Pete Sessions<\/h2>\n<p>According to Rep. Pete Sessions (R-Texas), Attorney General Merrick Garland&#8217;s appointment of Delaware U.S. Attorney David Weiss as Special Counsel for the Hunter Biden investigation may violate the law. The law states that the position must be filled by an individual who is impartial and from \u2063&#8221;outside of the government.&#8221;<\/p>\n<blockquote>\n<p>\u201cToday, Merrick Garland hired a Special\u200b Counsel who he knew would \u200cnot investigate the President\u2019s illegal behavior while \u2064he was Vice\u2064 President. He\u2064 is placing the same prosecutor in charge of Hunter \u200dBiden\u2019s sweetheart deal. \u200dDavid\u2063 Weiss has shown himself to not be an impartial decision-maker, and therefore I do not believe he is qualified to be Special Counsel. The \u2064senior Sessions had served as a federal judge before President Ronald Reagan&#8217;s appointment to the FBI position.<\/p>\n<p>Sen. Lindsay Graham, the Ranking Member of the \u2064Senate Judiciary Committee, <a href=\"https:\/\/www.lgraham.senate.gov\/public\/index.cfm\/press-releases?ID=D62A5A43-6528-4257-BC15-E8E8B613FFED\" target=\"_blank\" rel=\"noopener\">pointed<\/a> to the\u200d plea deal as &#8220;the biggest\u200c sweetheart deal in the history of the \u2064American legal system. \u200bTo\u200c allow this same team to continue to investigate potential financial crimes involving Hunter Biden and others doesn\u2019t pass the smell test. On July 26, U.S. District Court Judge Maryellen Noreika rejected the proposed plea deal negotiated by Mr. Weiss and Hunter Biden&#8217;s \u200clawyers that would have granted Biden complete immunity from future prosecution in return for his pleading guilty to two\u200b <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/hunter-biden-plea-deal-cannot-be-the-final-word-grassley-says\/\" title=\"Grassley: Hunter Biden plea not the final say.\">misdemeanor tax evasion charges<\/a> and accepting probation in a third charge in which he acknowledged lying on a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/hunter-biden-special-counsel-appointment-may-violate-law-requiring-government-outsider-rep-sessions\/\" title=\"Rep. Sessions suggests that the appointment of Hunter Biden as Special Counsel may break the law, which mandates an outsider for government positions.\">federal firearm purchase\u200c form<\/a>.<\/p>\n<p>Republicans in \u2063Congress condemned the proposed Biden deal as &#8220;a sweetheart deal,&#8221; and \u200balmost simultaneously with Garland&#8217;s announcement, Mr. Weiss filed a statement \u200dwith Judge Noreika saying efforts to agree to\u200b a\u2062 revised plea deal had failed and the case cannot be\u2062 resolved short of a trial.<\/p>\n<p>\u201cUpon considering his request, as well as the extraordinary circumstances relating to this matter, I have concluded it is in the public\u2062 interest to appoint\u200b him as\u2064 Special\u2063 Counsel. This appointment confirms my \u200ccommitment to provide Mr. Weiss all the resources he requests. It also reaffirms that Mr. Weiss has the authority he needs to conduct a thorough investigation \u200cand to continue to take the steps he \u2063deems appropriate independently, based only on\u2062 the facts and the law,\u201d Garland said. He did not\u2062 respond to shouted questions from reporters assembled for the announcement.<\/p>\n<p>The provision to which Mr. Sessions \u2063referred is in the 1999 law that established the Special Counsel position to replace the Independent Counsel \u200bposition that had previously been used in the Clinton sex scandal investigation,\u2062 the\u200b Iran-Contra probe of 1987, and the \u2064Watergate conspiracy investigation.<\/p>\n<p>Section 600.3 <a href=\"https:\/\/www.ecfr.gov\/current\/title-28\/chapter-VI\/part-600\" target=\"_blank\" rel=\"noopener\">provides<\/a> that &#8220;an\u2063 individual named as Special Counsel shall be a lawyer with \u2063a \u200dreputation for integrity and impartial decision-making, and with appropriate experience to ensure both that \u2062the investigation will be conducted ably, expeditiously and thoroughly, and that investigative and prosecutorial decisions will be \u2064supported by an informed understanding of the criminal law and Department of Justice policies.<\/p>\n<figure style=\"width:600px\" class=\"alignnone\"><figcaption>United States\u200c Attorney Robert Hur speaks at a news\u2062 conference at the U.S. Attorney&#8217;s Office, in Baltimore, Md., on Sept. 19,\u200d 2018. (Zach Gibson\/Getty Images)<\/figcaption><\/figure>\n<p>A \u200dDepartment of Justice (DOJ) spokesman did not respond to The\u200d Epoch\u2064 Times&#8217; request for an explanation of how Mr. Weiss can satisfy\u200c the\u2063 legal requirements for being appointed \u200da Special Counsel. Garland previously appointed Robert Hur as Special Counsel to investigate classified documents in\u2064 the possession of the president that were \u2063found at four separate\u2062 locations in the\u2063 District of Columbia and Delaware. Mr. Hur was not a government employee at the time of his appointment as Special Counsel.<\/p>\n<p>Similarly, Garland appointed Jack Smith in 2022 to investigate President Donald Trump&#8217;s possession of classified documents\u200b at his Mar-a-Logo, Florida, residence. Although a career DOJ attorney, Mr. Smith was working with the Kosovo Specialist Chambers and\u200d Specialist Prosecutor&#8217;s Office.<\/p>\n<p>Mr.\u2064 Sessions and other congressional Republicans argue Weiss cannot be impartial, having accepted the plea deal that gave Hunter Biden complete immunity from all future prosecutions.<\/p>\n<p>Conservative \u2062legal\u200d analysts also blasted the appointment. Article \u2064III Founder and President Mike Davis, a former Senate Judiciary Committee staffer, issued a <a href=\"https:\/\/article3project.org\/media\/a3p-news\/\" target=\"_blank\" rel=\"noopener\">statement<\/a> calling Weiss a &#8220;<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wapos-jennifer-rubin-scores-back-to-back-victories-in-annual-liberal-hack-tournament\/\" title=\"WaPo\u2019s Jennifer Rubin Scores Back-to-Back Victories in Annual \u201cLiberal Hack Tournament\u201d\">loyal foot soldier<\/a>&#8221; for the Biden administration.<\/p>\n<p>&#8220;When this scandal got exposed \u2063by Judge Maryellen \u200bNoreika, we now\u2063 have today\u2019s special counsel\u2062 appointment. Weiss has proven himself as a loyal\u200d political foot soldier for Biden. \u200bAnd Garland\u2019s\u2064 appointment of Weiss as special counsel, \u2063with his &#8216;ongoing investigation,&#8217; will simply shield Biden from accountability before \u200bthe 20<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Counsel for the Hunter Biden probe, but Rep.
