In a decision that awaits the Supreme Court&#8217;s final ruling, the appeals court stated \u2062that the drug should not be distributed through the \u200dmail \u2063or prescribed via telemedicine.<\/p>\n<p>The appeals\u200c court&#8217;s ruling falls short \u200dof\u200c U.S. District \u2063Judge \u2062Matthew Kacsmaryk&#8217;s previous decision to suspend the FDA&#8217;s approval of mifepristone. \u200dHowever, it does reinstate\u2064 regulations on mailing and prescribing the pill, which is used in up to half of all abortions.<\/p>\n<blockquote>\n<p>&#8220;The 5th Circuit rightly required the FDA to do its\u200b job and\u2063 restore crucial safeguards \u200bfor women and girls, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-appeals-court-makes-decision-on-the-mailing-of-abortion-pills\/\" title=\"Federal Appeals Court Rules on Abortion Pill Mailings\">including ending illegal\u2063 mail-order\u200d abortions<\/a>,&#8221; said Alliance Defending Freedom Senior Counsel Erin Hawley.<\/p>\n<\/blockquote>\n<p>Hawley, \u2063who helped represent those who sued FDA officials to stop\u200b the distribution of the drug, added, &#8220;The FDA will finally be made to account for the damage it has caused to the health of countless women and girls and the rule of law by unlawfully removing every meaningful safeguard \u2062from the \u200d<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-judge-says-fda-wrongfully-approved-abortion-pill\/\" title=\"Federal Judge Says FDA Wrongfully Approved Abortion Pill\">chemical abortion drug regimen<\/a>.&#8221;<\/p>\n<p>The \u2062decision was made by three judges, two of \u2062whom were appointed \u200bby former President\u2063 Donald Trump and one by former President George Bush. The \u2064Supreme\u2063 Court is expected to rule on \u2062the case\u2062 in its \u2063upcoming \u2064fall session, after previously putting\u2064 a stay on Kacsmaryk&#8217;s decision to suspend approval for the pill.<\/p>\n<p>The\u200b ruling has \u200bbeen met with\u200d celebration from pro-life organizations and criticism from <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/joe-biden-signs-memorandum-backpedaling-on-president-trumps-abortion-policies\/\" title=\"Joe Biden signs memorandum backpedaling on President Trump\u2019s abortion policies\">pro-abortion groups<\/a>.<\/p>\n<blockquote>\n<p>&#8220;Today&#8217;s ruling by the Fifth Circuit \u200cCourt of \u200bAppeals reinstating these basic safeguards and \u200dstopping the \u2063dangerous practice of mail-order \u2063abortions is \u200ca first step towards reprioritizing women&#8217;s health over the interests of the abortion industry and its allies within our profession,&#8221; stated the American Association of Pro-Life Obstetricians and Gynecologists, a plaintiff in the \u2064case.<\/p>\n<\/blockquote>\n<p>Planned Parenthood Federation\u200d of America President Alexis McGill \u200cJohnson expressed concern, stating that\u200d the ruling &#8220;makes it\u2063 clear that mifepristone&#8217;s approval \u200dis\u2064 very much still \u2064at risk, as is the FDA&#8217;s independence.&#8221;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Fifth Circuit Court of Appeals stated that mifepristone, a chemical abortion drug, cannot be sent by mail or prescribed through telemedicine.
