Version: 4.0.47--><h2>Trump&#8217;s Georgia Indictment Could Be \u2063Escalated\u200c to Federal Court<\/h2>\n<p>Former President Donald Trump could request that his trial be transferred from Georgia to \u2064a federal court in a move just crazy enough to work.<\/p>\n<p>On Monday, Fulton County District Attorney\u2063 Fani Willis <a href=\"https:\/\/www.westernjournal.com\/trump-wins-white-house-wont-able-pardon-georgia-neither-can-governor\/\" target=\"_blank\" rel=\"noopener\">indicted<\/a> the leading GOP candidate\u2062 in the 2024 presidential race on 13 counts, including one charge of violating the Racketeer Influenced and Corrupt Organizations statute \u2014 typically\u200b applied to organized crime.<\/p>\n<p>Willis is prosecuting Trump and 18 of his associates \u2014 including former White House Chief of Staff Mark Meadows \u2014 for allegedly attempting to overturn the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/katie-couric-trump-supporters-need-to-be-deprogrammed-video\/\" title=\"Katie Couric: Trump Supporters Need to Be \u201cDeprogrammed\u201d (VIDEO)\">2020 presidential election results<\/a> in Georgia.<\/p>\n<p>Meadows filed a motion to\u200c move \u200bhis case out of Fulton\u200b County and into the\u200b federal court\u200d for the Northern \u200bDistrict of Georgia shortly after being indicted.<\/p>\n<p>On Wednesday, U.S. District Judge Steve C.\u200b Jones <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.gand.319225\/gov.uscourts.gand.319225.6.0.pdf\" target=\"_blank\" rel=\"noopener\">scheduled<\/a> an evidentiary hearing on the motion for Aug. 28.<\/p>\n<p>Many\u2064 believe Trump will follow suit, according to <a href=\"https:\/\/www.cnn.com\/2023\/08\/17\/politics\/georgia-election-criminal-case-removal-federal-court-explainer\/index.html\" target=\"_blank\" rel=\"noopener\">CNN<\/a>.<\/p>\n<p>This \u200blatest in a string of criminal cases against\u200b the former president could trip him up more than all of the others, but a\u2064 change to a federal court could be just what he needs to slip the noose.<\/p>\n<p>There are many advantages to doing this, not the least of which is delaying the trial as the <a href=\"https:\/\/www.westernjournal.com\/major-warning-sign-emerges-biden-2024-campaign-heats-whistling-past-graveyard\/\" target=\"_blank\" rel=\"noopener\">2024 primary campaign<\/a> heats up.<\/p>\n<p>Another distinct advantage for the former president would be the \u200davailability of a more <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/fulton-or-federal-trump-indictment-poised-to-set-off-court-venue-dispute\/\" title=\"Trump indictment could spark court venue dispute: Fulton or federal?\">friendly jury pool<\/a> as well as the relative impartiality\u200c of a federal judge who might be more inclined\u200c to throw \u2062the whole case out.<\/p>\n<p>Willis used Georgia\u2019s RICO law \u2063to string the shoddy indictment together, and it\u2019s doubtful the charges would stand up to scrutiny by a serious judge.<\/p>\n<p>\u201cThere\u2019s very few \u200bcases in Georgia interpreting the\u2062 RICO \u2063statute,\u201d Georgia criminal defense attorney Andrew Fleischman said, according to CNN.<\/p>\n<p>A\u200d move would mean the case Willis cobbled together and the intricacies of the 1980 state law\u2063 would go before a federal judge Fleischmann believes would \u201cask a bunch \u200bof questions\u201d about them.<\/p>\n<p>It\u2019s\u2064 possible the change of venue would \u2062be granted. Both Meadows and Trump could successfully argue that it belongs \u200bin federal court because the alleged activity happened during\u2062 Trump\u2019s presidency.<\/p>\n<p>However, Trump\u2019s team may seek a federal trial as it could confer the greatest advantage \u200cof all \u2014 the prospect of\u200c a complete\u200b pardon.<\/p>\n<p>Under the Constitution, the president has the power to <a href=\"https:\/\/www.westernjournal.com\/levin-takes-counterview-trump-power-potus-pardon-state-charges\/\" target=\"_blank\" rel=\"noopener\">pardon<\/a> only federal offenses.<\/p>\n<p>As it stands now, a pardon in Georgia is \u2063unlikely, and \u2063not \u200cjust \u2062because Trump has bad blood with GOP Gov. <a href=\"https:\/\/www.westernjournal.com\/abrams-top-dem-snubs-stacey-gives-glowing-endorsement-brian-kemp\/\" target=\"_blank\" rel=\"noopener\">Brian Kemp<\/a>.<\/p>\n<p>In fact, it\u2019s not up to the governor. Instead, pardon power is granted through the <a href=\"https:\/\/www.westernjournal.com\/trump-wins-white-house-wont-able-pardon-georgia-neither-can-governor\/\" target=\"_blank\" rel=\"noopener\">State Board of \u2064Pardons and Paroles<\/a> via a five-person panel and only after\u200b the criminal \u2062serves five\u2063 years of the sentence.<\/p>\n<p>If Trump is\u2064 tried and convicted under federal \u2063law and \u200cgoes on to\u200c win the presidency,\u2064 he arguably could pardon himself.<\/p>\n<p>Although this seems like the unlikely ending to a political thriller novel,\u200b the strategy \u200bappears solid.<\/p>\n<p>Talk radio host and attorney Mark Levin \u2063believes Trump could pardon himself regardless of where the\u200c conviction is finalized.<\/p>\n<p>Levin outlined his rationale in a\u200b lengthy post to X, formerly known as Twitter, even as \u2064other legal experts debated the possibility.<\/p>\n<p>\u201cPresident Trump can, in fact,\u200b pardon himself from the GA charges if\u200d he is elected president,\u201d \u200dhe asserted.<\/p>\n<p>Levin pointed out that the Constitution doesn\u2019t specify \u201cwhether a president can be indicted\u201d\u200d but said the Justice Department \u201chas taken the position under both parties that you cannot indict a sitting president because it would cripple\u200c the executive branch and make his ability to defend himself\u2062 effectively impossible.\u201d<\/p>\n<p>Because state convictions would have the same effect on the president\u2019s <a href=\"https:\/\/www.westernjournal.com\/biden-campaign-off-brutal-start-manager-cancels-interview-msnbc\/\" target=\"_blank\" rel=\"noopener\">ability to\u2063 govern<\/a>, he believes this \u2062could be a valid argument against prosecuting the sitting \u2063president.<\/p>\n<p>\u201cFURTHERMORE, if indicted and even convicted, the idea that a president cannot \u2064pardon himself from state charges is absurd, again, not only because of the Supremacy Clause, but the same considerations that apply to a federal conviction would obviously \u2064apply \u2063to a state conviction,\u201d Levin said, citing the constitutional hierarchy that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trumps-georgia-indictment-could-be-escalated-to-federal-court\/\" title=\"Trump's Georgia indictment may go to federal court.\">makes federal laws supreme<\/a> over\u200b state laws.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">President Trump can, in fact, pardon himself from the GA charges if \u2063he is elected president.<\/p>\n<p>1.
