Doctors informed her that immediate surgery\u2064 was necessary as they were unable to detect a fetal heartbeat. Tragically, her child was delivered stillborn.<\/p>\n<p>Issa filed \u200bher lawsuit in 2021, \u200dseeking monetary \u200bdamages for\u2063 medical bills\u200c and funeral \u2064expenses for her unborn child. However, she has faced opposition from the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/cuomo-must-resign-if-cover-up-of-nursing-home-deaths-proven-stefanik\/\" title=\"Cuomo Must Resign If \u2018Cover-Up\u2019 of Nursing Home Deaths Proven: Stefanik\">state attorney general&#8217;<\/a>s office,\u200c which has \u2062requested the case be dismissed.<\/p>\n<p>Texas is known for\u2064 having some of\u2063 the most \u200b<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/texas-judge-says-abortion-ban-too-restrictive-and-must-allow-exceptions\/\" title=\"Texas judge deems abortion ban excessively strict, mandates inclusion of exceptions.\">restrictive \u2062abortion laws<\/a> in the country.\u2062 In 2022, the state made it illegal for anyone to provide or assist\u200b in an \u200babortion, while exempting the \u2064woman \u2064who had \u2063the procedure from prosecution.<\/p>\n<p>In a challenge \u2063filed \u200dby the\u2062 state attorney\u200d general&#8217;s office in March, they argued in\u200d favor of dismissing the case, stating, &#8220;Just because several \u200cstatutes define an \u2063individual to include an unborn child does not mean that the Fourteenth Amendment does the \u200dsame.&#8221;<\/p>\n<p>Furthermore,\u2063 their argument \u2062revolves around\u2064 the timing of Issa&#8217;s loss, which occurred before the overturning \u200bof Roe v.\u2062 Wade.<\/p>\n<p>Last week, the\u2063 judge overseeing \u2063the case denied the state&#8217;s motion\u200c to dismiss, allowing Issa&#8217;s \u200clawsuit to proceed.
