Race-Based\u200b Hiring Practices Dismissed by Judge<\/h2>\n<p>A judge in Washington state has\u200d ruled against a conservative\u200c group \u2064that \u200csued Starbucks over the \u2063coffee chain&#8217;s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/nations-largest-public-university-hit-with-class-action-suit-over-race-based-hiring-practices\/\" title=\"Nation\u2019s Largest Public University Hit With Class Action Suit Over Race-Based Hiring Practices\">race-based hiring practices<\/a> that \u2063allegedly &#8220;flagrantly&#8221; violate various state and \u200dfederal laws.<\/p>\n<p>Chief U.S. District Judge Stanley Bastian\u2063 on \u2063Friday ruled against the National Center for Public Policy Research (NCPPR), dismissing \u200da lawsuit the conservative nonprofit \u200dbrought against Starbucks over so-called &#8220;affirmative action&#8221; NCPPR wrote in \u2062the complaint.<\/p>\n<p>&#8220;The \u200bindividual Defendants took these actions despite knowing of a glaring, inconvenient fact: the policies they\u2062 so trumpeted flagrantly violate \u200ca \u200bwide array of state \u2063and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-justice-department-pick-helped-kill-pipeline-favored-by-key-senator\/\" title=\"Biden Justice Department Pick Helped Kill Pipeline Favored by Key Senator\">federal civil rights laws<\/a>,&#8221; the group continued.<\/p>\n<p>The Starbucks policies\u2063 that are the subject of the lawsuit include \u2064the \u200cgoal\u2063 of at least\u200c 30 percent\u200c of its U.S. corporate workforce \u200bbeing black, indigenous, or people of color by 2025 while pegging executive pay to workforce diversity\u2063 quotas.<\/p>\n<\/blockquote>\n<div class=\"shortcode\">\n<div class=\"lazyload-wrapper\">\n<div class=\"lazyload-placeholder\"><\/div>\n<\/p><\/div>\n<\/div>\n<h2>More Details<\/h2>\n<p>Before \u2063filing its \u200clawsuit, the group,\u200b which holds around $6,000\u2064 worth of Starbucks shares, warned\u2063 Starbucks that its race-based policies were illegal and that their adoption \u2062posed \u2063a litigation risk for other Starbucks shareholders. NCPPR asked Starbucks to take action to address these risks and publicly \u200dretract the policies.<\/p>\n<p>Starbucks responded in July\u2063 2022 that \u200dit would &#8220;take no\u2063 relevant action to correct \u2062course and reduce\u200b the exposure they had created \u2063for it and its shareholders,&#8221;\u2063 per the NCPPR complaint,\u200b prompting the group to sue.<\/p>\n<p>In its complaint, NCPPR alleged \u200dthat, by failing to rescind the policies in question, Starbucks endangered the interests of all its shareholders and violated their fiduciary obligations.<\/p>\n<p>&#8220;Why do they do so? \u200cBecause\u2063 it\u2062 benefits \u2062them personally to pose as \u2063virtuous\u2063 advocates of &#8216;Inclusion, Diversity, and Equity,&#8217; even if it harms the company and its owners\u2014a classic\u2063 example of (admittedly non-pecuniary) self-dealing,&#8221; the group alleged \u2062in\u2062 the complaint.<\/p>\n<p>However, Judge Bastian rejected\u200d these allegations and on Aug. 11 dismissed\u200b the case with prejudice, according to a court filing (<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.waed.101253\/gov.uscourts.waed.101253.33.0.pdf\" target=\"_blank\" rel=\"noopener\">pdf<\/a>), meaning\u200b that NCPPR\u200c is barred\u200c from refiling the lawsuit.<\/p>\n<p>The judge said that the lawsuit centered on public policy questions that are \u200cfor lawmakers and corporations to decide, not the courts.<\/p>\n<p>&#8220;If\u200c the plaintiff doesn&#8217;t \u200cwant to be\u2064 invested in &#8216;woke&#8217; corporate America, perhaps it should \u2062seek\u2064 other investment opportunities rather than\u2063 wasting this court&#8217;s time,&#8221; \u200cthe judge said.<\/p>\n<p>Starbucks \u2064said it was pleased with the decision and said it remains committed to &#8220;creating a\u200b culture of\u2063 warmth and belonging.&#8221;<\/p>\n<p>NCPPR spokesperson Scott Shepard\u2062 called the judge&#8217;s comments &#8220;surprising and disappointing.&#8221;<\/p>\n<p>&#8220;We will continue to pursue relief \u200dfrom illegal discrimination on behalf of shareholders\u200c and employees,&#8221; he said.<\/p>\n<p>In\u2063 a statement one day before the unfavorable \u200cruling, NCPPR expressed hope that, in light of the\u2064 recent \u200d <a href=\"https:\/\/www.theepochtimes.com\/us\/supreme-court-strikes-down-affirmative-action-policies-at-us-colleges-5363356\" target=\"_blank\" rel=\"noopener\">landmark\u200b Supreme Court ruling<\/a> \u2064 that barred race-based recruitment policies at colleges, it might prevail in\u2062 its lawsuit, \u2064which would have \u2062the &#8220;potential to influence change in companies that have \u200ctrumpeted Diversity, Equity, and Inclusion (DEI) programs\u2063 that are both racist and illegal.&#8221;<\/p>\n<h2>Supreme Court \u200bBans Race-Based\u200d Admissions<\/h2>\n<p>In\u2063 a 6\u20133 \u2063decision on July\u200d 29, the \u200dSupreme Court struck down the use of racially discriminatory admissions \u2062policies and American \u200ccolleges, ending the\u2062 use of so-called affirmative \u2064action programs in higher \u2063education.<\/p>\n<p>Chief Justice John Roberts wrote\u200c (<a href=\"https:\/\/www.supremecourt.gov\/opinions\/22pdf\/20-1199_hgdj.pdf\" target=\"_blank\" rel=\"noopener\">pdf<\/a>) for the court that,\u2063 for too\u200c long,\u200c universities have \u201cconcluded, wrongly,\u2063 that\u200c the touchstone of\u2063 an individual\u2019s identity is not challenges\u200c bested, \u200dskills built, \u200bor lessons learned but the \u2062color of their skin.&#8221;<\/p>\n<p>&#8220;Our \u2062constitutional history does not tolerate that choice,&#8221; he wrote.<\/p>\n<p>Justice Sonia Sotomayor dissented, \u200cwriting that \u2062the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-lets-starbucks-keep-its-race-based-hiring-quotas\/\" title=\"Judge allows Starbucks to maintain race-based hiring quotas.\">majority decision \u201crolls back decades<\/a>\u200d of precedent and momentous progress.\u201d<\/p>\n<p>\u201cIt holds that race can no longer be\u200b used in a limited way in college admissions,\u201d she added.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A Washington judge dismissed a lawsuit by a conservative group, the National Center for Public Policy Research (NCPPR), against Starbucks.
