(Photo by JIM WATSON \/ AFP) (Photo by \u200dJIM WATSON\/AFP\u200d via Getty \u2062Images)<\/figcaption><\/figure>\n<h2>OAN\u2019s <a href=\"https:\/\/www.oann.com\/tag\/james-meyers\">James Meyers<\/a><\/h2>\n<h3>12:47 PM \u2013 Friday, August 18, 2023<\/h3>\n<p>A federal appeals court \u2064ruled in favor of the \u2062state of\u2063 New Jersey to allow\u200c them to \u2064sue local gun businesses under the state\u2019s \u201cpublic nuisance\u201d law. <\/p>\n<div id=\"div-gpt-ad-1663871513696-art-1\" style=\"min-width: 320px; min-height: 50px;  text-align: center;\">  \t<script>  \t\tgoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1663871513696-art-1'); });  \t<\/script>  <\/div>\n<div class=\"ad-slot__ad-label\">Advertisement<\/div>\n<\/p>\n<p>The U.S.\u200c Court of Appeals for the 3<sup>rd<\/sup> \u2062Circuit ruled that the lawsuit brought by the National Shooting Sports Foundation (NSSF)\u200d over the\u200d Garden State being able to sue the gun industry was filed too\u2064 early.<\/p>\n<p>The Appeals\u2064 Court claimed \u200cthey filed the lawsuit before the\u200c new law enforcement\u2063 began but did acknowledge that\u200c the new law is vague and does not detail what\u2063 can\u200b cause the state to file a\u200d lawsuit. <\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThe National Shooting Sports Foundation\u200b challenges\u2062 a new state gun law as violating its members\u2019 constitutional; \u2064rights,\u201d Judge\u2063 Stephanos Bibas, a former President Trump appointee, wrote. \u201cBut\u200c we see little\u200d evidence that enforcement is looming.\u201d<\/p>\n<\/blockquote>\n<p>The\u2064 lawsuit comes after New Jersey Governor Phil\u2064 Murphy (D-N.J.), signed the \u201cpublic nuisance\u201d\u2064 law into effect in July\u2064 2022. <\/p>\n<p>The \u200claw allows the \u2062state\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/donald-trump-rejects-idea-that-he-didnt-drain-the-swamp-in-first-term\/\" title=\"Trump denies not 'draining the swamp' in first term.\">attorney\u200c general<\/a> to file\u2063 lawsuits against <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/appeals-court-rules-new-jersey-can-sue-gun-industry\/\" title=\"NJ Appeals Court allows gun industry to be sued.\">local gun businesses based<\/a> on \u200dan exception \u2064to the federal Protection of Lawful\u2063 Commerce in\u2064 Arms Act \u200b(PLCAA), which\u2062 is meant to protect the gun industry from liability. <\/p>\n<p>A <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/scotus-sides-with-arizona-against-death-row-inmates\/\" title=\"SCOTUS Sides With Arizona Against Death Row Inmates\">district court allowed<\/a> the NSFF\u2019s imposition for a preliminary injunction in January, claiming the\u200d \u201cnuisance law\u201d was in direct \u200dconflict with the PLCAA. <\/p>\n<p>However, NSSF\u200b General \u200bCounsel Lawrence Keane stated the gun organization\u200d will file another suit against the state \u200dif they enforce the law against \u200bthe gun industry.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cWhile we respectfully disagree with the court\u2019s \u2062decision\u200b on our pre-enforcement \u200dchallenge, it is important \u2064to note \u2063the court did not say New Jersey\u2019s law does not violate the Protection of Lawful Commerce in Arms Act; it clearly does,\u201d\u200c Keane said.<\/p>\n<\/blockquote>\n<p>This is the first\u200d time\u200d a federal appellate court has weighed in on these new\u2062 gun laws.<\/p>\n<p>Stay informed!
