The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/hunter-bidens-lawyers-claim-deal-to-resolve-felony-gun-charge-was-binding\/\" title=\"Hunter Biden's attorneys assert that the agreement to settle the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/victims-blame-soros-backed-prosecutors-for-crime-wave-in-u-s-cities\/\" title=\"Victims Blame Soros-Backed Prosecutors for Crime Wave in U.S. Cities\">felony gun charge<\/a> was legally binding.&#8221;>federal judge tasked<\/a> both\u2064 sides with reworking their arrangement.<\/p>\n<p>Attorney General Merrick\u2062 Garland announced on Friday that Weiss\u2062 had been <a href=\"https:\/\/www.justice.gov\/opa\/pr\/appointment-special-counsel-2\">appointed special counsel<\/a> in \u200cthe \u200binvestigation of Biden, a designation that gives\u200c the prosecutor broader authority to \u200cbring charges in districts outside of his own.<\/p>\n<p>On that same day, Weiss <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ded.82797\/gov.uscourts.ded.82797.25.0.pdf\">said\u2064 in a motion<\/a> that the two sides were at an \u201cimpasse\u201d and asked the court to vacate a briefing order \u201csince there is no longer a plea agreement or diversion agreement for the Court to \u200cconsider.\u201d<\/p>\n<p><b data-stringify-type=\"bold\"><\/b><\/p>\n<p>Biden, 53, pleaded not guilty to the\u2062 tax charges in Delaware,\u2063 but Weiss made a separate filing on Friday seeking\u200d to\u2062 dismiss the information and <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ded.82801\/gov.uscourts.ded.82801.31.0.pdf\">indicating<\/a> that he intended to take the\u2064 tax case to trial in the \u200dCentral District of California or in\u200d the District of Columbia \u2014 venues for the alleged offenses\u2063 \u2014 because plea negotiations had hit a roadblock.<\/p>\n<p>One of Biden\u2019s lawyers, Abbe Lowell, said on CBS News\u2019s \u200b\u201cFace the Nation\u201d on \u200bSunday that a trial was <a href=\"https:\/\/www.cbsnews.com\/news\/face-the-nation-full-transcript-08-13-2023\/\">\u201cnot inevitable.\u201d<\/a><\/p>\n<p>As for the\u2064 felony gun charge, with\u2064 which Biden was accused\u200c of knowingly possessing a firearm while\u200b being an <a href=\"https:\/\/www.justice.gov\/usao-de\/pr\/tax-and-firearm-charges-filed-against-robert-hunter-biden\">\u201cunlawful\u201d drug user<\/a> in \u200b2018,\u2063 his lawyers insisted in their Sunday filing they \u201chave a valid and binding bilateral \u200dDiversion Agreement.\u201d<\/p>\n<p>Biden\u2019s \u201cunderstanding of the scope of immunity agreed to by the United States was and is based on the express written terms of \u2062the Diversion Agreement,\u201d the lawyers added. \u201cHis understanding of the scope \u2063of\u2063 immunity agreed to by\u200b the United States is also corroborated by prosecutors\u2019 contemporaneous\u2064 written and oral communications during the plea negotiations.\u201d<\/p>\n<p>In an \u2062order on Monday, the judge instructed Weiss to <a href=\"https:\/\/twitter.com\/ProfMJCleveland\/status\/1691128747762884608\">file a response<\/a> to\u2063 Biden\u2019s lawyers by \u200cnoon on Tuesday.<\/p>\n<p>If Biden is found guilty of the felony gun charge, the Department of\u200b Justice <a href=\"https:\/\/www.justice.gov\/usao-de\/pr\/tax-and-firearm-charges-filed-against-robert-hunter-biden\">said<\/a> the maximum penalty is ten years in prison.
