Those\u200d events were &#8220;in the\u200d background&#8221; of the draft \u200brequirement, according to an \u200bAugust 2 <a href=\"https:\/\/www.americanbar.org\/content\/dam\/aba\/administrative\/legal_education_and_admissions_to_the_bar\/council_reports_and_resolutions\/aug23\/23-aug-src-memo-standards-revisions-notice-comment.pdf\">memo<\/a> from the bar association. <a href=\"https:\/\/freebeacon.com\/campus\/hundreds-of-yale-law-students-disrupt-bipartisan-free-speech-event\/\">Yale Law School<\/a> and the <a href=\"https:\/\/reason.com\/volokh\/2022\/03\/03\/ilya-shapiro-is-shouted-down-at-u-c-hastings\/\">University\u2063 of California Hastings Law School<\/a> experienced similar\u2063 disruptions in 2022, each instigated by progressive students upset about a conservative speaker.<\/p>\n<p>The \u200baccreditation standard reads \u2062as a direct response to those incidents. Law schools must &#8220;protect the rights \u2064of faculty, students, and\u2063 staff to communicate ideas that may be \u200ccontroversial or unpopular,&#8221; the draft requirement states, including through\u2063 public demonstrations. At the same time, the standard would prohibit protests that stifle &#8220;free expression by preventing or substantially interfering with \u200dthe carrying out of law school\u2064 functions or\u200c approved activities.&#8221;<\/p>\n<p>The proposal comes amid accusations \u2063that the bar \u200dassociation has\u200c stifled free speech through its accreditation process. The group drew criticism last year when it <a href=\"https:\/\/freebeacon.com\/campus\/how-the-american-bar-association-just-radicalized-law-school\/\">required<\/a> all law schools to instruct students that \u200bthey have a duty to\u2062 eliminate \u200cracism, a move that many law professors, including 10\u2064 <a href=\"https:\/\/www.americanbar.org\/content\/dam\/aba\/administrative\/legal_education_and_admissions_to_the_bar\/council_reports_and_resolutions\/comments\/2021\/june-2021\/june-21-comment-yale-law-school.pdf\">at Yale<\/a>, said would imperil academic\u2063 freedom \u2062and result in compelled speech. It also considered \u2064requiring law schools to &#8220;diversify&#8221; their student bodies\u2014only to <a href=\"https:\/\/freebeacon.com\/campus\/american-bar-association-scraps-controversial-diversity-proposal-after-blowback\/\">axe the proposal<\/a> a month before the Supreme Court heard oral arguments in <em>Students for Fair Admissions<\/em> v. <em>Harvard<\/em>, the \u200bcase that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/american-bar-association-considers-crackdown-on-disruptive-conduct-in-wake-of-stanford-shout-down\/\" title=\"ABA considers crackdown on disruptive conduct after Stanford shout down.\">outlawed race-based college admissions<\/a>.<\/p>\n<p>The American Bar Association declined \u200dto\u2064 comment.<\/p>\n<p>Though the group has long <a href=\"https:\/\/www.americanbar.org\/content\/dam\/aba\/publications\/misc\/legal_education\/Standards\/2017-2018ABAStandardsforApprovalofLawSchools\/2017_2018_standards_chapter4.authcheckdam.pdf\">required<\/a> law schools to have policies protecting academic \u200cfreedom, it has offered few specifics on what those policies should entail. As \u2063disruptive protests become increasingly common on <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/pro-life-should-prepare-for-more-doxing-as-abortion-activists-rage-inflames\/\" title=\"Pro-Life Should Prepare For More Doxing As Abortion Activists\u2019 Rage Inflames\">law school campuses<\/a>, experts say the proposal would fill an important \u200bgap.<\/p>\n<p>&#8220;The current standard doesn\u2019t\u200c provide\u2062 any substance,&#8221; Paul Lannon, an attorney at Holland \u2064&#038; Knight who specializes in\u2062 education law, <a href=\"https:\/\/www.abajournal.com\/web\/article\/professors-administrators-and-counsel-applaud-proposed-aba-standard-on-academic-freedom\">told<\/a> <em>ABA Journal<\/em>, which is published by the American Bar Association.\u200c &#8220;This kind of guidance from the ABA is long\u200b overdue.&#8221;<\/p>\n<\/p><\/div>\n<\/article>\n<\/section>\n","protected":false},"excerpt":{"rendered":"<p>The American Bar Association&#8217;s accreditation arm is proposing a new standard that would oblige law schools to prohibit behavior that obstructs free expression.
