Their \u200clawsuit invoked a\u200b 1972\u200b clause in Montana&#8217;s constitution, \u200cwhich mandates the preservation\u2064 and improvement of a clean and healthful environment for present and future generations.<\/p>\n<p>This landmark ruling \u2063now requires Montana to consider climate change when \u2064evaluating the approval of fossil fuel \u200bprojects, including power plants. Previously, the state had \u200cprohibited the consideration of &#8220;actual or \u2063potential impacts that \u2062are regional, national,\u200c or global in nature&#8221; in such\u200d decisions since 2011.<\/p>\n<p>Unsurprisingly,\u200d Montana Attorney General Austin Knudsen, a Republican, intends to appeal the ruling. With approximately 30% \u2064of the nation&#8217;s total coal reserves, the \u2063state produced about\u2064 5% of the country&#8217;s coal in 2021.<\/p>\n<p>Julia Olson, the founder of Our Children&#8217;s Trust, the organization that filed the lawsuit\u2063 on behalf of the young plaintiffs, hailed the ruling as a significant victory for Montana, youth, democracy, and the climate. She believes that more favorable rulings like this will follow in the future.<\/p>\n<p>Rikki Held, the lead \u200cplaintiff in the case \u200dat 22 years old, grew up on her family&#8217;s 7,000-acre ranch in Montana. She has \u200cpersonally witnessed \u200dthe devastating impacts of extreme weather, flooding, and wildfires on \u200ctheir crops and livestock, which she attributes to climate change. Held expressed \u200bhope for the future, stating\u2064 that decisions like \u2063this, along\u2062 with other ongoing court cases, will inevitably bring about the necessary change.<\/p>\n<p>Similar to Montana, young people in other\u2063 states have also taken legal action to address \u200cthe adverse effects of climate change.
