The judge, \u200cBeryl \u200bHowell, stated that immediate\u200d notification of the warrant to Trump would seriously\u2063 jeopardize the\u200c ongoing investigation. \u2064This disclosure would provide him with an \u2064opportunity to \u200ddestroy \u200devidence, alter his \u200cbehavior, inform his associates, and potentially escape prosecution. As a result, Twitter was compelled to \u2063provide \u200dextensive data from \u200bTrump&#8217;s\u2062 account to Mr.\u2062 Smith&#8217;s\u200c team.<\/p>\n<p>In a filing unsealed \u200cthis week, Mr. Smith&#8217;s team argued that the court should\u2062 approve the non-disclosure order due to\u200c the\u2062 potential risk of Trump attempting to flee if the order was \u200cnot in place.<\/p>\n<blockquote>\n<p>Keeping the warrant secret &#8220;furthers several additional\u200c governmental interests, including (1) &#8216;prevent[ing] the escape&#8217; of individuals\u200b who may be indicted,&#8221; Mr. \u200bSmith&#8217;s team claimed.<\/p>\n<\/blockquote>\n<p>Twitter, however, \u200cobjected to these claims, stating that there was no reason to believe\u2062 that\u200d notifying Trump about \u2063the warrant would lead to \u2064the destruction of\u200c evidence,\u200c witness intimidation,\u200b or \u2062an \u200dattempt \u200dto\u2064 flee prosecution.<\/p>\n<p>In a filing on\u200c February 2, Twitter&#8217;s lawyers argued, &#8220;The former President has announced that\u200d he is running for re-election\u2064 in\u200b 2024, which renders it highly implausible that he \u200dwill attempt to flee the \u2062country, and even more unlikely that such flight\u200b would be precipitated by\u2064 this specific warrant.&#8221;<\/p>\n<p>During a hearing on February 7, Judge Howell acknowledged \u200bTwitter&#8217;s concerns and expressed her\u2064 understanding of their desire to modify the non-disclosure order to remove the &#8220;potential risk of flight by the president.&#8221;<\/p>\n<p>Prosecutors \u200clater admitted their error in including \u200cthe flight risk claim and sought to\u200d strike \u200dthat language from\u200b the non-disclosure order.<\/p>\n<p>Portions\u200d of Judge Howell&#8217;s order were previously made \u2063public by an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-court-is-fast-tracking-sidney-powells-request-for-a-forensic-exam-of-dominion-voting-machines\/\" title=\"Federal Court Is Fast-Tracking Sidney Powell\u2019s Request For A Forensic Exam Of Dominion Voting Machines\">appeals court<\/a>, which supported her decision to approve the warrant \u200band order.<\/p>\n<h2>Warrant Approved, Reaffirmed<\/h2>\n<p>The warrant was approved\u200c on\u200d January 17, the \u2064same \u200bday it was \u200crequested. Judge\u2064 Howell\u2062 also entered the non-disclosure order on\u2064 that day, which was subsequently challenged by Twitter.<\/p>\n<p>Mr. Smith obtained the warrant as \u200cpart of \u2064his investigation into \u2064President Trump&#8217;s efforts to investigate the 2020 presidential\u200b election.
