The state\u200c has implemented\u2062 a first-of-its-kind \u2064ban on the \u200dapp, \u200bset to take effect\u200c on \u2062January \u20631. Attorney General Austin Knudsen is\u2062 urging a U.S. judge to support the ban, arguing \u200dthat \u2062it is necessary to protect the state from potential harm \u200bcaused \u200cby a foreign adversary.<\/p>\n<div id=\"div-gpt-ad-1663871513696-art-1\" style=\"min-width: 320px; min-height: 50px;  text-align: center;\">  \t<script>  \t\tgoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1663871513696-art-1'); });  \t<\/script>  <\/div>\n<div class=\"ad-slot__ad-label\">Advertisement<\/div>\n<\/p>\n<p>TikTok, owned by China&#8217;s ByteDance, has filed a lawsuit\u2062 against\u200c the ban, claiming that\u2063 it infringes\u2064 on the company&#8217;s and users&#8217; First Amendment \u200brights. However, Attorney General \u200dKnudsen argues\u2064 that the ban is justified as it aims to protect the \u200bstate from <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/i-get-caught-up-and-i-spiral-tom-holland-announces-hes-taking-a-break-from-social-media-for-mental-health\/\" title=\"\u2018I Get Caught Up And I Spiral\u2019: Tom Holland Announces He\u2019s Taking A Break From Social Media For Mental Health\">potential harm caused<\/a> by \u200da foreign adversary.<\/p>\n<p>In a legal filing, Knudsen states \u2062that Montana has the authority to ban harmful\u200d products without <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/montana-ag-asks-court-to-reject-tiktok-challenge-to-state-ban\/\" title=\"Montana AG urges court to dismiss TikTok's challenge to state ban.\">violating free speech rights<\/a>. He compares the ban to prohibiting cancer-causing radios or sports-betting apps that \u200bpromote illegal\u200b gambling. \u200cAccording to\u2062 Knudsen, the ban targets nonexpressive harms such\u2062 as preventing cancer, illegal gambling, and \u2063data-gathering by\u2064 a hostile foreign state.<\/p>\n<p>A hearing on\u2064 TikTok&#8217;s request for a preliminary injunction is scheduled for October 12.<\/p>\n<p>TikTok, which is used by\u200b over 150 million Americans, \u200dhas <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/watchdog-report-catalogs-esg-shareholder-efforts-to-pressure-corporations-on-liberal-priorities\/\" title=\"Watchdog report lists ESG shareholder push for corporate action on liberal priorities.\">faced increasing\u2064 scrutiny<\/a> from U.S. lawmakers due to\u200b concerns \u200babout potential Chinese government influence. \u200dThe \u200ccompany has\u200c repeatedly denied sharing U.S. user data \u200cwith the\u200b Chinese government \u200dand claims to have implemented \u2064measures \u200cto protect \u200duser\u200b privacy and \u2064security.<\/p>\n<p>If TikTok violates the ban in\u200d Montana, the state could\u200b impose fines of $10,000 \u200dper violation. However, individual TikTok users would \u200bnot face penalties.<\/p>\n<p>Former President \u200cDonald Trump previously attempted to ban TikTok and another \u2062Chinese-owned app,\u2064 WeChat, but court decisions prevented \u2064the bans from taking effect.
