In these circumstances, federal law provides for prompt removal of a \u201ccriminal prosecution . . \u2064. commenced \u200din\u200d a State court . . . against or\u2064 directed to\u201d a federal \u200cofficial, \u201cin an official or individual capacity, for or \u200brelating to any \u2062act under color of [his] office.\u201d<\/p>\n<\/blockquote>\n<p>The filing came one day after he was indicted \u2064along\u2064 with 45<sup>th<\/sup> President Donald Trump and 17\u2062 others over alleged efforts to overturn the 2020 election. Terwilliger specifically points out that many of the alleged charges by Willis are not \u201ccriminal <em>per se<\/em>.\u201d<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cNothing Mr. Meadows is\u200d alleged in the \u200cindictment to\u2063 have done \u2062is criminal \u200c <em>per \u200cse<\/em>: arranging Oval Office meetings, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/mark-meadows-requests-removal-of-georgia-election-case-from-fulton-county-court\/\" title=\"Mark Meadows seeks transfer of Georgia election case from Fulton County court.\">contacting state officials<\/a> on the President\u2019s behalf, visiting \u2062a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/multiple-states-take-action-to-end-mask-mandates\/\" title=\"Multiple states take action to end mask mandates\">state government building<\/a>, and setting \u2063up a phone call for the President,\u201d Terwilliger wrote. \u201cOne would expect a Chief \u2064of Staff to the President \u200dof the United States to do \u2063these sorts of\u2063 things.\u201d<\/p>\n<\/blockquote>\n<p>Counsel for the National Legal and Policy \u200dCenter, Paul Kamenar,\u2064 told \u2062One America News \u200cthat federal\u200d law requires\u200d the removal of criminal \u200cproceedings brought in state \u2063court if\u200b the alleged crimes\u2064 occurred when the\u200d defendant\u2063 was\u2063 operating in a federal role.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThe underlying rationale for that law was not \u200cto have state courts and state prosecutors interfere with federal officials\u2019 duties,\u201d Kamenar said.\u2062 \u201cAnd so in this case, all the allegations against \u2062Trump and Mark Meadows revolve around the\u2064 activities they did in \u2063the\u2063 White House while \u2062they were \u2062in office.\u201d<\/p>\n<\/blockquote>\n<p>Kamenar was \u2064referring to federal\u2063 statute <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/28\/1442\" target=\"_blank\" rel=\"noreferrer noopener\">28 U.S. Code \u00a7 1442<\/a> \u2062which\u2062 says, \u201cA civil action or criminal prosecution that \u200dis commenced\u2064 in a <a href=\"https:\/\/www.law.cornell.edu\/definitions\/uscode.php?width=840&#038;height=800&#038;iframe=true&#038;def_id=28-USC-1383817500-315185671&#038;term_occur=999&#038;term_src=title:28:part:IV:chapter:89:section:1442\" target=\"_blank\" rel=\"noreferrer noopener\">State court<\/a> and that is against or directed to any of \u200cthe following may be removed by them\u2062 to \u2064the \u2064district court of\u2064 the United States for the district \u200dand\u200c division embracing the place wherein it is pending\u2026any officer \u2063(or any person \u200cacting under that officer) of the United States.\u201d<\/p>\n<p>Kamenar says moving the case to a federal court would not only be \u200dbeneficial \u2062for Meadows,\u2063 but also for Trump.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThe jury pool will \u200dbe brought from a broader spectrum and population demographics than it would be just in Fulton County, Georgia,\u201d Kamenar said. \u201cThat\u2019s one advantage. Secondly, there would be these \u200cmotions that are going to be\u2063 made regarding immunity that federal courts are expert at resolving rather than a state judge.\u201d<\/p>\n<\/blockquote>\n<p>Many expect Trump\u2019s legal team to follow Meadows\u2019\u2063 lead, filing their own motion to \u200cmove the case to a federal court. Trump did so in New York\u2019s \u200dcase, but it \u2063was denied. Kamenar \u2062says they would have\u200d a better argument in the \u200bFulton County case.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201c[The New York case] was\u200d more of a personal matter, even when he was in office,\u201d\u200d Kamenar said. \u201cHere,\u200c on the\u200c other hand, the allegations are clear that this deals \u200cwith\u200c duties while [Trump] \u200b was \u200din office. \u200cThey were arguably\u200c among his duties as president of the United States \u200dto \u200bmake sure that the\u200d elections are \u200bproper and the\u2064 votes\u200b are properly counted.\u201d<\/p>\n<\/blockquote>\n<p>Stay informed! \u200dReceive breaking news \u200cblasts\u200d directly to your inbox for\u200d free.
