Indeed, it \u200cis even hard \u200dto\u200b secure\u2063 a\u2063 state pardon, which is not issued\u2062 by the\u200b governor but a pardon board,\u201d Turley wrote for the Daily\u200c Beast.<\/p>\n<p>Outlets like CBS \u2063News have also \u2062reported that Trump would not be able\u2064 to \u200cpardon\u2064 himself from <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/report-house-democrats-budget-slashes-border-enforcement-funding-by-a-billion-dollars\/\" title=\"Report: House Democrats\u2019 Budget Slashes Border Enforcement Funding By A Billion Dollars\">state-level crimes<\/a>.<\/p>\n<p><\/p>\n<p>However, Levin, who was chief of\u200d staff \u200bto Attorney General \u2063Edwin Meese during the Reagan administration, takes a counterview.<\/p>\n<p>He tweeted Tuesday, \u201cPresident Trump\u200b can, in fact, \u200dpardon himself from the GA\u200c charges if \u200bhe is elected president.\u201d<\/p>\n<p>Levin argued that \u2063the same reasoning the DOJ has employed\u2063 to conclude a president is\u2063 shielded from criminal\u200d prosecution at the federal level applies at the state level, too.<\/p>\n<p>\u201c1. The Constitution\u2019s silent\u2062 about whether a\u2062 president can\u2062 be indicted,\u201d \u2064the conservative commentator tweeted.<\/p>\n<p>\u201c2. The\u200d DOJ\u2063 has taken the position under both parties that you cannot indict a sitting president because it would \u200dcripple the\u2063 executive branch and make his ability to defend\u200d himself effectively impossible.<\/p>\n<p>\u201c3. Given\u2064 the DOJ\u2019s position, and the\u2062 Supremacy Clause in the Constitution, I would argue strongly\u2063 that the idea that a\u200b president \u200ccannot \u200dbe indicted\u200b at the federal \u200clevel\u2064 because it would cripple the executive branch, but can be indicted\u200b by local DAs, would\u200d have exactly the same\u2064 effect as a\u200b <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/desantis-trump-should-have-come-out-more-forcefully-during-jan-6-capitol-riot\/\" title=\"DeSantis: Trump should've been stronger on Jan. 6 Capitol riot.\">federal\u2062 indictment<\/a>, except there are \u200bthousands of local \u200cand\u200c state prosecutors making the crippling of a\u2064 president \u2062even \u2064more likely.<\/p>\n<p>\u201c4. FURTHERMORE, if indicted and even convicted, the \u200didea that \u200ba president cannot pardon\u200b himself from state charges is absurd, again, not only because of the Supremacy Clause, but the same considerations that apply\u200c to \u200da \u200cfederal conviction would obviously apply to a \u200cstate conviction.<\/p>\n<p>\u201cTherefore,\u2062 I \u2064disagree with \u200cJonathan Turley\u2019s view and others\u2063 who \u200dkeep \u200drepeating it,\u201d Levin concluded.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">President Trump can, in fact, pardon himself\u200b from \u200dthe GA \u2063charges if \u2062he is \u200delected president.<\/p>\n<p>1. It prohibits states from interfering with the \u200bfederal government\u2019s exercise of \u2064its constitutional powers.\u201d<\/p>\n<p>Levin\u2019s \u200bargument is\u200c that this clause means a state court would not be able \u2062to \u200ddo what a\u200d federal court could not \u2063in relation to preventing the president from performing\u200d his job under the Constitution.<\/p>\n<p>In \u200bother words, a \u200dstate cannot trump the \u2064federal government in this \u200dmatter. \u2063Georgia could not force \u200ba President Trump to try to govern from a state \u200bjail.<\/p>\n<p>The remedy provided by the Constitution for a president who is believed\u200c to have engaged in criminal\u2064 wrongdoing\u2064 is for Congress\u2062 to impeach \u200chim or \u200cher.<\/p>\n<p>Levin makes a compelling case.
