Harvard that \u2064 <a href=\"https:\/\/www.theepochtimes.com\/us\/supreme-court-strikes-down-affirmative-action-policies-at-us-colleges-5363356\" target=\"_blank\" rel=\"noopener\">race-based affirmative action<\/a> at colleges \u2062and \u2062universities is unconstitutional. \u200cPresident\u2062 Biden was quick to register his\u2064 disagreement with the court&#8217;s\u2063 decision.<\/p>\n<p>On Monday, Associate Attorney General Vanita Gupta\u200d announced the Department of Justice and Department of Education would begin \u2062circulating a cover\u2064 letter\u200c and Q&#038;A document (<a href=\"https:\/\/www.ntd.com\/assets\/uploads\/2023\/08\/id936309-post-sffa_resource_faq_final_508.pdf\" target=\"_blank\" rel=\"noopener\">pdf<\/a>) that instructs institutions of higher education on how they can still factor \u200crace into their <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/medical-professor-warned-colleagues-that-schools-racial-preferences-were-illegal-and-he-was-removed-from-directorship-now-hes-suing\/\" title=\"Medical Professor Warned Colleagues That School\u2019s Racial Preferences Were Illegal And He Was Removed From Directorship. Harvard bans colleges and universities from using an applicant&#8217;s race as a direct factor\u2062 in their admissions policies, the new DOJ-DOE \u2062guidance describes certain scenarios \u2064where an applicant&#8217;s racial or ethnic background could still come up.<\/p>\n<h2>Federal Guidance<\/h2>\n<p>The Q&#038;A document \u200dstates that &#8220;universities may continue to embrace \u200bappropriate considerations \u200bthrough holistic application-review processes \u2063and (for example) provide opportunities to assess \u2062how applicants\u2019\u200d individual backgrounds and attributes\u2014including those related to their race, experiences \u200cof racial discrimination, or the racial composition of their neighborhoods \u200dand schools\u2014position them \u2064to contribute to campus in unique ways.&#8221;<\/p>\n<p>The guidance document described specific permissible admissions scenarios,\u200b such as\u200d a university considering an application that describes\u2063 what it meant for \u2063the \u2063applicant &#8220;to become the first black violinist in their city&#8217;s youth orchestra,&#8221; or &#8220;how an \u2063applicant conquered her feelings of \u200disolation as a\u200d Latina student at \u2064an overwhelmingly white <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/despite-insistence-by-democrat-politicians-and-medical-elites-empirical-evidence-does-not-conclusively-show-that-masks-reduce-the-spread-of-covid\/\" title=\"Despite Insistence by Democrat Politicians and Medical Elites, Empirical Evidence DOES NOT Conclusively Show that Masks Reduce the Spread of COVID\">high school<\/a> to join the debate\u200b team.&#8221;<\/p>\n<div class=\"shortcode\">\n<div class=\"lazyload-wrapper\">\n<div class=\"lazyload-placeholder\"><\/div>\n<\/p><\/div>\n<\/p><\/div>\n<p>The DOJ-DOE\u200c document further stated that\u200b colleges and\u2063 universities may use admissions practices that consider\u200c &#8220;the full range of\u2062 circumstances a student has faced in achieving their accomplishments, including financial \u2062means and broader socioeconomic\u2063 status; information about the applicant\u2019s\u200b neighborhood and \u200chigh school; and experiences of adversity, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/lawmakers-call-for-investigation-into-federally-funded-critical-race-theory-program\/\" title=\"Lawmakers Call for Investigation Into Federally-Funded Critical Race Theory Program\">including racial discrimination<\/a>.&#8221;<\/p>\n<p>The DOJ-DOE \u200bdocument also states that the Supreme Court decision &#8220;does not require institutions to ignore race&#8221; in their recruiting and outreach programs, &#8220;provided that\u2062 their outreach and recruitment programs \u2063do not provide targeted groups of prospective students preference in \u2064the admissions process, and provided that all students\u2014whether part of a specifically \u200ctargeted group or not\u2014enjoy the same\u2063 opportunity\u200d to \u200capply and compete \u200bfor admission.&#8221;<\/p>\n<p>The document \u200bgoes so far as to say \u200dcolleges and universities &#8220;may\u200d direct\u2062 outreach and recruitment efforts toward schools and school districts that serve predominantly students of color and\u2064 students of limited financial\u200c means.&#8221;<\/p>\n<h2>SFFA Watching for Racial &#8216;Proxies&#8217;<\/h2>\n<p>While the DOJ-DOE\u2062 document describes ways that colleges and universities can indirectly factor in race and ethnicity\u200b in their admissions \u2062programs, \u2063opponents of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-admin-releases-diversity-guidance-for-colleges-after-supreme-courts-affirmative-action-ruling\/\" title=\"Biden Admin issues diversity guidelines for colleges post-Affirmative Action ruling.\">past race-based affirmative action programs<\/a>\u200b may continue to challenge these\u2062 new methods.<\/p>\n<p>&#8220;The administrators of higher \u2062education must note: The\u2064 law will not tolerate direct proxies for racial\u2063 classifications,&#8221; SFFA founder\u200b and president Edward Blum \u200bsaid on June<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Joe Biden&#8217;s administration is issuing fresh guidelines on how colleges can foster diversity following a Supreme Court ruling against race-based affirmative action.
