They \u200cnow have the power to sue\u200b their &#8220;influencer&#8221; parents for keeping the profits made from\u200d their online videos. This new legislation, known as Senate Bill 1782, was signed \u2062into law by Gov. \u2063J.B. Pritzker\u200c on\u2062 Aug. 11.<\/p>\n<p>Introduced\u2062 by state Sen. David Koehler, a Democrat, in February, \u2064this\u2062 bill\u2063 received \u2062bipartisan support and passed in May. This amendment\u2063 to the Child Labor Law ensures \u200bthat child influencers\u2062 receive their rightful share of the profits.<\/p>\n<p>Furthermore, the legislation grants &#8220;kidfluencers&#8221; the right to request the permanent deletion of \u200bany \u2064video footage featuring them once they turn 18.<\/p>\n<p>In addition, parents who feature \u200ctheir children \u200bin online videos \u2063or vlogs are required to set aside a specified amount\u2062 of their\u2062 earnings\u2062 into a trust account for their children. The children can access this money \u200donce they reach the age of 18.<\/p>\n<p>Illinois is leading\u200c the way\u200c as the first U.S. state to enact such legislation.<\/p>\n<h2>Kids Working in &#8216;Digital Environments&#8217; Must Be Protected<\/h2>\n<p>State\u2064 Sen. David Koehler \u200demphasized the importance of this legislation in a \u2064statement following its signing. He acknowledged that social media has opened up new opportunities \u2063for children to earn\u200d money, but \u2062some parents\u2064 are taking advantage of\u2062 their children&#8217;s earnings.<\/p>\n<p>&#8220;Many parents have taken this opportunity to\u2063 pocket the money, while making their children continue to work in these digital \u2063environments,&#8221; said Sen. Koehler. &#8220;This new digital age has given us tremendous opportunities to connect with \u2064one \u2062another, but it\u2019s\u2064 also presented legal\u200b issues that have never existed before. We need to work with our children\u200c to \u200csee the problems they face and tackle them head-on before\u200c any further\u200d harm is done.&#8221;<\/p>\n<div>\n<figure style=\"width:640px\" class=\"alignnone\"><figcaption>Illinois Gov. Koehler\u200c revealed that the inspiration\u2063 for this \u200blegislation came \u2064from Shreya Nallamothu, a\u200d 15-year-old <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-education-sec-on-womens-school-sports-we-have-a-legal-responsibility-to-include-transgender-athletes\/\" title=\"Biden Education Sec On Women\u2019s School Sports: We Have a \u2018Legal Responsibility\u2019 to Include Transgender Athletes\">high school student<\/a>\u2064 in his district. \u200bShreya raised concerns about the lack of protections for child influencers and their \u200cearnings.<\/p>\n<p>&#8220;When scrolling on social media, I\u2064 always saw young children and\u200c families, called family\u2063 vlog channels, posting videos online. After finding that users could make money off of platforms \u2062such as YouTube and TikTok, I learned that, often, these kids are made to participate in videos without any guarantee of the income generated from the content,&#8221; said Shreya. &#8220;I wanted to work with Senator Koehler to protect the money that these\u2063 kids have rightfully earned.&#8221;<\/p>\n<p>According to Senate Bill 1782, parents must allocate a portion of\u200d their gross earnings from videos featuring their child&#8217;s &#8220;likeness,\u2063 name, or photograph&#8221; into a trust fund. This money can be accessed by the child once\u200d they reach adulthood.<\/p>\n<h2>Billion Dollar Industry<\/h2>\n<p>The percentage of earnings to be set aside is determined by\u200d the child&#8217;s level of involvement in the content. If a minor under the \u2062age of 16 appears in\u200b at least 30 percent of a video or online\u2064 content for which their parent or guardian is being paid, they are\u2063 entitled to compensation. \u200cHowever, this law only\u200d applies to video content created in Illinois that generates more than 10 cents per \u200bview.<\/p>\n<p>Parents \u200dwho\u2062 fail to comply with this legislation may face\u200b lawsuits \u200dfrom their adult children, seeking punitive and actual damages.<\/p>\n<p>This\u200b legislation comes at a time when the child influencer industry is booming, with <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/child-social-media-stars-can-now-sue-influencer-parents-under-new-illinois-law\/\" title=\"New Illinois law allows child social media stars to sue their 'influencer' parents.\">highly successful child influencers earning approximately  million<\/a> per year\u2062 through advertising.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Child social media stars in Illinois can now sue their parents for keeping the earnings from their online videos.
