The best in his or her specialty. Or:\u200c B. Meets state \u201cimplicit bias\u201d awareness standards.<\/p>\n<p>Anyone\u2063 with any sense,\u2064 and who wants to live, picks\u2062 choice A\u2014the best doctor.<\/p>\n<p>That\u2019s at the heart of a federal lawsuit by\u2064 two doctors who \u2064are rejecting the \u201cimplicit bias\u201d section of the\u2063 50 hours of continuing education needed every two years to keep a physician\u2019s \u200blicense in California. \u201cThe federal lawsuit\u200c seeks an injunction\u2062 to\u2064 eliminate that \u200crequirement,\u201d <a href=\"https:\/\/www.sfchronicle.com\/health\/article\/doctors-sue-california-medical-board-halt-18260018.php\" target=\"_blank\" rel=\"noopener\">reported<\/a> the San Francisco Chronicle. \u201cThe doctors teach continuing education courses and are suing the state licensing agency that oversees the instruction.\u201d<\/p>\n<\/blockquote>\n<div class=\"shortcode\">\n<div class=\"mb-4 mr-4 w-full max-w-[500px] border border-[#D3D3D3] px-5 py-4 text-[16px] leading-[20px] text-[#262626] md:float-left\">\n<div class=\"mb-3 font-sans text-[16px] font-semibold uppercase leading-[19px] text-[#2F2F2F]\">Related Stories<\/div>\n<ul>\n<li>\n<div class=\"mb-1 line-clamp-2\"><a href=\"http:\/\/www.theepochtimes.com\/us\/doctors-sue-california-over-forced-implicit-bias-dei-training-in-medicine-5441674\">Doctors \u2063Sue California Over Forced &#8216;Implicit Bias&#8217;\u200d DEI Training in Medicine<\/a><\/div>\n<div class=\"text-[14px] leading-[18px] text-[#737373]\">8\/6\/2023<\/div>\n<\/li>\n<li>\n<div class=\"mb-1 line-clamp-2\"><a href=\"http:\/\/www.theepochtimes.com\/us\/white-privilege-nurses-mandated-to-undergo-implicit-bias-training-in-kentucky-5419352\">&#8216;White Privilege&#8217; Nurses Mandated to Undergo &#8216;Implicit Bias&#8217; Training in Kentucky<\/a><\/div>\n<div class=\"text-[14px] leading-[18px] text-[#737373]\">7\/24\/2023<\/div>\n<\/li>\n<\/ul><\/div>\n<\/div>\n<p>At issue is \u2062 <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=201920200AB241\" target=\"_blank\" rel=\"noopener\">Assembly Bill 241<\/a>, signed into law by\u200c Gov. Gavin Newsom in October 2019. In the bill\u2019s words, it would \u201crequire \u2064all continuing\u200c education courses for a physician and surgeon to contain curriculum that includes specified instruction in the understanding of implicit bias\u200b in medical \u200ctreatment.\u201d And, it \u201cwould require associations that accredit \u200cthese continuing \u2062education courses to develop standards to comply with these provisions.\u201d It does the \u2062same \u200cfor registered nurses.<\/p>\n<p>And here\u2019s \u200dhow the bill \u2063defines the term: \u201cImplicit bias, meaning the attitudes or internalized stereotypes that affect our perceptions, actions, and decisions \u2062in an unconscious manner, exists, and often contributes to \u2063unequal treatment of people \u2063based on race, ethnicity,\u200c gender identity, sexual orientation, age, disability, and other characteristics.\u201d<\/p>\n<p>Notice how that\u2019s just a vague jumble of word salad. Is it \u201cimplicit bias\u201d to <a href=\"https:\/\/www.statista.com\/statistics\/1167867\/nba-players-ethnicity\/\" target=\"_blank\" rel=\"noopener\">report<\/a>, as \u2062Statistia does, \u201cThe National Basketball Association\u200b has one of the highest \u200dpercentages of African American players from the big\u200b four professional\u2063 sports leagues \u200cin North America. In 2022, approximately 71.8 percent of NBA players were\u200d African American. Meanwhile, ethnically white players constituted \u2063a 17.4 percent share of all NBA players that year.\u201d<\/p>\n<p>I don\u2019t think\u200c so. (Apu Gomes\/AFP via Getty\u200c Images)<\/figcaption><\/figure>\n<h2>Medical Differences<\/h2>\n<p>In a more direct issue, \u200cthe fact is the races\u2062 and the two sexes (not \u201cgenders,\u201d a grammatical \u2062term) do have some different medical situations. Only women, \u200bdespite the current fad of \u201ctransgenderism,\u201d can get pregnant.<\/p>\n<p>And there are racial differences in diseases. For example, <a href=\"https:\/\/www.cancer.org\/cancer\/types\/melanoma-skin-cancer\/about\/key-statistics.html#:~:text=50%20and%20older.-,Risk%20of%20getting%20melanoma,in%20167)%20for%20Hispanic%20people.\" target=\"_blank\" rel=\"noopener\">according<\/a> to \u2064the American Cancer Society, \u201cMelanoma is more than 20 times\u200c more common in White people\u200b than in\u200c Black\u2063 people. Overall, the lifetime risk of getting melanoma for White people is about 2.6% (or\u200d 1 in 38), 0.1% (1 in 1,000) for Black\u200d people, and 0.6% (1 in 167) for\u200d Hispanic \u2063people.\u201d<\/p>\n<p>The reason is obvious: whites have \u2062less melanin. That\u2019s so they can absorb more\u2062 Vitamin D at the higher latitudes they lived in until recently. By contrast, <a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/16549493\/\" target=\"_blank\" rel=\"noopener\">according<\/a> to \u200dthe Journal \u2064of Nutrition, \u201cVitamin D \u2063insufficiency is more prevalent\u200b among African Americans (blacks) than other Americans \u2062and, in North America, most young, healthy blacks do not achieve \u2064optimal 25-hydroxyvitamin D [25(OH)D] concentrations at any time\u2063 of year. This is primarily\u200c due to the fact that pigmentation reduces vitamin D production in the\u200b skin.\u201d<\/p>\n<p>Now, is it \u201cimplicit bias\u201d \u200bif a doctor is more concerned about a black patient\u2019s potential \u200cvitamin\u2063 D\u2063 deficiency,\u200d than \u2063for \u2062a white patient? In a similar\u200b fashion, is it \u201cimplicit bias\u201d if a doctor \u2063is more\u2062 concerned about a\u2062 white person\u2019s possible melanoma, than for a\u200b black patient?<\/p>\n<p>This only \u2064is going to get\u2063 more\u2063 complex as genetic science advances.\u200b Critical medications and other treatments could be \u200ddeveloped to treat the specific ailments \u2064that strongly occur in one \u200crace more than another. (Mario\u200b Tama\/Getty Images)<\/figcaption><\/figure>\n<h2>What Is \u2018Implicit Bias\u2019?<\/h2>\n<p>The great social writer Heather\u200b Mac\u200b Donald <a href=\"https:\/\/www.wsj.com\/articles\/the-false-science-of-implicit-bias-1507590908\" target=\"_blank\" rel=\"noopener\">described<\/a> \u2064 what \u201cimplicit bias\u201d really is in the Wall Street Journal, \u201cImplicit-bias theory burst onto the academic scene in 1998 with the rollout of an instrument called the\u2063 <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/implicit-bias-is-nothing-but-divisive-junk-science\/\" title=\"\u2018Implicit Bias\u2019 Is Nothing But Divisive Junk Science\">implicit association test<\/a>, the\u2062 brainchild of social psychologists\u202fAnthony Greenwald\u202fand Mahzarin Banaji. A press release trumpeted the IAT as a breakthrough in prejudice studies: \u2018The pervasiveness of prejudice, affecting 90 to 95\u200d percent of people, was demonstrated \u200dtoday &#8230; by psychologists\u200b who developed a new tool that measures the unconscious roots of prejudice.\u2019<\/p>\n<p>\u201cIn the race IAT (there also versions for everything from gender to disability to weight), <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/act-scores-fall-to-lowest-average-in-30-years-due-to-pandemic-era-learning-loss\/\" title=\"ACT Scores Fall to Lowest Average in 30 Years Due to Pandemic-Era Learning Loss\">test-takers<\/a> at a computer are asked to press two keys to sort a series of black and white faces and a set of \u2018good\u2019 and \u2018bad\u2019 words. For part of the exercise, the test-taker presses one key for\u2064 white faces and words like \u2018happy,\u2019 and \u200cthe other key for black faces\u200b and words like \u2018death.\u2019 Then \u2063the protocol \u200bis reversed, pairing white \u200bfaces with \u2018bad\u2019 words and black faces with \u2063\u2018good\u2019 words. (The order is randomized, so some test-takers sort black faces with \u2018good\u2019 words\u2063 first.)\u201d<\/p>\n<p>What \u2063nonsense. It\u2019s fake science.<\/p>\n<h2>Government Indoctrination<\/h2>\n<p>The <a href=\"https:\/\/pacificlegal.org\/wp-content\/uploads\/2023\/08\/2023-08-01-Khatibi-v-Lawson-PLF-complaint.pdf\" target=\"_blank\" rel=\"noopener\">lawsuit<\/a> was \u2063filed by the Pacific \u200cLegal Foundation for plaintiffs Azadeh Khatabi, M.D.,\u200d and \u2064Marilyn M. Singleton, M.D., against the Medical\u2062 Board\u2063 of California. It contends, \u201cUnder the First Amendment to the United States Constitution, the government cannot compel speakers to engage in discussions on subjects \u200cthey prefer to remain \u200dsilent about. Likewise, the government cannot condition\u2062 a\u200b speaker\u2019s ability to \u2063offer courses for credit on the requirement that she espouse the government\u2019s favored view on a controversial topic. This case seeks to\u2062 vindicate those important constitutional rights.\u201d<\/p>\n<p>And, \u201cWhile there is no consensus definition, the concept of \u201cimplicit bias\u201d refers to stereotypical or prejudicial beliefs or \u200battitudes that an individual may unconsciously\u2062 possess toward others,\u2062 which can result in discriminatory actions taken by the implicitly biased individual when those beliefs \u200dor attitudes are activated.<\/p>\n<p>\u201cIn\u2062 the\u200c context of\u2063 healthcare, some people worry that a physician who holds \u200bimplicit bias toward a patient under his or her care \u200bwill render disparately \u200dworse care.<\/p>\n<p>\u201cThere is inconsistent evidence that implicit \u2064bias in healthcare is prevalent and results in disparate treatment outcomes.<\/p>\n<p>\u201cEven assuming sufficient evidence exists\u200d that implicit bias in healthcare is\u200d prevalent and \u2064results in disparate treatment outcomes, there is no evidence-based \u200cconsensus that trainings intended to\u2064 reduce implicit bias \u2063are effective.<\/p>\n<p>\u201cMoreover, evidence shows that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-executive-order-mandates-divisive-unscientific-race-training-at-every-level-of-the-federal-government\/\" title=\"Biden Executive Order Mandates Divisive, Unscientific Race \u2018Training\u2019 At Every Level Of The Federal Government\">implicit bias trainings<\/a> can\u200c cause counterproductive\u2063 anger, frustration, and resentment \u2064among those taking the \u200dtrainings.\u201d<\/p>\n<p>That is, the \u201cimplicit bias\u201d trainings themselves are biased, and increase \u200cbias.<\/p>\n<p>The complaint continues, \u201cBy mandating all <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/lawsuit-rejects-implicit-bias-brainwashing-for-doctors\/\" title=\"Lawsuit opposes 'Implicit Bias' indoctrination of doctors.\">continuing medical education instructors include training<\/a> on implicit bias even\u2063 though evidence-based \u2064criteria ensuring the trainings \u200care\u200c effective\u2064 does not exist,\u2062 [the law] \u200cis unlikely to address the problem of implicit bias in healthcare, if any.\u201d<\/p>\n<figure style=\"width:640px\" class=\"aligncenter\"><figcaption>Healthcare workers at St. Joseph Hospital in Orange, Calif., on Dec. 16, \u20622020.
