U.S. District Judge Thomas Ludington of the \u2064Eastern District \u2062of Michigan issued an 18-page\u2062 order on Aug. 14, dismissing\u2063 the lawsuit without prejudice. The lawsuit \u200bwas filed by the New Civil \u200cLiberties Alliance (NCLA)\u2062 on behalf of the Cato Institute and Mackinac Center\u200c for Public Policy earlier this \u200bmonth.<\/p>\n<p>Judge Ludington concluded that the lawsuit lacked standing and the groups did not demonstrate they would suffer injury \u2063by \u200cthe administration&#8217;s student loan forgiveness plan.<\/p>\n<blockquote>\n<h3>Related Stories<\/h3>\n<ul>\n<li><a href=\"http:\/\/www.theepochtimes.com\/us\/group-files-lawsuit-to-stop-bidens-new-student-loan-repayment-plan-5445764\">Conservative Group Files\u200d Lawsuit to Stop \u200dBiden&#8217;s New \u2064$39 Billion Student Loan Repayment Plan<\/a> &#8211; 8\/4\/2023<\/li>\n<li><a href=\"http:\/\/www.theepochtimes.com\/us\/biden-launches-beta-version-of-revised-student-loan-repayment-plan-5435216\">Biden Launches &#8216;Beta Version&#8217; of Revised \u200cStudent Loan Repayment Plan<\/a> \u2063 &#8211; 7\/31\/2023<\/li>\n<\/ul>\n<\/blockquote>\n<p>&#8220;Plaintiffs have\u2063 not shown \u2062a redressable injury caused by Defendants,&#8221; the judge wrote. &#8220;But\u2014even \u200dassuming that Plaintiffs&#8217; alleged injury was sufficient\u2014they \u200chave not adequately demonstrated a causal link between Defendants&#8217; action\u2063 and an identifiable injury.&#8221;<\/p>\n<p>The judge also rejected the groups&#8217; \u200crequest to temporarily halt the administration&#8217;s plan.<\/p>\n<p>In response to the ruling, Sheng Li, litigation counsel for NCLA,\u2064 told media \u2063outlets\u200d in an email statement that the groups are reviewing their legal options.<\/p>\n<p>&#8220;The\u200d district \u2063court did not rule on the merits of the case\u200b and instead \u200dsaid Cato and Mackinac\u2064 were not\u2063 the right parties\u200d to bring it,&#8221; Mr. Sheng stated. &#8220;We disagree with the court&#8217;s conclusion regarding legal standing and\u200b are reviewing legal options with our clients.&#8221;<\/p>\n<p>President Joe Biden issued a statement celebrating the\u200d ruling.<\/p>\n<p>&#8220;I&#8217;m \u200cproud that my Administration is\u200d delivering on that \u200dpromise\u2062 and has \u200dalready approved over $116 billion in debt cancellation\u2062 for 3.4 million Americans \u2013 no matter how many lawsuits, challenges, or roadblocks Republican elected officials or special interests put in our way,&#8221; President Biden said.<\/p>\n<p>&#8220;As I announced earlier this summer in the wake of the Supreme Court&#8217;s decision on our student \u2064debt relief plan, we will continue to pursue\u200c an \u2063alternative path to deliver student debt relief to as \u2064many borrowers as possible as quickly as possible,&#8221; the\u200c president added. &#8220;We will use every tool at our disposal to get student loan borrowers\u200b the relief they\u2062 need to reach their dreams.&#8221;<\/p>\n<p>The court&#8217;s decision\u200c happened on the same day that the Department of Education began providing \u200b$39 billion in student loan forgiveness for borrowers.<\/p>\n<p>&#8220;Today, the \u2064Biden-Harris Administration\u200c is beginning \u200bto discharge loans for 804,000 borrowers who never received the forgiveness they \u200crightfully earned through decades of payments,&#8221; Education Secretary Miguel Cardona wrote on X, formerly known as Twitter, on\u2063 Aug. 14. \u2063&#8221;We are fighting for\u2064 borrowers and fixing a \u2062broken student loan \u200bsystem.&#8221;<\/p>\n<p>On July \u200d14, the Biden administration announced a $39 billion student loan forgiveness plan for 804,000 borrowers, in a move to fix &#8220;administrative failures&#8221; that had held up relief for borrowed \u2064under IDR plans.<\/p>\n<p>Weeks earlier, the Supreme Court voted 6\u20133 to strike down President Biden&#8217;s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/nyc-mayor-adams-announces-student-debt-relief-program-for-mental-health-professionals\/\" title=\"NYC Mayor Adams announces student debt relief program for mental health professionals\">student debt relief program<\/a>\u2062 to provide as much \u2064as $20,000 \u200bfor around 40 million borrowers.<\/p>\n<p>On Aug. 4, NCLA\u2063 filed the lawsuit in the U.S. District Court for the Eastern District of Michigan, arguing that the Department of Education &#8220;has \u2064no lawful authority&#8221; to carry out the student\u2064 loan forgiveness \u200bplan.<\/p>\n<p>&#8220;NCLA\u200c argues the U.S. Department of Education&#8217;s actions\u200d violate the \u2063Constitution&#8217;s \u2062Appropriations Clause, which grants Congress \u2062near-exclusive authority to<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A federal judge in Michigan dismissed a lawsuit by conservative groups against the Biden administration&#8217;s student loan income-driven repayment plan.
