Henderson\/Getty \u200bImages)<\/figcaption><\/figure>\n<h2>Oher Claims He Was Never Legally \u2064Adopted \u2063by &#8220;The\u2064 Blind Side&#8221; Family<\/h2>\n<p>OAN\u2019s <a href=\"https:\/\/www.oann.com\/tag\/noah-herring\">Noah Herring<\/a><br \/>1:13\u200d PM \u2013\u200d Monday, August 14, 2023<\/p>\n<p>Retired NFL player Michael Oher, whose supposed adoption out of poverty inspired the 2009 movie, \u201cThe Blind Side,\u201d petitioned a Tennessee court on \u2062Monday \u2063claiming that the family \u200dnever legally adopted\u200c him \u200cand lied about their status for profit. <\/p>\n<div id=\"div-gpt-ad-1663871513696-art-1\" style=\"min-width: 320px; min-height: 50px;  text-align: center;\">  \t<script>  \t\tgoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1663871513696-art-1'); });  \t<\/script>  <\/div>\n<div class=\"ad-slot__ad-label\">Advertisement<\/div>\n<\/p>\n<p>The\u200b 14-page petition, which was\u200d filed\u200c in Shelby County, Tennessee,\u200d probate court, alleges that Sean \u2063and Leigh Tuohy, who accepted Oher into their home as a\u200d <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-education-sec-on-womens-school-sports-we-have-a-legal-responsibility-to-include-transgender-athletes\/\" title=\"Biden Education Sec On Women\u2019s School Sports: We Have a \u2018Legal Responsibility\u2019 to Include Transgender Athletes\">high school student<\/a>, had never adopted him. <\/p>\n<p>Oher\u2063 claims that the couple tricked him into signing a document\u200c making them his conservators, which gave them legal authority to make business deals in his name. <\/p>\n<p>The petition also alleged that the Tuohys \u2062used their power as conservators to strike\u2063 a movie \u2064deal\u200d that paid them and their two birth children millions of dollars in royalties, \u2062while Oher got nothing for a story &#8220;that would not have\u200b existed\u200d without him.&#8221;<\/p>\n<p>Since\u200c the movie, the Tuohys have continued\u2064 calling \u200cthe 37-year-old their adopted son \u200band have used that label to\u2064 promote their own\u2063 personal \u2063foundation.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>&#8220;The lie of Michael&#8217;s adoption is one upon\u2063 which co-Conservators Leigh Anne Tuohy and Sean Tuohy have\u200c enriched themselves at the expense\u200d of their\u2062 Ward, the undersigned Michael Oher,&#8221; \u200dthe legal filing says. &#8220;Michael \u200cOher \u200bdiscovered this lie\u2063 to his \u2062chagrin and embarrassment\u200b in February \u2062of 2023, when he learned that the Conservatorship to which he consented on the basis that\u200c doing \u200bso would make him\u200c a \u2062member of the Tuohy family, in fact provided\u200b him no familial relationship with \u2062the Tuohys.&#8221;<\/p>\n<\/blockquote>\n<p>Oher\u2019s petition asked the court to end the Tuohy\u2019s\u200c conservatorship and to issue an injunction banning them from using his name and likeness. It also seeks\u200d full accounting on the money gained off of Oher\u2019s name\u2063 to have the couple pay \u200bhim\u2063 his \u2062fair share of\u200b profits.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>&#8220;Since at least August\u2064 of\u2062 2004, Conservators have allowed\u2062 Michael,\u200b specifically,\u200d and the \u2062public, generally, to believe that Conservators adopted Michael and have used that untruth to gain financial advantages for themselves and the foundations which they own or which \u2062they exercise control,&#8221; \u2063the petition \u200bsays. \u2064&#8221;All monies \u2064made in said manner\u200d should in all conscience and \u200cequity be \u2062disgorged and \u200cpaid over to the said ward, \u200cMichael \u2064Oher.&#8221;<\/p>\n<\/blockquote>\n<p>Oher was a senior in\u2062 high school \u2062when he signed the conservatorship papers. <\/p>\n<blockquote class=\"wp-block-quote\">\n<p>&#8220;They explained \u2064to me that it means pretty much the exact same thing as &#8216;adoptive parents,&#8217; but that the laws were just written \u2063in a way that took my age into account,&#8221;\u200c Oher\u2063 wrote in his 2011\u2062 best-selling memoir &#8220;I\u200c Beat the Odds.&#8221;<\/p>\n<\/blockquote>\n<p>There\u2063 are \u200cimportant legal \u2063distinctions between adoption and conservatorship. If Oher had been adopted,\u200b he would have been a legal member of\u200d the\u200d family and would have retained the power to handle his own financial\u2062 affairs. Under the conservatorship, Oher surrendered the authority \u2063to the \u2063Tuohys, even as a legal adult with \u2062no serious\u200d disabilities. <\/p>\n<p>According to the legal\u2062 filing,\u2062 the movie paid the Tuohys and their two \u2064birth children at least $225,000, plus 2.5% of the film\u2019s &#8220;defined net proceeds.&#8221; While the\u200b deal allowed \u200cthe family to \u2062profit from the film, the petition claims that a\u200b <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/michael-oher-from-blind-side-claims-tuohys-never-adopted-him-made-millions\/\" title=\"Michael Oher, of 'Blind Side' fame, says Tuohys never adopted him, earned millions.\">separate 2007 contract purportedly signed<\/a> by Oher appeared to\u2063 &#8220;give away&#8221; the rights \u200cto his story to 20<sup>th<\/sup> Century Fox &#8220;without any payment whatsoever.&#8221;<\/p>\n<p>Oher claims that he had no recollection \u2063of signing that contract, and even if he did, he claims nobody explained the implications. <\/p>\n<p>In the past, the Tuohy family maintained\u200b that they did not make much from the movie, \u2063claiming they received a &#8220;flat fee&#8221; for the \u200cstory. They also said that whatever money they earned was shared with Oher. <\/p>\n<blockquote class=\"wp-block-quote\">\n<p>&#8220;We\u200d divided it\u200c five ways,&#8221; the\u2062 Tuohys wrote in their 2010 book, &#8220;In a Heartbeat: Sharing the Power of Cheerful Giving.&#8221;<\/p>\n<\/blockquote>\n<p>The petition\u200c from Oher exemplifies \u2064a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/10-more-movies-that-snuck-conservative-themes-on-screen\/\" title=\"10 More Movies That Snuck Conservative Themes On Screen\">major plot twist<\/a> in what had previously\u200c been an inspiring, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/never-forget-rush-limbaughs-last-true-story-of-thanksgiving\/\" title=\"Never Forget: Rush Limbaugh's Last 'True Story of Thanksgiving'\">feel-good story<\/a>. <\/p>\n<blockquote class=\"wp-block-quote\">\n<p>&#8220;Mike&#8217;s relationship with the Tuohy family started to \u2062decline when he discovered that he was portrayed\u200c in\u200c the movie as\u200d unintelligent,&#8221; Oher\u2019s attorney J. Gerard Stranch IV said. &#8220;Their relationship continued to deteriorate as he\u2063 learned that he was \u200cthe only member of the\u2063 family not receiving \u2063royalty checks from \u2062the movie, and it was \u2064permanently fractured\u2064 when he realized he wasn&#8217;t adopted and a part of the family.&#8221;<\/p>\n<\/blockquote>\n<p>Stay informed!
