And\u2063 that refusal was based on her unsupported \u200cand subjective belief regarding the Board\u2019s motive for\u200b the investigation,&#8221; Kimberly Lee, a state official, said in\u200c <a href=\"https:\/\/www.documentcloud.org\/documents\/23908010-dr-tenpenny-suspension-order\" target=\"_blank\" rel=\"noopener\">the suspension order<\/a>.<\/p>\n<p>&#8220;Licensees of the Board\u200b cannot simply\u2064 refuse to cooperate in investigations because\u2063 they\u200b decide they do\u2063 not like what they assume is the reason for the investigation,&#8221; Ms. Lee added.<\/p>\n<\/blockquote>\n<p>According to state\u2062 law, medical professionals can be disciplined by the board for &#8220;failure to\u200b cooperate in an investigation conducted by the board.&#8221;<\/p>\n<div class=\"shortcode\">\n<div class=\"lazyload-wrapper\">\n<div class=\"lazyload-placeholder\"><\/div>\n<\/p><\/div>\n<\/p><\/div>\n<p>Dr. Tenpenny, in \u2063 <a href=\"https:\/\/rumble.com\/v36ntkg-dr.-sherri-tenpenny-show-me-the-health-freedom-doctor-and-the-medical-board.html\" target=\"_blank\" rel=\"noopener\">a video statement<\/a> following the suspension, \u200dclaimed that she had indeed cooperated with the board.<\/p>\n<p>&#8220;We cooperated at\u200d every level. \u200dWe carefully reviewed\u200d the letters, provided appropriate \u2063and legal responses,&#8221;\u200b Dr. Tenpenny stated.<\/p>\n<p>&#8220;My lawyers &#8230; drafted \u2062responses appropriately, and sent them back. However, the board\u2063 claimed that we did \u200cnot cooperate. It seems they simply did not like our answers. But\u200c that does not mean we failed to\u200d cooperate,&#8221; she added.<\/p>\n<p>Dr. Tenpenny, a \u200cgraduate of Kirksville College of Osteopathic\u2062 Medicine, has been practicing medicine since 1984. (Courtesy \u200dof Sherri Tenpenny)<\/figcaption><\/figure>\n<\/p><\/div>\n<h2>Testimony Sparks\u2064 Investigation<\/h2>\n<p>The medical board initiated an investigation into Dr. Tenpenny following approximately \u2063350 complaints received after her testimony \u2062to the Ohio House of Representatives Health Committee in June\u2063 2021. During her testimony, she <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/mtg-says-she-got-a-terrifying-message-after-her-tv-turned-on-by-itself\/\" title=\"MTG claims receiving a scary message after her TV mysteriously turned on.\">made controversial claims<\/a> that the\u2064 COVID-19 vaccines \u2064were causing people to become magnetized.<\/p>\n<p>&#8220;They\u200d can put a key\u200d on their forehead and it sticks,&#8221;\u2062 Dr. Tenpenny asserted at the \u200btime.<\/p>\n<p>She also expressed concerns about side effects, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/cdc-director-who-said-vaccinated-cant-catch-covid-catches-covid\/\" title=\"CDC Director Who Said Vaccinated Can't Catch COVID Catches COVID\">including heart inflammation<\/a>, which U.S. officials have since acknowledged as potential risks associated with\u200d the vaccines.<\/p>\n<p>The board&#8217;s investigation focused on whether\u200d Dr. \u200cTenpenny violated the state&#8217;s Medical \u200dPractices Act.<\/p>\n<p>According to \u200dthe law, the board is obligated \u2064to investigate any evidence suggesting a violation of the act, including making\u2064 false or\u2062 misleading statements related to the practice of\u2063 medicine.<\/p>\n<p>Board attorney Marcie Pastrick \u200bstated\u2063 that the complaints made against\u200b Dr. Tenpenny \u200calleged violations of \u200bthe law, if proven true.<\/p>\n<p>Ultimately, the suspension was imposed due to Dr. Tenpenny&#8217;s alleged refusal to cooperate, \u200crather than the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/evan-rachel-wood-accuses-marilyn-manson-of-raping-her-on-music-video-set\/\" title=\"Evan Rachel Wood Accuses Marilyn Manson of Raping Her on Music Video Set\">specific allegations made<\/a> against her.<\/p>\n<p>Thomas Renz,\u200d a lawyer representing Dr. \u200dTenpenny, argued that she declined to cooperate\u200c with what he described as &#8220;the board\u2019s\u2062 bad faith and unjustified \u200bassault on her licensure, livelihood, and constitutional rights.&#8221; He emphasized that \u2064her testimony was based\u200b on \u2062&#8221;factual reports by third parties,&#8221;\u2063 <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/medical-board-suspends-license-of-doctor-critical-of-covid-19-vaccines\/\" title=\"Doctor's license suspended for criticizing COVID-19 vaccines.\">including peer-reviewed studies<\/a>.<\/p>\n<p>Dr. Tenpenny later contended that the board was investigating her \u2064without any evidence of a violation of state law.
