Both judges were appointed under President \u200cDonald \u2064Trump.<\/p>\n<div class=\"shortcode\">\n<div class=\"lazyload-wrapper\">\n<div class=\"lazyload-placeholder\"><\/div>\n<\/p><\/div>\n<\/p><\/div>\n<p>U.S.\u2063 Circuit Judge Paul Niemeyer, \u2062appointed under\u2063 Republican former President George H.W. Bush, dissented.<\/p>\n<p>&#8220;The majority \u2063reads the parents\u2019 complaint\u2063 in this case in an \u200cunfairly narrow way and \u2064thus denies the parents the ability to obtain\u2063 relief, concluding that the \u2064parents have no standing to challenge the guidelines until they learn \u2062that their own children are actually considering gender transition,&#8221;\u2063 Judge Niemeyer \u2062wrote in the dissent.<\/p>\n<p>&#8220;In reaching that conclusion, the majority \u200cis, I \u2064submit, unnecessarily subjecting \u2062the parents by default to a mandatory policy that pulls \u2064the discussion of gender issues from the family\u200d circle to\u2063 the public schools without \u2063any avenue of redress by the parents,&#8221;\u200d he added.<\/p>\n<p>Judge Quattlebaum said the\u200c dissent only detailed harms \u2062that occur after a child identifies as transgender or gender nonconforming, \u2064which doesn&#8217;t provide standing.<\/p>\n<h2>Attorney Responds<\/h2>\n<p>Frederick Claybrook,\u2063 an\u200b attorney representing the parents, said in \u2063a statement to \u200bnews\u200b outlets that the decision was wrong.<\/p>\n<p>\u201cParents do not have to wait until they\u200c find out that damage has been done in secret \u200cbefore they may complain,\u201d he \u200csaid.<\/p>\n<p>Montgomery County officials did not respond to a request for comment.<\/p>\n<p>The suit was brought by parents who said they wouldn&#8217;t know if their students were transitioned in school and \u2062that irreparable harm might happen before they became aware.\u200d They said that the policy was a violation\u2063 of Maryland and federal laws, as well as the state and federal constitutions.<\/p>\n<p>The policy in question is titled the &#8220;guidelines for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/parents-say-massachusetts-middle-school-carried-out-secret-gender-transitions-on-children\/\" title=\"Parents Say Massachusetts Middle School Carried Out Secret Gender Transitions on Children\">student gender identity<\/a> in Montgomery County Public\u200c Schools.&#8221;<\/p>\n<p>The policy says that \u200dstudents &#8220;have \u200ba right to privacy,&#8221; including &#8220;the right to keep private one&#8217;s transgender status or <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/renowned-biologist-rebukes-inclusive-biology-instruction\/\" title=\"Renowned Biologist Rebukes \u2018Inclusive\u2019 Biology Instruction\">gender nonconforming presentation<\/a> at school.&#8221;<\/p>\n<p>Information about a student&#8217;s transgender status may \u200bbe <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/parents-cant-challenge-us-districts-secret-transition-policy-because-their-children-arent-transgender-court\/\" title=\"Parents cannot challenge a US District's secret transition policy as their children are not transgender, says court.\">considered confidential medical information<\/a> and disclosing it \u200dto parents\u2064 may violate laws, the policy states. That applies even if parents ask.<\/p>\n<p>The guidelines also let staffers, regardless\u2062 of\u2063 qualification, assist students in evaluating their gender identity \u2064in a process that \u200cis also designed to keep the information secret from most or \u200dall parents.<\/p>\n<p>Staffers are directed in the\u2062 system to use the \u200bstudents&#8217; new name in school but to use their birth name when the parents \u200bare around.<\/p>\n<p>The policy violates, among other \u2062laws, the \u2063Maryland Family Law, which says that parents are &#8220;jointly and severally responsible&#8221; for their child&#8217;s &#8220;support, care,\u2062 nurture, welfare, and education,&#8221; the parents alleged in their suit.<\/p>\n<p>Montgomery County defendants argued that the parents were mistaken in their beliefs about parental \u200drights.<\/p>\n<p>&#8220;Plaintiffs\u2019 claims proceed from a fundamentally \u200bmistaken premise, \u200cwhich is that parents have an unfettered right to direct how their children will be \u2064treated while at school,&#8221; district officials said in one filing.<\/p>\n<p>&#8220;The gu<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Maryland parents cannot challenge a school district&#8217;s transgender policy without transgender children.
