As part of\u200d our oversight, the Committee requests information relating to the concerns raised by the Office of Advocacy to ensure DOL is taking its RFA requirements seriously.&#8221;<\/p>\n<p>The House Committee on Small Business put \u2062their <a href=\"https:\/\/twitter.com\/HouseSmallBiz\/status\/1691476747567386625?s=20\" target=\"_blank\" rel=\"noopener\">support behind<\/a> \u200bthe correspondence, \u200bsaying their \u2063committee has sent 39 letters to the Biden administration, \u2062questioning the implementation of over $400 billion\u2062 in \u200dnew \u200bregulations, which amount \u2064to\u2064 over \u2062230 million hours in new paperwork.<\/p>\n<p>&#8220;The National Federation of Independent Businesses (NFIB) Small Business Legal Center noted in a review of the Office of Advocacy&#8217;s comment letters that there were 28 instances during the 117th Congress where\u2062 agencies across the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/court-declares-laws-banning-handgun-sales-to-people-under-21-unconstitutional\/\" title=\"Court Declares Laws Banning Handgun Sales To People Under 21 Unconstitutional\">federal government failed<\/a> to follow the RFA,&#8221; Ms. Foxx and Mr.\u2062 Kiley \u2064went on. &#8220;DOL was responsible\u2062 for nearly 18 percent of these failures.&#8221;<\/p>\n<h2>Focusing on\u2064 How Department \u200cOperates<\/h2>\n<p>The Education \u2063and Workforce Committee is investigating the DOL \u2064to ensure it follows the \u2063RFA, a law that ensures government agencies \u2064consider\u2062 how their \u200brules <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/war-on-small-business-top-advocacy-groups-rip-democrats-proposal-to-strip-tax-deduction\/\" title=\"\u2018War On Small Business\u2019: Top Advocacy Groups Rip Democrats\u2019 Proposal To Strip Tax Deduction\">affect small businesses<\/a>.<\/p>\n<p>The RFA says \u2063agencies must explain how \u200ca new rule could affect small businesses. They \u200bneed to\u200d publish two types of analyses:\u2064 one when they suggest a rule called the initial regulatory flexibility \u200banalysis (IRFA) and another when the\u2062 rule becomes\u200d final (final regulatory flexibility analysis or FRFA). If a practice is thought to \u2062bring little or no harm to small businesses, agencies can\u200b skip these analyses, but\u2063 only if the \u2064agency head confirms the lack of potential damage.<\/p>\n<p>Republican leaders mentioned in their letter a review by the National Federation of Independent Businesses (NFIB) Small Business Legal Center. This review showed that the DOL frequently didn&#8217;t follow the RFA guidelines.<\/p>\n<p>In a\u200c specific instance cited by lawmakers, the DOL issued both an IRFA\u2064 and a statement\u2062 suggesting\u200c that \u2062a new rule would have minimal impact on\u2062 small \u200cbusinesses. This <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/house-republicans-take-aim-at-surge-in-fees-regulations-for-small-businesses\/\" title=\"House Republicans target rising fees, regulations for small businesses.\">action reportedly caused confusion<\/a> within the Office of Advocacy.<\/p>\n<p>Additionally, the committee highlighted\u2064 other occasions when the Office \u2064of \u2062Advocacy identified \u200dinstances\u2064 where the DOL failed to conduct the necessary rule analysis as mandated by the RFA.
