d by the risk that an individual may later in life regret the physical changes brought on by hormone replacement therapy. But Geraghty said <span data-qa-component=\"highlight-text\">Georgia<\/span> presented \u200d&#8221;little&#8221; reliable evidence of regret.
