It\u2062 doesn&#8217;t serve the country&#8217;s best interest for either party to criminalize what is already \u2063a dirty game, yet here we are,\u201d he said.<\/p>\n<div class=\"shortcode\">\n<div class=\"lazyload-wrapper\">\n<div class=\"lazyload-placeholder\"><\/div>\n<\/p><\/div>\n<\/p><\/div>\n<p>Mr. Miller is disturbed by the use of RICO, which was first enacted\u2064 at \u2064the federal level in 1970 to go after \u200dthe mafia. More than 30 states have adopted their own \u2063RICO statutes.<\/p>\n<p>But because the law was written \u201cvery broadly,\u201d it has been used to\u2064 prosecute people that RICO\u2064 \u201cwasn\u2019t really intended to go after.\u201d<\/p>\n<p>\u201cMost notoriously,\u201d RICO was\u200b used \u200bto prosecute pro-life\u200d activist\u2062 Joseph \u2062Scheidler \u200bfor protesting against \u200babortion.<\/p>\n<p>But the Supreme \u200bCourt ruled in his favor in 2006, saying RICO \u201cwas not meant to go that far, that\u2062 Joe\u2019s \u200b<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-denied-request-for-delay-in-jan-6-hearing-after-truth-social-tirade-against-judge\/\" title=\"Trump refused to postpone Jan. 6 hearing despite criticizing judge on Truth Social.\">free \u200cspeech rights<\/a> cannot be curtailed by claiming he was\u2064 threatening other \u200bconstitutional rights,\u201d Mr. Miller said.<\/p>\n<p>President Trump will argue that \u201che\u2019s allowed to believe\u2064 and say that he\u200c thinks he won \u200bthe election, and as applied here \u200bin Georgia, \u200dthat he thinks\u2064 a recount would\u2064 have turned up the votes that he needed to\u200b win\u2014no different than [when] Vice President [Al] Gore\u2063 felt [in the 2000 election] that if you counted\u200b every dimpled chad in \u2062Florida, \u200dhe would have \u200bwon,\u201d according to Mr. Miller.<\/p>\n<p>\u201cAnd then you \u200blayer\u200b on\u200d top of\u200b it, that so many of these co-defendants are lawyers,\u201d \u2062he said.<\/p>\n<p>\u201cSo now you&#8217;re not just saying \u200bthat President Trump&#8217;s not allowed to believe that he\u2062 won and try and fight the\u200b outcome no different than Vice President Gore, but you&#8217;re saying\u200b that \u2062he can&#8217;t rely upon lawyers.<\/p>\n<p>\u201cThese lawyers are giving Trump\u2064 advice, saying, \u2018Yes, you can seek\u200c to overturn the election, and here&#8217;s the strategy.\u2019 Now\u200b it&#8217;s \u2018no, you shouldn&#8217;t have listened\u2063 to those lawyers\u2014in fact, what they were telling you to do\u2062 was \u200ccriminal.\u2019\u201d<\/p>\n<p>Vice President Gore challenged the outcome in 2000, as did John \u200bKerry in 2004\u2064 and Hillary Clinton in 2016,\u2062 and \u201cwe all know about 1960 with Nixon and Kennedy in Chicago.\u201d<\/p>\n<p>\u201cIt&#8217;s just not unreasonable for Americans to believe \u200dthat their candidate got shafted, and we&#8217;ve never\u2062 previously said that that amounts to criminal behavior,\u201d Mr. Miller said.<\/p>\n<p>Before these Trump indictments started, \u2063\u201cit seemed \u200dthat the country was moving on,\u201d but now \u201cevery time he\u2019s indicted, he\u2062 seems to get\u200d more popular,\u201d he said.<\/p>\n<h2>RICO Lawyer \u2064Weighs In<\/h2>\n<p>Attorney Etan Mark of Mark, Migdal, and\u2062 Hayden in Miami, who has \u200bhandled many RICO\u2063 cases, said he wasn\u2019t surprised\u200b that the charges were \u2062brought under RICO, which\u200d he\u200c described as \u201ca useful statute when you&#8217;re looking to encompass claims against a scattered group of people without any real formal affiliation,\u2064 but they are all working towards a common\u200c objective.\u201d<\/p>\n<p>The indictment\u2063 begins \u201cwith the premise that it\u2019s a\u2062 crime\u200b to try to overturn a federal election,\u201d and then officials are \u201cdelineating all of the things that Donald Trump did\u200c or said in furtherance of that particular crime,\u201d including statements on social media and communications with state officials in Georgia.<\/p>\n<p>\u201cThere&#8217;s obviously a difference between using the judicial process to claim that there&#8217;s been some defects in connection with the election, and getting in front of a group of people and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ice-nominee-worked-with-blm-to-push-false-claim-that-white-man-murdered-7-year-old-black-girl\/\" title=\"ICE Nominee Worked With BLM to Push False Claim That White Man Murdered 7-Year-Old Black Girl\">making false allegations<\/a>,\u201d Mr. Mark said.<\/p>\n<p>The difference between Mr.\u200b Gore and \u200dPresident Trump is that once the courts had \u200druled, \u201cGore conceded.\u201d<\/p>\n<p>But President Trump went on national \u2062television telling \u201ceverybody who would listen that\u2064 the election was stolen and the results are illegitimate &#8230; [and] he used his people and he himself \u200bparticipated in commu<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Legal experts have stated that the Georgia grand jury&#8217;s indictment of ex-President Donald Trump for his attempts to overturn the 2020 election results may breach democratic norms.
