In these circumstances,\u200c federal \u200blaw\u2062 provides for prompt removal of \u200ca \u2063\u201ccriminal prosecution . . . commenced in a State court . . . against or directed to\u201d a\u2064 federal official, \u201cin \u200ban official or individual capacity, for or\u200c relating to any \u200cact under color of [his] \u200c office.\u201d<\/p>\n<\/blockquote>\n<p>The filing came one day after he was\u200d indicted along with 45<sup>th<\/sup> President Donald Trump \u2064and 17 others over\u200b alleged efforts to overturn the 2020 election.\u2064 Terwilliger specifically points out that many of \u200dthe alleged charges by \u2062Willis\u2063 are not \u200c\u201ccriminal <em>per se<\/em>.\u201d<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cNothing Mr. Meadows \u2064is alleged in the indictment to have done is criminal <em>per \u2064se<\/em>: arranging Oval \u200cOffice meetings, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/mark-meadows-requests-removal-of-georgia-election-case-from-fulton-county-court\/\" title=\"Mark Meadows seeks transfer of Georgia election case from Fulton County court.\">contacting state officials<\/a> on the President\u2019s behalf, visiting\u2062 a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/former-white-house-chief-of-staff-mark-meadows-files-to-move-fulton-county-case-to-federal-court\/\" title=\"Mark Meadows, ex-White House Chief of Staff, seeks to transfer Fulton County case to federal court.\">state \u200bgovernment\u2064 building<\/a>, and\u200b setting up \u200da phone call\u200d for the President,\u201d Terwilliger wrote. \u201cOne would expect a \u200cChief of Staff to the President of\u2062 the United States to do \u2063these sorts of things.\u201d<\/p>\n<\/blockquote>\n<p>Counsel for the National Legal and Policy Center, Paul Kamenar, told\u200d One America \u2062News that \u200cfederal law requires\u200d the removal of criminal proceedings brought in state court if the alleged crimes occurred when the defendant was operating in a federal role.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThe underlying rationale\u2064 for that law was\u2063 not to have state courts and state prosecutors interfere with federal officials\u2019 duties,\u201d Kamenar said. \u201cAnd so in this case, all the allegations against Trump and Mark Meadows revolve\u2063 around the\u2062 activities \u2062they did in the White House while \u2062they were in office.\u201d<\/p>\n<\/blockquote>\n<p>Kamenar \u2062was referring to federal\u200d statute <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/28\/1442\" target=\"_blank\" rel=\"noreferrer noopener\">28 U.S. \u2062Code \u00a7 1442<\/a> which says,\u2064 \u201cA civil action or criminal prosecution that is\u2064 commenced in\u2062 a <a href=\"https:\/\/www.law.cornell.edu\/definitions\/uscode.php?width=840&#038;height=800&#038;iframe=true&#038;def_id=28-USC-1383817500-315185671&#038;term_occur=999&#038;term_src=title:28:part:IV:chapter:89:section:1442\" target=\"_blank\" rel=\"noreferrer noopener\">State court<\/a> and that\u2063 is \u200dagainst or directed \u200cto any of\u200d the following may be removed by them \u2064to\u200b the\u2063 district court of the United States\u2062 for\u200c the \u2062district and\u2062 division embracing the place wherein it is\u200c pending\u2026any officer \u2062(or any\u2062 person acting under that officer) of the United States.\u201d<\/p>\n<p>Kamenar\u200d says moving the case to a federal \u200ccourt\u2062 would not only be beneficial for \u200dMeadows, but also for \u200dTrump.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThe jury \u200cpool \u2063will be brought from \u2064a broader spectrum and population demographics than it would\u200b be just in Fulton County, Georgia,\u201d Kamenar said. \u201cThat\u2019s one advantage. Secondly, \u200cthere would be these motions that are going to\u2062 be made regarding immunity that federal courts are expert \u200cat resolving rather than a state judge.\u201d<\/p>\n<\/blockquote>\n<p>Many expect Trump\u2019s\u200c legal team to follow Meadows\u2019 lead, filing their own motion to move the case to a federal \u200dcourt.\u2064 Trump did so in New \u200dYork\u2019s case, but it was denied.\u2063 Kamenar says \u200bthey would have a better argument in the\u2064 Fulton County case.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201c[The New York case] was more\u2062 of a personal matter, even when \u2064he was \u200din office,\u201d Kamenar said. \u201cHere, on the other hand, the allegations are clear that this deals \u200dwith\u200d duties while [Trump] \u200cwas in \u200doffice. They were\u2064 arguably among his duties as president of the\u2064 United States to make sure that \u200dthe elections are proper and the votes are \u2064properly \u200ccounted.\u201d<\/p>\n<\/blockquote>\n<p>Stay informed!
