min-height: 50px;  text-align: center;\">  \t<script>  \t\tgoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1663871513696-art-1'); });  \t<\/script>  <\/div>\n<div class=\"ad-slot__ad-label\">Advertisement<\/div>\n<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThis is a case where information is being selectively leaked to make the president look bad,\u201d Scharf told One America News.<\/p>\n<\/blockquote>\n<p>Trump faces criminal charges of unauthorized retention of national defense information, \u200bobstruction,\u200c among other things.\u200c Scharf says this is a very important distinction to\u200c make.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cIt\u2019s really\u200c important to note\u2063 that \u2062President Trump has not been charged\u200c with <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/information-is-being-selectively-leaked-former-federal-prosecutor-blasts-special-counsel-jack-smith-for-media-leaks-to-hurt-pres-trump\/\" title=\"Former federal prosecutor criticizes Special Counsel Jack Smith for selectively leaking information to the media to harm President Trump.\">unlawfully retaining classified information<\/a>,\u201d said \u200bScharf. \u201cHe\u2019s been\u2062 charged under the Espionage Act\u200d for unlawful \u2062retention of national\u200d defense information, which is \u200da very different legal classification.\u201d<\/p>\n<\/blockquote>\n<p>Under the Espionage Act,\u200c national defense information has to fit the <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/793\">definition<\/a> of \u201crelating to the\u200c national defense which information \u200dthe possessor had reason to believe could be \u2062used to the injury \u2062of the United States or to \u2062the advantage of any foreign nation.\u201d <\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThat information, in my view, doesn\u2019t bear on the burden of proof that Jack Smith has to meet,\u201d \u200bScharf said.\u2063 \u201cAnd as \u200dI\u2019ve said before, I believe that that burden is insurmountable for the special counsel and his team.\u201d<\/p>\n<\/blockquote>\n<p>A Trump spokesperson told ABC\u2063 News that this story was \u200danother example of Smith \u201cselectively leaking \u200bincomplete information\u201d to hurt the 45<sup>th<\/sup> president.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThis is a \u2062case that should be tried \u2063in\u200b a courtroom, not in the public domain, \u200dcertainly not \u200bin the mainstream media the way it has been,\u201d Scharf \u200csaid. \u201cJack Smith has, from the start of this process,\u2064 attempted \u200cto shape the narrative, has attempted to play to the media. As a former\u200c federal\u200b prosecutor, that\u2019s not the way I was trained to prosecute cases. \u2064I was \u2063always taught \u200cthat \u200dyou do\u2063 your talking in court, not in public. And I think that\u2063 really \u200dshows you how politicized \u200dthe Department \u2063of Justice\u2063 has \u2062become under Joe\u200b Biden.\u201d<\/p>\n<\/blockquote>\n<p>U.S. District Judge \u2062Aileen Cannon has set the trial date for May\u200d 20, \u20642024, but Scharf\u2062 believes \u2063that will not last.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cI \u2062believe that\u200b the case will ultimately get pushed back,\u201d he said.<\/p>\n<\/blockquote>\n<p>Scharf claims that these \u200dleaks from the DOJ have the potential to taint the jury pool.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cI believe that these media leaks have a real potential of corrupting the jury pool, of \u200cleading people\u2063 to believe things about these\u2062 cases that are not in evidence, that are not properly\u2064 before \u200dthe court,\u201d said Scharf. \u201cAnd \u200cfrom a constitutional rights standpoint, that\u2019s deeply troubling\u200d and problematic. I believe that President Trump will have his day in \u200dcourt. I believe that\u200c he will be vindicated when he\u200c has that day in court.\u201d<\/p>\n<\/blockquote>\n<p>Scharf says this, along\u200d with the other Trump indictments, are staining the American judicial system.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThe real question is what damage will be done\u200c between now and \u200dthat day to our democratic institutions and\u2064 to the rule of law,\u201d asked Scharf.<\/p>\n<\/blockquote>\n<p>Stay informed!
