The court ordered a ban on telemedicine prescriptions and shipments of \u2064the drug by \u200dmail.\u200b However, the decision will not \u200dimmediately take effect.<\/p>\n<\/blockquote>\n<p>The court stopped short of completely\u2063 pulling \u2063the drug off the market, as a lower court had previously done.<\/p>\n<p>The Biden administration plans to appeal the ruling to the U.S. Supreme\u200d Court. President Joe Biden, \u200ba Democrat, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wapo-defends-very-catholic-biden-against-far-right-bishops-set-to-rebuke-him-over-abortion\/\" title=\"WaPo Defends \u2018Very Catholic\u2019 Biden Against \u2018Far-Right\u2019 Bishops Set To Rebuke Him Over Abortion\">supports abortion rights<\/a> and has previously ordered the expansion\u200c of\u200c access to mifepristone.<\/p>\n<p>The ruling will only\u200c take effect after the Supreme Court reviews it,\u200d which could \u200bhappen in \u200dthe upcoming term from October to \u2062June.<\/p>\n<h3>Background of the\u2062 Ruling<\/h3>\n<p>The ruling stems from a \u200clawsuit brought by \u2062four <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/remember-when-media-freaked-out-over-amy-coney-barrett-and-the-right-wing-supreme-court\/\" title=\"Remember When Media Freaked Out Over Amy Coney Barrett And The Right Wing Supreme Court?\">anti-abortion groups<\/a> and four anti-abortion doctors. They argue \u200dthat\u200b the \u200dFDA improperly approved mifepristone in 2000\u200c and\u200d did not adequately consider its safety \u2064when\u200c used by minors.<\/p>\n<p>The 5th Circuit \u200dpanel\u200c reviewed an order by U.S. District Court\u200d Judge Matthew Kacsmaryk in Amarillo, Texas. \u200cWhile \u200dit was a \u200cpreliminary ruling, Kacsmaryk \u2064indicated that he was likely to make it permanent.<\/p>\n<h3>Reactions to the\u200d Ruling<\/h3>\n<p>Erin Hawley of Alliance Defending Freedom, a lawyer \u2063for \u2063the anti-abortion \u2064groups challenging the\u200c pill&#8217;s approval, stated, &#8220;The 5th\u200d Circuit rightly required the FDA \u2063to do its job\u200b and \u2063restore crucial safeguards for women\u2062 and girls, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/court-strikes-down-fda-approval-of-mail-order-abortion-pills\/\" title=\"Court invalidates FDA approval of mail-order abortion pills.\">including ending\u2062 illegal mail-order \u2063abortions<\/a>.&#8221;<\/p>\n<p>Susan B. Anthony Pro-Life\u2063 America also criticized the\u200b FDA, stating that it had\u2062 been\u2062 &#8220;reckless.&#8221;<\/p>\n<p>Alexis McGill Johnson, president of abortion rights group Planned\u2064 Parenthood Federation of America, expressed concern over the decision, saying that it puts mifepristone&#8217;s approval and the FDA&#8217;s\u200d independence at risk.<\/p>\n<p>GenBioPro \u2064Inc, a company that sells a\u200d generic version of mifepristone, voiced its concerns about attempts to undermine science and access to evidence-based medication\u200c through court challenges.<\/p>\n<h3>Conservative Judges and FDA Actions<\/h3>\n<p>All three judges on the panel are staunchly conservative and have a history of opposing abortion rights. \u200bWhile one \u200bjudge wanted to pull \u200cmifepristone\u2062 off the market, the other two\u200c judges stated that the lawsuit\u2062 was filed too\u2063 late to challenge the drug&#8217;s original approval.<\/p>\n<p>The majority of the panel rolled back\u2062 FDA actions that \u200chad \u2064made the drug more \u2064accessible in recent years.
