McElroy on Aug. 8 sentenced Zeus Lines Management S.A., which owns the tanker Gallissas, to pay $1.68 million in fines and an additional\u2062 $562,500 community\u200b service payment over\u2062 a\u2063 four-year term of probation, during \u2064which any vessels operated\u200c by\u2062 the \u2064company and calling \u200don U.S. ports will be required to implement a robust environmental compliance plan,\u201d the U.S. attorney&#8217;s office\u2064 in the\u200d District of Rhode Island <a href=\"https:\/\/www.justice.gov\/usao-ri\/pr\/ships-operator-captain-and-chief-engineer-sentenced-environmental-crimes-aboard-rhode\" target=\"_blank\" rel=\"noopener\">said<\/a>.<\/p>\n<p>The captain \u200dand chief engineer\u2062 were also sentenced\u200c to terms of \u200dprobation.<\/p>\n<p>The Gallissas was transporting diesel \u200ccargo from Rotterdam, Netherlands, to \u2063Rhode Island in February\u200d 2022 when it discharged nearly 10,000 gallons \u200dof oily \u2062bilge water \u2062into the ocean.<\/p>\n<p>&#8220;Oily \u2062bilge water typically contains oil \u2064contamination from the operation and cleaning\u200d of machinery on the vessel,&#8221; the attorney&#8217;s\u2062 office said.<\/p>\n<p>Chief Engineer Roberto Cayabyab\u2063 Penaflor admitted to \u2062violating the\u2062 Act to Prevent Pollution from \u200bShips for <a pay .25M for polluting oceans.\">knowingly discharging untreated oily\u2064 bilge water directly<\/a> from the tanker into\u200d the sea, federal prosecutors \u200csaid.<\/p>\n<p>The bilge water was\u200c not processed through required pollution prevention equipment, and the \u200billegal discharges were not \u200brecorded in the vessel\u2019s \u200coil record book, as required by law, prosecutors said.<\/p>\n<p>The \u2062Gallissas\u2019 captain, Master Jose Ervin Mahinge Porquez,\u2064 previously \u2063admitted to violating the \u200cPorts and Waterways\u200b Safety \u2062Act for failing to report to the Coast Guard, prior to entering Rhode \u2063Island waters, that \u200cthe system ensuring safe oxygen\u2064 levels within cargo tanks was inoperable.<\/p>\n<p>When the Coast Guard was informed, \u200bit found that oxygen levels\u200d registered more than double the allowable limit and ordered the vessel to move\u200c farther \u200coffshore so \u2062it did not endanger the community of Newport.<\/p>\n<h3>Fraudulent Logbook<\/h3>\n<p>Additionally, the captain\u200c created \u200ba fraudulent logbook showing safe \u2062oxygen levels during the voyage, \u200dwhich was \u2063presented to the Coast Guard during an inspection.<\/p>\n<p>\u201cEveryday thousands of\u2064 ships safely call on U.S. ports and handle nearly 95% of US trade that drives \u2062our economy\u200d and provides for our national security. By sailing \u200cinto a major U.S. port with a known faulty inert gas generator, the operator, and senior officers of the Galissas endangered not \u2062only their\u200c shipmates but \u200dalso the people of Rhode Island,\u201d Rear Adm.
