The <a href=\"https:\/\/thefederalist.com\/2023\/08\/01\/biden-delivers-another-blow-against-his-primary-political-rival-with-latest-trump-indictment\/\" target=\"_blank\" rel=\"noreferrer noopener\">indictment<\/a> from earlier this month, not to be confused with the <a href=\"https:\/\/thefederalist.com\/2023\/08\/15\/fulton-countys-bogus-trump-indictment-is-democrats-latest-attempt-to-criminalize-free-speech\/\" target=\"_blank\" rel=\"noreferrer noopener\">Georgia indictment<\/a> out Monday night, was the third \u200bround of \u2064get-Trump charges this election \u200dcycle and was <a href=\"https:\/\/thefederalist.com\/2023\/08\/02\/doj-indictment-of-trump-is-a-declaration-of-war-against-american-voters\/\" target=\"_blank\" rel=\"noreferrer noopener\">ostensibly related<\/a> to Trump\u2019s speech surrounding the Capitol\u200d riot two and a half years ago. Judge Tanya Chutkan is presiding.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1914203947\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-42b6cd99784acb53effe1ed91221122d fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-42b6cd99784acb53effe1ed91221122d\"><\/div>\n<p>\u201cThere is \u200dno way I can get a fair trial with the judge \u2018assigned\u2019 to the \u2063ridiculous freedom of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/more-questions-raised-about-fair-trump-trial-after-its-revealed-what-doj-prosecutor-spent-money-on\/\" title=\"Concerns grow over fairness of Trump trial as details emerge on DOJ prosecutor's expenditures.\">speech\/fair elections case<\/a>. Everybody knows this, and so does she!\u201d Trump <a href=\"https:\/\/thehill.com\/regulation\/court-battles\/4140283-trump-targets-judge-in-jan-6-case-says-legal-team-will-ask-for-recusal\/\" target=\"_blank\" rel=\"noreferrer noopener\">wrote <\/a>on his \u2063social media platform Truth Social. \u201cWe will be immediately asking for recusal of this judge on\u2062 very powerful grounds, and likewise for venue change, out [of] D.C.\u201d<\/p>\n<p>An examination of Chutkan\u2019s \u2064prior\u200d statements gives Trump and his supporters \u200cgood \u2062reason to be\u2062 concerned.\u200b Chutkan, who was appointed to the federal bench \u200bby \u200dPresident Barack Obama and confirmed in 2014, has a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/house-dems-reject-gop-effort-to-compel-probe-into-covid-origins\/\" title=\"House Dems Reject GOP Effort To Compel Probe Into COVID Origins\">recent track record<\/a> that is\u2063 incompatible with impartiality. Serving on \u2062the U.S. District Court for the District\u2062 of Columbia, Chutkan has \u2062presided over more\u200d than \u2062three dozen cases\u2063 of those charged with crimes related to the Capitol riot.\u2064 <a href=\"https:\/\/apnews.com\/article\/trump-indictment-judge-tanya-chutkan-capitol-riot-9ba5c18d315697d759521425ea203012\" target=\"_blank\" rel=\"noreferrer noopener\">According <\/a>to the Associated Press, Chutkan built a reputation as a\u2062 \u201ctough \u2063punisher of Capitol rioters,\u201d with <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-tanya-chutkans-record-should-disqualify-her-from-presiding-over-trumps-j6-trial\/\" title=\"Judge Tanya Chutkan's record disqualifies her for presiding over Trump's J6 trial.\">38 defendants receiving severe sentences<\/a>.<\/p>\n<p>\u201cOther judges typically\u200b have\u2064 handed down sentences that are more lenient than those requested by prosecutors,\u201d\u2062 the AP reported. \u201cChutkan,\u2063 however, has matched or exceeded prosecutors\u2019 recommendations in 19 of her 38 sentences. In four of those cases, prosecutors weren\u2019t seeking any jail time at all.\u201d<\/p>\n<p>While dishing out decades in prison time\u2062 related to the Jan. 6\u200c riot, Chutkan rejected the idea that a bunch of <a href=\"https:\/\/www.washingtonexaminer.com\/opinion\/byron-yorks-daily-memo-the-larp-rebellion\" target=\"_blank\" rel=\"noreferrer noopener\">LARPers <\/a>led by some Narnia-like minotaur should be compared to the left-wing\u2062 George Floyd riots, which cost an\u200d estimated <a href=\"https:\/\/v2-9mdnszte.thefederalist.com\/2020\/09\/16\/george-floyd-riot-damage-could-cost-insurance-companies-upwards-of-2-billion\/\" target=\"_blank\" rel=\"noreferrer noopener\">$2 billion<\/a> in just two weeks. <\/p>\n<div class=\"fdrlst__b89e9-181dd4c1be6a0b49e4aa0720a495c7ba fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-181dd4c1be6a0b49e4aa0720a495c7ba\"><\/div>\n<p><strong>[READ:[READ:<a href=\"https:\/\/thefederalist.com\/2021\/02\/26\/estimates-george-floyd-riots-to-cost-66-times-more-than-capitol-damage\/#:~:text=Estimates%3A%20George%20Floyd%20Riots%20To%20Cost%2066%20Times%20More%20Than%20Capitol%20Damage&#038;text=The%20Capitol%20architect%20told%20lawmakers,cost%20an%20estimated%20%242%20billion.\" target=\"_blank\" rel=\"noreferrer noopener\">Estimates: George Floyd Riots To Cost 66 Times More Than Capitol Damage<\/a>]<\/strong><\/p>\n<p>To Chutkan, the latter was a minor episode in\u2063 the righteous \u200ccrusade for social justice. The former was a major threat \u2063to democracy. <\/p>\n<p>In 2021, Chutkan said of the 2020 riots that \u201cpeople gathered\u200d all over\u2064 the country last year to protest the violent murder by\u2062 the police of an unarmed man.\u201d<\/p>\n<p>\u201cBut\u2064 to compare the actions of people protesting, mostly peacefully, for civil rights,\u201d <a href=\"https:\/\/apnews.com\/article\/black-lives-matter-texas-sentencing-courts-capitol-siege-675b12d0ddacb64d9030c444f8812a5c\" target=\"_blank\" rel=\"noreferrer noopener\">she \u200b <\/a>added, \u201cto those\u200b of a violent mob seeking to overthrow the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/donald-trump-indicted-assigned-judge-tanya-chutkan-known-for-longest-jan-6-sentences\/\" title=\"Donald Trump indicted; Judge Tanya Chutkan known for lengthy Jan. 6 sentences.\">lawfully elected government<\/a> \u2063is a false equivalency and ignores a\u2063 very real danger that the Jan. 6 riot posed to the foundation of our\u2063 democracy.\u201d<\/p>\n<div class=\"fdrlst__b89e9-438e698143ac1a85e6056ea7712e05bb fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-438e698143ac1a85e6056ea7712e05bb\"><\/div>\n<p>Sounds like a very reasoned\u200c judge prepared to\u2064 preside fairly and impartially over the unprecedented trial of a former president who was vilified\u200d as the provocateur of the\u200b riot she condemned. <\/p>\n<p>Trump and his legal team\u200b may hope to move the trial away from D.C., but Chutkan\u2019s\u200c record previews how that will pan out. In April last year, one of the Jan. 6 \u2063defendants also moved to have the trial \u200cheld outside the nation\u2019s capital. <\/p>\n<p>\u201cThe defendant had noted the Capitol riot\u2019s impact on local residents, pretrial publicity and how D.C.\u2063 voted in the\u200b 2020 \u2064presidential\u2062 election,\u201d The\u200c Hill\u200c <a href=\"https:\/\/thehill.com\/regulation\/court-battles\/4144314-trump-faces-uphill-battle-in-moving-case-from-dc\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>. \u201cChutkan rejected all of those arguments, calling \u200dthe defendant\u2019s contention about the city\u2019s political makeup \u2018misleading and ultimately unavailing.&#8217;\u201d<\/p>\n<p>According to Chutkan, the idea that \u200ba jury\u2064 from where Democrats\u2064 captured their <a href=\"https:\/\/www.nytimes.com\/interactive\/2020\/11\/03\/us\/elections\/results-president.html?action=click&#038;pgtype=Article&#038;state=default&#038;module=styln-elections-2020&#038;region=TOP_BANNER&#038;context=election_recirc\">highest <\/a>electoral margin in the presidential contest would be biased against Trump is \u201cmisleading.\u201d<\/p>\n<p>Chutkan has even previously ruled against Trump related to the same\u2063 incident. Two years ago, Chutkan <a href=\"https:\/\/apnews.com\/article\/donald-trump-joe-biden-us-supreme-court-congress-capitol-siege-81abcdc965fe19597e5289e63ae7850b\" target=\"_blank\" rel=\"noreferrer noopener\">denied <\/a>the former president\u2019s request to\u2064 <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trumps-ex-wh-counsel-mcgahn-to-testify-next-week-about-mueller-report\/\" title=\"Trump's Ex-WH Counsel McGahn to Testify Next Week About Mueller Report\">assert executive privilege<\/a> over\u2062 documents sought by the House Select Committee on Jan. 6. <\/p>\n<p>Trump has every reason to want to hold his trial outside\u200c the Beltway.
