On July 4, a lower\u2063 court had ordered \u2064the Biden administration to\u2062 cease what\u2064 it called \u201carguably \u2026 the most massive attack against\u200d free speech \u200cin United States\u2019 history.\u201d The Fifth \u200dCircuit\u2063 paused that injunction on \u200bJuly 14\u2062 and heard <a href=\"https:\/\/www.ca5.uscourts.gov\/OralArgRecordings\/23\/23-30445_8-10-2023.mp3\" target=\"_blank\" rel=\"noreferrer noopener\">oral arguments<\/a> against it on Aug. 10 in <em>Missouri v. Here are some key takeaways from Thursday\u2019s oral arguments\u2063 and earlier revelations from this massive \u2064First Amendment case.<\/p>\n<h2 class=\"wp-block-heading\">1. By the Government\u2019s Own\u2062 Definition, It\u2019s Censoring<\/h2>\n<p>Key to Thursday\u2019s arguments was the question \u200bof coercion: Did government demands of\u200c internet monopolies equal\u2064 coercion, or were those merely officials advocating for\u200d their views?<\/p>\n<p>\u201cIf \u2063the government was doing something like that in \u2063a coercive manner, \u2064then that could \u200bbe the subject of a proper injunction,\u201d Department of Justice lawyer Daniel Bentele\u200d Hahs Tenny told the court in his opening remarks. \u201cThe problem is that what you would \u2064have to do is\u2062 say, \u2018Here is what the government is doing that\u2019s coercive, and I\u2019m \u2062enjoining that.&#8217;\u201d<\/p>\n<div class=\"fdrlst__b89e9-9686d671dc704f0a8ef64fb510e9ff01 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-9686d671dc704f0a8ef64fb510e9ff01\"><\/div>\n<p>Judge Don Willett responded: \u201cHow do you define coercive?\u201d<\/p>\n<p>Tenny: \u201cI don\u2019t think there\u2019s too much disagreement on\u2063 this point. Coercive is where a reasonable person would construe it to be backed \u200dby a threat of government action against a party \u200bif it didn\u2019t comply.\u201d<\/p>\n<p>That\u2019s \u2064exactly what the government did, the voluminous documents already discovered in \u2064this case show. I \u2064want an\u200c answer on what happened here and I want it today.\u201d <\/p>\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-large is-resized\"><\/figure>\n<\/div>\n<p>\u201cWhat appears \u200cto be in the record are these irate messages from\u2064 time to\u2062 time from <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/you-are-our-champion-novak-djokovic-gets-heros-welcome-in-serbia\/\" title=\"'You Are Our Champion': Novak Djokovic Gets Hero\u2019s Welcome in Serbia\">high-ranking government officials<\/a> \u2063that say, \u201cYou didn\u2019t do this yet,\u2019\u201d Judge Jennifer Walker Elrod told \u200cTenny. \u201cAnd \u200dthat\u2019s my toning down the \u200clanguage. \u2026 So it\u2019s like, \u2018Jump!\u2019 and, \u2018How\u200d high?\u2019\u201d<\/p>\n<p>The judges also noted the\u2063 White House publicly threatened the\u200d business model of all online communications monopolies through\u2064 <a href=\"https:\/\/ti-nyurl.com\/73hnfk3h\" target=\"_blank\" rel=\"noreferrer noopener\">potentially\u2062 revoking Section \u200b230<\/a> and launching antitrust lawsuits. The lawsuit documentation\u2064 shows leading Democrats\u200c making the same public threats, including \u200bHouse Speaker Nancy Pelosi and multiple U.S. \u2063senators. \u2062 <\/p>\n<p>Joe Biden even <a href=\"https:\/\/www.nytimes.com\/interactive\/2020\/01\/17\/opinion\/joe-biden-nytimes-interview.html\" target=\"_blank\" rel=\"noreferrer noopener\">threatened<\/a><a href=\"https:\/\/judiciary.house.gov\/sites\/evo-subsites\/republicans-judiciary.house.gov\/files\/evo-media-document\/schmitt-testimony.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"> <\/a>to hold Zuckerberg criminally liable for not running Facebook the way Biden wanted. So government control of public discourse will continue even if the Fifth Circuit reinstates the injunction.<\/p>\n<p>Tenny told the Fifth Circuit the Covid-era censorship \u2064that ignited this case \u2062is over because the government currently deems \u2062Covid\u200c not an emergency. In court, Sauer cited YouTube banning two weeks ago\u200b a video of \u2064attorneys\u200d discussing \u200bthis case as more proof \u200dthis massive \u200ccensorship persists. He also cited court documents showing Americans \u200dstill can\u2019t post social media messages \u2064about \u200ccensored\u200c topics.<\/p>\n<p>\u201cAttorneys present gave estimates ranging from a few weeks to two months for the panel to rule\u201d on whether to reinstate an injunction against more of this\u200d government behavior, reported Taibbi, who attended the oral arguments in New Orleans, Louisiana.
