Additionally, he and the prosecutors had reached a \u200b<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/justice-department-charges-hunter-biden\/\" title=\"Justice Department charges Hunter Biden\">pretrial diversion agreement<\/a> for a felony gun charge.<\/p>\n<p>During the first hearing after the announcement of the \u2064deals, U.S. District \u2064Judge Maryellen Noreika expressed concerns about certain details. She discovered\u2062 that the diversion agreement included a promise from prosecutors \u200cnot to pursue the gun \u200dcharge, as\u2063 well as other charges related \u200dto the tax issues beyond the\u200d two\u200c counts already brought forward.<\/p>\n<p>&#8220;Have you ever seen a Diversion Agreement where the agreement not to prosecute is so broad that it encompasses crimes in a different case?&#8221; Judge Noreika asked the prosecutors.<\/p>\n<p>&#8220;No,&#8221; answered Leo Wise, one of the prosecutors.<\/p>\n<p>Subsequently, the parties disagreed on the interpretation of the details, leading one of Mr. Biden&#8217;s\u2064 attorneys to declare the plea agreement null and void, resulting in Mr. Biden pleading \u200bnot guilty.<\/p>\n<p>&#8220;The possibilities are only, one, they wrote something and weren&#8217;t clear what they meant. Two, they knew what they meant, and misstated it\u200b to\u2063 counsel. Or third, they changed their view as they were standing in court\u2063 in\u200c Delaware,&#8221; said Abbe \u2063Lowell, one of the lawyers representing Mr.\u2063 Biden, \u2062during\u200c an interview on CBS&#8217; &#8220;<a href=\"https:\/\/www.cbsnews.com\/news\/abbe-lowell-hunter-biden-attorney-transcript-face-the-nation-08-13-2023\/?intcid=CNI-00-10aaa3b\" target=\"_blank\" rel=\"noopener\">Face the Nation<\/a>&#8221; on Sunday.<\/p>\n<p>Prosecutors later revealed that attempts to negotiate an updated agreement for the tax charges \u2064had\u200b failed, leading to the likelihood of a trial.<\/p>\n<p>&#8220;The \u2064immunity\u2063 that would have been granted would be broad immunity,&#8221; Mr. Lowell stated.<\/p>\n<p>While Mr. Biden&#8217;s lawyers acknowledged that a briefing \u200dto the judge was unnecessary given the circumstances, Mr. Lowell suggested that a newly crafted agreement could still be a possibility to avoid a trial.<\/p>\n<p>&#8220;We were trying\u2064 to avoid one all along. And so were the prosecutors who came forward to us, and were the ones to say, &#8216;can there\u2063 be \u2064a \u2062resolution short of a prosecution?&#8217; So\u200d they\u2064 wanted \u200dit and maybe they still do want it,&#8221; Mr. Lowell explained.<\/p>\n<p>The two counts Mr. Biden\u200d faces are misdemeanors,\u2064 each carrying a maximum \u2063prison \u2062term of one year upon conviction.<\/p>\n<p>Prosecutors\u2064 have indicated that the diversion agreement \u2063is separate \u200bfrom the plea deal and remains in \u200beffect.
