Chuck Grassley and Ron Johnson further\u2062 material, including evidence that implicates the Department of Justice in obstructing the investigation. <\/p>\n<p>However, court <a href=\"https:\/\/www.courtlistener.com\/docket\/67511765\/united-states-v-biden\/\" target=\"_blank\" rel=\"noreferrer noopener\">filings<\/a> in <em>United States v. Biden<\/em> from \u2064Friday indicate the collapse of \u2062Weiss\u2019s plea deal with Hunter Biden spurred the request for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/fbi-told-agent-who-confirmed-whistleblower-testimony-to-decline-to-respond-to-questions\/\" title=\"FBI instructed agent to not answer questions confirming whistleblower testimony.\">special \u200dcounsel status<\/a>. Noreika was \u200cparticularly concerned that the \u200dpretrial diversion agreement related to\u2062 the\u2064 gun offense\u200c included a provision granting \u200cwide-ranging immunity \u200bto Hunter \u2064Biden,\u2063 whereas normally that provision would be included in the plea agreement. <\/p>\n<p>On Friday, the Delaware\u200b U.S. attorney\u2019s office filed a \u200cmotion \u200bwith Judge Noreika stating that following the \u2062late-July hearing, the parties had\u200d entered\u2063 additional plea\u2064 negotiations but had \u2064\u201creached an impasse\u201d and that the government \u2064now believes the\u200d case will not resolve short of trial. \u200dAnd because \u201cvenue,\u201d meaning the proper location for a trial, does not lie in\u2063 Delaware\u2062 but\u2063 rather Washington, \u200bD.C., or the central\u2064 district of California,\u2063 Weiss\u2019s office moved to dismiss the charges against \u200dHunter Biden \u2062\u201cwithout prejudice,\u201d meaning \u2064charges could be refiled elsewhere. In fact, in his motion, Weiss noted prosecutors\u2064 are \u201cconsidering what tax charges to bring in another district\u2026\u201d<\/p>\n<p>While \u200cHunter Biden had agreed\u2063 to\u200b waive any objection to \u200bvenue in Delaware\u2064 as part\u200b of the plea agreement, \u2063once that\u200c deal fell apart, Weiss\u2064 needed authority \u200cto bring \u200bcharges in D.C. or California because as a Delaware\u200b U.S. attorney, his power was limited to that federal district. In naming Weiss special \u2064counsel, Garland authorized Weiss to bring criminal charges in any federal district court. <\/p>\n<div class=\"fdrlst__b89e9-6b483ef8a8419e4d2b625692bb2b59b7 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-6b483ef8a8419e4d2b625692bb2b59b7\"><\/div>\n<p>These circumstances \u2062best explain the timing\u200c for the appointment \u2014 but they also\u200b expose the impropriety of Weiss handling the investigation \u2062of Hunter \u2062Biden to this point without special counsel status.\u200b The regulations governing the appointment of a special counsel\u200b provide\u2063 that the attorney general \u201cwill appoint a \u200bSpecial Counsel\u201d\u2062 if \u2062a criminal investigation \u201cis warranted\u201d and the investigation or\u2064 prosecution\u2063 \u201cwould present a conflict of interest for the Department or\u2064 other extraordinary circumstances.\u201d <\/p>\n<p>But there was nothing about the \u2063collapse of the plea agreement that \u2064should \u2064have triggered the \u2063appointment of a special counsel:\u2064 It neither created a\u200b conflict of interest nor constituted \u201cextraordinary circumstances\u201d because \u200dWeiss could have filed\u200d charges \u200din D.C. or California by virtue of another federal statute, 28 U.S.C. \u00a7 515. In fact, Weiss had \u200cpreviously \u200c <a href=\"https:\/\/www.washingtonexaminer.com\/news\/senate\/david-weiss-letter-lindsey-graham-disputes-whistleblower-allegation-special-counsel\" target=\"_blank\" rel=\"noreferrer noopener\">discussed<\/a> with Garland obtaining authority under Section 515 to charge\u200c Hunter in another district, with Weiss saying he \u201cwas\u200c assured that \u2064 [he] would be \u200dgranted\u00a0this authority \u2064if it\u00a0proved necessary.\u201d<\/p>\n<p>That\u200d Weiss sought, and\u2063 Garland \u2063approved, the special \u200dcounsel \u200dappointment <em>now\u2063 <\/em>thus confirms that a conflict\u200c of interest animated the U.S. attorney\u2019s investigation into the president\u2019s son. And\u2062 since\u200c nothing new happened to create that conflict (or \u200bextraordinary circumstances), it is clear Garland failed to fulfill\u2064 his duties as attorney general by refusing to grant \u2062Weiss\u200d that status years ago.<\/p>\n<h2 class=\"wp-block-heading\">2. A Contradiction in Everything<\/h2>\n<ol><\/ol>\n<p>Garland\u2019s naming of Weiss \u200das special counsel\u200d not only contradicts any earlier claims that there was no need \u2062for\u200d such an appointment, but \u200cit also \u200ccontradicts nearly\u200b everything we\u2019ve been told about the investigation \u2063and the \u2063DOJ\u2019s \u200crole. We were told that Weiss was the ultimate decisionmaker \u2014 well, except that he obviously wasn\u2019t or he wouldn\u2019t have \u200bneeded \u2062the appointment. We were told he could take any \u200dsteps and make any investigative decisions,\u2063 having\u2064 ultimate authority over this matter \u2014 except now we\u2019re told he is\u200c no longer subject to the day-to-day\u2063 supervision of the Department of Justice. <\/p>\n<div class=\"fdrlst__b89e9-e9ace3b745c7e4991c2d745dcf7ea5d2 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-e9ace3b745c7e4991c2d745dcf7ea5d2\"><\/div>\n<p>Either Weiss had that \u200cpower, or\u2062 he didn\u2019t. Either he was in charge of the investigation, or he wasn\u2019t. Naming Weiss \u2062special counsel \u200dconfirms everything\u2064 we\u2019ve been\u200b told until now was a \u2062farce. And it wasn\u2019t just Garland telling us Weiss was totally in charge \u2014\u2063 it was \u2063also Weiss. Weiss even stuck with that \u2062story when contradicted\u2063 by \u2062the IRS whistleblowers \u200bwho had \u2064contemporaneous emails confirming\u2064 the Delaware U.S. attorney had \u2064told upper-level\u200c managers \u2063on \u2064the investigation that he \u200cwas not \u2063the ultimate decisionmaker. <\/p>\n<p>That Weiss\u2063 gave Garland cover, allowed \u200dthe DOJ to apparently interfere in the investigation, entered a sweetheart deal with Hunter \u200cBiden, and removed the IRS whistleblowers from the investigation renders him\u2063 incapable of serving as an independent\u200c special counsel. The \u200cregulations themselves so provide, stating that the \u201cindividual named as Special Counsel shall be a lawyer with a reputation for integrity and impartial decisionmaking.\u201d The regulations also provide that the special counsel \u200bshall be selected from\u200d outside the United States government, although there is no\u2063 enforcement mechanism and John Durham was also appointed \u2064special counsel from\u2062 within the government. <\/p>\n<p>So while Garland touted the appointment of a special counsel as providing Americans confidence\u2062 in the\u200b integrity of \u2063the\u200b investigation into Hunter\u2063 Biden, putting Weiss in that role contradicted every assurance of independence he gave.<\/p>\n<h2 class=\"wp-block-heading\">3. Weiss Is Just\u2062 Part of the Problem<\/h2>\n<ol><\/ol>\n<p>Weiss, however, is but part of the problem, as he wasn\u2019t \u2062alone in slow-walking \u2064the investigation: According to the whistleblowers, others \u2062in the office impeded \u200bthe normal investigative techniques, prevented them from interviewing witnesses and executing\u2063 search warrants, kept them from asking pertinent questions, and did many \u2064other things to interfere in \u2063the probe of the president\u2019s son. \u2063Weiss also axed\u2063 the whistleblowers and their \u200belite\u200c team of experts who\u200b specialized in <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/taking-on-china-canada-floats-two-year-ban-on-foreigners-buying-real-estate\/\" title=\"Taking on China? Canada Floats Two-Year Ban on Foreigners Buying Real Estate\">international money laundering<\/a> and \u200dtax evasion investigations,\u2064 likely leaving inexperienced or less experienced agents\u200d in their place. <\/p>\n<p>So Weiss \u200dbeing in charge is but part of the problem: Also concerning is who is still on \u200bhis \u2062team and who isn\u2019t.\u2063 That Weiss \u2063is continuing \u2063to\u200b serve as the \u2064U.S.\u2062 attorney for \u200cDelaware also \u200bsuggests he isn\u2019t intending to \u2062ramp up the investigation. But even if Weiss plans to move forward\u200d with a real investigation, the complexity of the\u200c Biden family \u2064corruption investigation is likely far beyond \u200chis and his local team\u2019s skill \u200dset. <\/p>\n<p>Moreover, even under \u2062the special \u200bcounsel regulations, the bottom line\u2064 is that Weiss still reports to Garland, and Garland\u2019s boss is Joe Biden. Department\u200d regulations, which Garland made clear during Friday\u2019s press conference still \u200capply to the special counsel, also prohibit Weiss from investigating a presidential\u2063 candidate (i.e., Joe Biden) without\u200d permission.\u200c Under these circumstances, even if Weiss has decided \u2064to dust off his reputation, there is no reason to believe he will\u200d be free to\u200d follow the \u2063facts where\u200b they lead \u2014 since \u200cthey likely lead to the Big Guy.<\/p>\n<h2 class=\"wp-block-heading\">4. Impeachment\u2064 Inquiries Are \u200cMore Vital Than Ever<\/h2>\n<ol><\/ol>\n<p>Weiss\u2019s \u2064appointment \u2064as \u2064special counsel \u2063quickly \u2062forced Democrats to change their narrative from \u201cnothing\u2062 to see here\u201d \u2063to\u200b \u201cthis is all about Hunter\u200d Biden and we need to let the process play out.\u201d House Republicans, however, promised\u200c to\u200d push forward \u2062with their investigations and framed \u2064the appointment as a delay tactic and a\u2062 cover-up.<\/p>\n<p>Complaining\u200b won\u2019t\u200b move the needle, however, and \u200cneither will continuing the present \u200cinvestigative trajectory.\u00a0Rather, the clear conflict\u2063 of interest prevents the executive branch, even\u200c under the title of special counsel, from properly investigating\u200d Joe Biden. And \u2063the evidence of the president\u2019s \u200ccomplicity in \u2062his son\u2019s selling \u200cof access overwhelmingly supports an investigation into \u200dhim.\u2062 Further, the scandal isn\u2019t just \u2062about the \u2062Biden \u2064family but about the DOJ \u200cand \u2064FBI and their obstruction of\u200d the investigation. <\/p>\n<p>The House needs to launch an impeachment\u2062 inquiry immediately for Joe Biden, Merrick Garland, and Christopher \u200bWray. There\u2019s a reason the Founding Fathers separated power among the three \u200bbranches of government, and it\u2019s time the legislative branch flexes its impeachment muscle to uncover\u2062 the truth.<\/p>\n<h2 class=\"wp-block-heading\">5. Kudos\u2064 to Judge Maryellen Noreika<\/h2>\n<ol><\/ol>\n<p>Speaking of the three branches of government,\u2063 the \u2062judicial branch and specifically Judge Noreika deserves accolades for her handling of last\u200b month\u2019s plea hearing. If \u200dnot for Noreika, who was <a href=\"https:\/\/www.law360.com\/articles\/1338187\/65-names-to-watch-when-biden-picks-circuit-judges\">rumored<\/a> \u2063 to be on a\u200b short\u2062 list to be named a circuit \u2062court judge by President Biden, \u200dthe Hunter Biden sweetheart plea agreement\u200b might have already been a done deal. <\/p>\n<p>Instead \u2062of rubberstamping\u200c the agreement, however, she quizzed both sides\u200d on some of the puzzling aspects of it, such as why \u200dthe pretrial diversion agreement included the promise of immunity and why she\u200c didn\u2019t\u200c need to approve \u200dthe plea agreement. In doing so, however, she never prejudged the case or \u2064stated her intent; rather,\u200c she asked pointed questions to ensure Hunter Biden \u200dwas getting the deal he\u2063 thought he was, and \u200bthat the \u200cgovernment was proceeding appropriately. <\/p>\n<p>That her questions caused \u2062the plea\u2064 deal\u2063 to blow up suggests there was something amiss, and while the U.S. attorney\u2019s office had no problem trying to \u200cpush through the agreement, Noreika was a \u200bvital check\u200b on the \u2064executive branch. She may be \u2062regretting her approach, though, as she now \u2062has a mare\u2019s \u2063nest, \u2062with Hunter \u200dBiden arguing\u200b the\u200c pretrial\u2063 diversion agreement remains \u2063binding on the government\u2063 and Noreika forced \u2064to \u200dwade through\u200b some legal issues of first\u2064 impression. <\/p>\n<p>Her integrity, however, deserves recognition.<\/p>\n<h2 class=\"wp-block-heading\">6. \u200bA Pox on the \u200dLegacy Press\u2019s House<\/h2>\n<ol><\/ol>\n<p>On the\u2064 other hand, the legacy press, \u2062which ignored the Biden family scandal for the last \u2062three\u200d years, merits ridicule. No\u2064 matter\u2064 how much evidence the House provided, no matter how many whistleblower complaints Grassley revealed,\u200b the corrupt media refused to cover the scandal, other than to spin it as a Republican \u2064hoax. <\/p>\n<p>Even \u200cnow, the press is providing\u200d an assist\u200b to the president and Democrats by spinning the special counsel appointment as \u2064sufficient and the investigation only about Hunter Biden. <\/p>\n<p>Weiss\u2019s appointment is\u2064 not sufficient, \u2062though, although he \u2064may very well be \u2062only investigating Hunter Biden.
