Hawley files counter-complaint against Senate Dems\">dark money group<\/a><\/a>. But that group, nonprofit Future Forward USA Action, reported in its 2021\u2063 IRS <a href=\"https:\/\/projects.propublica.org\/nonprofits\/organizations\/824170762\/202203279349300615\/full\" target=\"_blank\" rel=\"noopener\">tax return<\/a> that it provided $15.3 million to the\u200b super \u200bPAC that year.\u2063 The missing $12 million is one of several errors in the group\u2019s finances, errors that experts say are egregious enough to warrant a federal probe.<\/p>\n<p>&#8220;The apparent\u2064 numerous and blatant discrepancies in the recent filings by \u2063both the nonprofit and the super \u2063PAC are \u200cbeyond\u200d troubling,&#8221; said Kendra Arnold, executive director of watchdog group Foundation for Accountability and Civic Trust. &#8220;This situation calls for an investigation,&#8221; \u2063Arnold said,\u200d adding that the radical divergence in the figures\u2062 reported \u2064in the groups\u2019 financial disclosures &#8220;is a\u2062 telltale sign \u200dof inaccuracies \u200band\u2063 a deeper problem.&#8221; Nonprofit attorney Jason Torchinsky echoed that call, \u2063saying an apparent failure\u2064 to report millions in contributions &#8220;would be a\u200b serious matter that the Federal Election Commission would\u200d investigate.&#8221;<\/p>\n<p>An investigation into Future Forward could \u200bprove to be a thorn in Biden\u2019s side heading \u200binto the 2024 elections. The group, which is led by former Obama campaign\u2062 officials, has quietly raised nearly $400 million in the past five \u200cyears to \u2063run ads supporting Biden and Democrats in battleground states. Much of Future Forward\u2019s funds came from Future Forward USA\u200b Action, \u2063which as a nonprofit is not required \u2062to publicly disclose its donors. While Biden in September said dark money &#8220;erodes public trust&#8221; and poses\u200c a &#8220;serious \u200dproblem facing our democracy,&#8221; White House deputy chief of staff Jennifer O\u2019Malley Dillon months later <a href=\"https:\/\/www.nytimes.com\/2023\/07\/14\/us\/politics\/biden-future-forward-super-pac.html\" target=\"_blank\" rel=\"noopener\">said<\/a> Future Forward would &#8220;play \u2064a\u200d key role&#8221; in supporting Biden\u2019s reelection\u2063 bid.<\/p>\n<p>Both Future Forward \u200cand\u2062 Future \u200cForward USA Action did not answer\u2064 detailed questions on \u200bthe gaps in their financial disclosures.<\/p>\n<p>Typically, when a \u200bsuper PAC discloses contributions from\u200c a dark money\u200b group, \u200cthe\u2064 figures \u200cwill match what the dark money group reports\u2064 in its\u2064 IRS tax returns. But in Future Forward\u2019s case, there are several \u2063glaring discrepancies in its disclosures to the IRS and\u200c FEC.<\/p>\n<p>In 2021, Future Forward USA Action reported\u2063 in its IRS \u2064 <a href=\"https:\/\/projects.propublica.org\/nonprofits\/organizations\/824170762\/202203279349300615\/full\" target=\"_blank\" rel=\"noopener\">tax return<\/a> that it provided $15.3 million \u2062to\u200c the\u200c super PAC that year. Future Forward should have reported the same number in its reports to the \u200bFEC. But instead, the super PAC <a href=\"https:\/\/www.fec.gov\/data\/receipts\/?data_type=processed&#038;committee_id=C00669259&#038;contributor_name=future+forward&#038;two_year_transaction_period=2022&#038;min_date=01%2F01%2F2021&#038;max_date=12%2F31%2F2021\" target=\"_blank\" rel=\"noopener\">claimed<\/a> it received\u200c just $3.4 million from its sister dark money group in\u200b 2021. The remaining $12 million is completely unaccounted for\u2062 in the super PAC\u2019s reporting, a discrepancy that Arnold called &#8220;beyond \u200ctroubling.&#8221;<\/p>\n<p>&#8220;If the filings are not \u200caccurate then not\u200b only are they worthless,\u200b but they are misleading,&#8221;\u2063 Arnold told the <em>Free Beacon<\/em>.<\/p>\n<p>Nonprofit attorney Jason Torchinsky said\u2062 the discrepancies in Future \u2063Forward\u2019s reporting are a &#8220;serious matter&#8221; that could result in substantial \u200cfines for the group.<\/p>\n<p>&#8220;It seems very odd to\u2064 tell \u200bthe IRS that you sent \u200d$15 million to a super PAC, but to only have that super PAC report $3 million,&#8221; Torchinsky told\u200d the<em> Free Beacon<\/em>. &#8220;If \u200cthe \u200bFEC \u200bdetermined that there \u200dwere $12 million in underreported receipts by a super PAC, that could result in a substantial fine because FEC penalties are often assessed \u2063based on the amount \u2064at issue.&#8221;<\/p>\n<p>The $3.4 million that is accounted for \u2064in Future Forward\u2019s 2021 reporting could also \u2063land the\u200b group in legal \u200dtrouble, the <em>Free\u2062 Beacon<\/em> <a href=\"https:\/\/freebeacon.com\/elections\/bidens-favorite-super-pac-used-illegal-scheme-to-conceal-its-donors-experts-say\/\" target=\"_blank\" rel=\"noopener\">reported<\/a>. Future Forward\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/legal-experts-call-for-investigation-into-bidens-favorite-super-pac-over-serious-financial-discrepancies\/\" title=\"Legal experts demand probe into Biden's preferred Super PAC for 'grave' financial inconsistencies.\">dark money arm disclosed<\/a> in another section of its 2021\u200c IRS tax return \u200cthat those funds were effectively earmarked for the super PAC, meaning the\u200d group should have revealed the original donors to the FEC. \u200cBut Future\u2064 Forward declined\u200c to disclose\u200c who contributed \u2063the cash.<\/p>\n<p>&#8220;Future Forward USA Action admitted to making over $3 million in\u200b earmarked political contributions, where they apparently obscured the true super PAC donor&#8217;s identity by routing the money through the nonprofit,&#8221; Republican election lawyer Charlie \u2063Spies told the <em>Free Beacon<\/em>. &#8220;The U.S.\u2063 DOJ has sent\u2062 people to \u200dprison for this\u2062 sort of\u2064 illegal \u2062activity, and the FEC has imposed major fines \u200don <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/conservative-groups-slam-blatant-politicization-of-doj-over-fbi-raid-of-mar-a-lago\/\" title=\"Conservative Groups Slam \u2018Blatant Politicization\u2019 of DOJ Over FBI Raid of Mar-a-Lago\">conservative organizations accused<\/a> of less blatant earmarking.&#8221;<\/p>\n<p>Future Forward\u2019s reporting from 2018 through 2020\u200d contain even more discrepancies. The Super PAC appears to have no dedicated staff, as it has never \u200dreported making a payroll expenditure, according to its FEC <a href=\"https:\/\/www.fec.gov\/data\/disbursements\/?data_type=processed&#038;committee_id=C00669259\" target=\"_blank\" rel=\"noopener\">filings<\/a>. Instead, the super PAC uses the services \u2063of its\u200d affiliated dark money group\u2019s staff. Such arrangements are legal and common, but in Future Forward\u2019s \u2063case, the \u200ctwo groups disclosed radically different amounts of \u2064in-kind staff\u200c donations\u200c every year between 2018 and 2020.<\/p>\n<p>For \u2063example, Future Forward <a href=\"https:\/\/www.fec.gov\/data\/receipts\/?data_type=processed&#038;committee_id=C00669259&#038;contributor_name=future+forward&#038;min_date=01%2F01%2F2020&#038;max_date=12%2F31%2F2020\" target=\"_blank\" rel=\"noopener\">reported<\/a> to the FEC it received $467,204 worth of in-kind staff contributions from the \u2062dark money group in 2020. But the dark money group <a href=\"https:\/\/projects.propublica.org\/nonprofits\/display_990\/824170762\/download990pdf_07_2022_prefixes_82-94%2F824170762_202012_990O_2022071220210864\" target=\"_blank\" rel=\"noopener\">claimed<\/a> to the IRS it only\u200d provided $67,479 worth of in-kind staff \u2064time to the super PAC that same\u2062 year. The \u200bnumbers should be an exact match, but instead, they\u2019re off\u2062 by a factor of nearly seven.<\/p>\n<p>Earlier, in 2018\u2063 and 2019, Future Forward\u2019s dark money group claimed it provided $0 \u2064worth of\u200b in-kind staff services to the PAC. But in those same years, Future Forward said it received a combined $137,000\u200d worth of\u200d in-kind staff\u2063 services from its dark money affiliate.<\/p>\n<p>&#8220;There must be an independent audit of\u200c both groups for these egregious discrepancies and an investigation and possible enforcement action by both the IRS and the FEC,&#8221; said Paul Kamenar, an attorney with \u2063the National Legal and Policy Center watchdog group.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>&#8220;Future Forward&#8217;s financial discrepancies, amounting to a $12 million gap, have raised concerns among legal experts, prompting calls for immediate investigations.
