According to the prosecutor, attempts\u2064 to change\u2064 an election outcome \u200dare legal, and a criminal\u200d enterprise must pose a continuing threat.<\/p>\n<p>Fulton \u200cCounty District Attorney Fani Willis recently launched a 41-count indictment against \u2062Trump and 18 co-conspirators. The indictment accuses them of trying to overturn the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/katie-couric-trump-supporters-need-to-be-deprogrammed-video\/\" title=\"Katie Couric: Trump Supporters Need to Be \u201cDeprogrammed\u201d (VIDEO)\">2020 presidential election result<\/a> \u2062by violating Georgia&#8217;s \u200bversion of the Racketeering Influenced and Corrupt Organizations (RICO) Act and soliciting\u2063 an official \u200dto violate their oath of office.<\/p>\n<p>While Georgia&#8217;s RICO Act allows prosecutors to connect various <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/u-k-experts-evidence-shows-chinas-genocide-against-uighurs\/\" title=\"U.K. Experts: Evidence shows China\u2019s genocide against Uighurs\">crimes committed<\/a> by multiple defendants, a former Chief\u2063 Assistant U.S. Attorney \u2064in\u200d the Southern District of New York, Andrew McCarthy, pointed out a flaw in the \u2063case. In an \u200bopinion piece for The Messenger, McCarthy highlighted\u2064 &#8220;a giant hole&#8221; in the indictment\u200c due to\u2062 the lack of a clear crime to which\u200d Trump and his co-defendants can be said to \u200bhave agreed.<\/p>\n<blockquote>\n<p>&#8220;Racketeering\u200d conspiracy charges typically apply to mafia-type criminal organizations that engage in offenses you would see in an episode of &#8216;The Sopranos.&#8217; But because\u2064 conspiracy charges require an \u200bagreement\u2062 with two or more people to violate\u2064 a criminal statute, if there is no agreement about committing a crime, there is no \u2063conspiracy,&#8221; McCarthy explained.<\/p>\n<\/blockquote>\n<p>In the indictment, Willis alleges that Trump and the co-conspirators attempted to change \u2064the election outcome in favor of Trump. However, McCarthy argues that trying to reverse the election results without an \u2064overarching objective is not technically a crime.<\/p>\n<blockquote>\n<p>&#8220;That\u200b is, the lawful objective of changing the election outcome somehow becomes unlawful\u2063 because she invokes the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/former-federal-prosecutor-calls-fulton-county-indictment-against-trump-allies-a-flawed-case\/\" title=\"Ex-Federal Prosecutor Deems Fulton County Indictment on Trump and Allies Flawed.\">apparently talismanic word &#8216;unlawful<\/a>.&#8217; But there is\u2062 no crime of unlawfully trying to change an election outcome \u2063\u2014 not in Georgia law nor any other American law,&#8221; McCarthy wrote.<\/p>\n<\/blockquote>\n<p>McCarthy also disputes\u200c the use of the RICO charge in the Georgia\u2064 case, stating that Trump and the co-defendants did not \u200cintend or desire to belong to a group or see themselves as a group. \u200cTheir alleged objective was \u2064to maintain Trump in power, not to participate in\u200d an\u200d enterprise.<\/p>\n<p>Democratic State Representative Tonya Miller of\u2062 Georgia, who is also a former prosecutor in Fulton County, defended the indictment. She explained that under Georgia law, the term &#8220;enterprise&#8221; is defined broadly and includes\u200d individuals, legal or\u200b illegal businesses, \u200cand government agencies.<\/p>\n<blockquote>\n<p>&#8220;RICO is particularly\u200d broad in \u200dGeorgia, more so than\u200d the federal\u200c version, because it isn&#8217;t just crimes that can form the \u2063basis of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/can-trump-win-his-lawsuit-against-hillary-clinton-and-the-dnc-for-their-russia-collusion-lies\/\" title=\"Can Trump Win His Lawsuit Against Hillary Clinton And The DNC For Their Russia Collusion Lies?\">racketeering activity<\/a>. It can be \u200dacts involving crimes, threats involving\u2064 crimes, so it really can encompass conduct that isn&#8217;t necessarily on its face criminal. We see that in this indictment,&#8221; Miller said.<\/p>\n<\/blockquote>\n<p>At the\u2062 end of each\u200d act in the indictment, Willis alleges that the defendants and other members\u200b and associates of the enterprise committed overt acts in furtherance of the conspiracy. Emory University Law Professor Fred Smith Jr. explained that as long as the actions were in furtherance of\u200c the same goal, the act of conspiracy could be counted, even if they \u200dwere not\u200d themselves illegal.<\/p>\n<blockquote>\n<p>&#8220;Now, of course, there does need to be illegal activity, a pattern\u200b of illegal \u200cactivity, which under Georgia law is two crimes that are listed in that particular <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/utah-legislature-moves-to-ban-critical-race-theory-from-public-schools\/\" title=\"Utah Legislature Moves To Ban Critical Race Theory From Public Schools\">state statute<\/a>. But all other actions that may not themselves be illegal, so long\u200b as they were\u2062 in furtherance of that same scheme, that same illegal goal can\u200b qualify,&#8221; Smith clarified.<\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>week, accusing them of attempting to overturn the 2020 election. However, critics argue that this indictment is flawed. According to a former federal prosecutor, changing election outcomes is legal, and a criminal enterprise must pose an ongoing threat.
