In 2022, the\u200b state made \u200dit illegal for anyone to provide or assist \u2063in an abortion, \u200cwhile exempting \u200dthe woman who had the procedure from prosecution.<\/p>\n<p>In a challenge filed \u200cby the state attorney general&#8217;s office in March, they argued in favor of dismissing the case, stating, \u200c&#8221;Just\u200b because several statutes \u2062define an individual\u200b to include an unborn child does not mean that \u2062the Fourteenth Amendment does the same.&#8221;<\/p>\n<p>Furthermore,\u2062 their argument revolves around the timing \u2064of Issa&#8217;s loss,\u2064 which occurred\u200c before \u200dthe overturning of Roe\u2063 v.\u200d Wade.<\/p>\n<p>Last week, the judge \u200coverseeing the case denied the state&#8217;s motion\u200b to dismiss, allowing\u200c Issa&#8217;s lawsuit to proceed.
