District Judge Tanya\u200b Chutkan, who is\u200c overseeing special counsel\u200b <a href=\"https:\/\/www.westernjournal.com\/trump-court-bombshell-federal-judge-agreed-jack-smith-former-president-flee-prosecution\/\" target=\"_blank\" rel=\"noopener\">Jack Smith\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/free-speech-not-absolute-obama-judge-admonishes-trump-while-limiting-his-access-to-sensitive-evidence-in-jan-6-trial\/\" title=\"Obama-appointed judge limits Trump's access to evidence in Jan. 6 trial, emphasizes free speech limits.\">ongoing 2020 election meddling case<\/a><\/a> against Trump, actually ultimately agreed with Trump\u2019s defense attorneys on a key issue.<\/p>\n<p>Namely, Trump\u2019s legal \u200cteam was arguing that\u200b the prosecutors\u2019 request for the former president \u2063to\u200b effectively be\u2062 muzzled was a step too far.<\/p>\n<p>According to the <a href=\"https:\/\/apnews.com\/article\/trump-election-capitol-riot-indictment-protective-order-71cd642e876c47fff4e1283c15f8ca01\" target=\"_blank\" rel=\"noopener\">Associated Press<\/a>,\u200c on Aug.\u200c 4,\u200d prosecutors asked Chutkan to \u2063issue a protective order concerning evidence in the ongoing case.<\/p>\n<p>At the time, they argued that \u200bTrump could wield \u2062outsized \u2063influence \u2062if he were to post on social media about\u200c \u201cwitnesses, judges, attorneys, and others associated with legal matters pending against him.\u201d<\/p>\n<p>Now, the bad news \u2063for\u2062 Team Trump: \u200dDespite Chutkan\u2019s agreement with\u200d Trump\u2019s\u200c legal team, she also\u200d agreed with the prosecutors that certain \u201csensitive\u200b materials\u201d should not \u200cmake their\u200b way to \u2063public discourse.<\/p>\n<p>And the kicker: Chutkan is allowing the prosecution to dictate the terms of what is \u2063\u201csensitive\u201d and what is not.<\/p>\n<p>In short, the \u2063prosecution is \u200cstill largely getting what it wants (according\u2063 to <a href=\"https:\/\/www.forbes.com\/sites\/willskipworth\/2023\/08\/11\/judge-says-trumps-free-speech-rights-are-not-absolute-as-she-limits-what-he-can-say\/?sh=5dbce1675103\" target=\"_blank\" rel=\"noopener\">Forbes<\/a>, the prosecutors wanted \u201ca much \u200dbroader protective order\u201d that Chutkan rejected), because they\u2063 are effectively setting the\u200c terms of this \u201cmore limited\u201d \u2062protective order.<\/p>\n<p>Perhaps just as concerning for Trump\u2019s legal team, however, \u200dis the actual rhetoric Chutkan used\u2062 when addressing the court.<\/p>\n<p>She noted that while Trump, \u201clike every \u2064American,\u2064 has a First \u2063Amendment right to free speech,\u201d \u2064that right is \u201cnot absolute\u201d and in cases such as these, \u201cfree speech is subject to the\u200c rules.\u201d<\/p>\n<p>As Forbes described, that specific line appeared to be\u2062 \u201ca direct \u2063repudiation\u201d of the argument \u200bbeing made by Team Trump that any \u2063protective\u2062 order against him would be a violation of his First-Amendment rights.<\/p>\n<p>Chutkan also didn\u2019t\u2063 mince \u2063words when it came to how these legal proceedings could interfere\u200d with Trump\u2019s ongoing bid for re-election.<\/p>\n<p>She told Trump\u2019s team \u2062that it \u201chas to yield\u201d to the legal proceedings, and\u200c \u201cif that means he can\u2019t say exactly what \u2062he wants to\u200b say in a political speech, that is just how it\u2019s going to have to be.\u201d<\/p>\n<p>All parties are set to reconvene on \u2063Aug. 28, when they will attempt to\u2063 hammer out a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/theres-hunter-hunter-biden-appears-in-court-for-paternity-dispute\/\" title=\"There's Hunter: Hunter Biden Appears in Court for Paternity Dispute\">trial start date<\/a>.<\/p>\n<p>That meeting \u2062has the\u2064 potential to be tumultuous, given that Smith\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/twitter-claims-musk-is-slow-walking-trial-over-44-billion-deal\/\" title=\"Twitter claims Musk is \u2018slow-walking\u2019 trial over  billion deal\">proposed start date<\/a> of Jan. \u20632, 2024,\u00a0 has been a source of much frustration from Trump.<\/p>\n<p>In an \u2063ironic twist, the former president actually called that start date \u201c<a href=\"https:\/\/www.westernjournal.com\/trump-rages-jack-smith-proposes-trial-date-general-schedule-election-interference\/\" target=\"_blank\" rel=\"noopener\">election interference<\/a>\u201d because\u2062 of how close\u2063 it is\u2062 to the GOP primary\u200b caucuses in Iowa\u200d \u2014\u2064 the \u201creal\u201d start to GOP primary season.<\/p>\n<p>Further adding to Trump\u2019s woes, Chutkan, who was appointed by former President Barack Obama in 2014, is \u2063described by the AP as \u201cthe\u200d toughest punisher\u201d when it comes to all matters related to Jan.\u200d 6,\u2063 2021.<\/p>\n<p>Trump has pleaded not\u2063 guilty to the four <a
